The following is a list of crimes punishable under the Laws of Estragalles.
Individual cities or provinces in the Great Land of Estragalles are permitted, with authority of the Dauphin, to make amendments to these laws based upon the requirements of their own cities, though it should be accepted that the Dauphin’s wisdom, and the wisdom of Dauphin’s previously has been implemental in assembling these laws and they should be adhered to as closely as possible
All breaches of the law will be addressed by local legal authorities and their appropriate representative. This may include, but is not limited to: Local Sheriffs, Dons of Houses, Representatives of the Dauphin, Inquisitors of the Algaian Warband, anyone officially appointed by any of the above.
Guilt will be determined by said appropriate representative of the law of Estragalean descent, in the case of Misdemeanours this will be a single appointed person. In the case of Felonies and Capital Crimes this will be decided by a jury of three appropriate representatives appointed by the above explained peoples present.
In the case of Misdemeanors and Felonies, the judging person(s) will be responsible for determining the punishment. In the case of Capital Crimes the punishment is always Death if found guilty, the method to be determined by the judging parties. Pleas of Clemency are the exception to this and may reduce the punishment.
In all cases, the accused has the right to Trial By Combat instead of trial by judgement. In all cases, terms will be set by the ranking authority on Estragalean Law. The accused must stand for themselves, the ranking authority will appoint representative(s) to stand against the accused.
The Dauphin has the right to amend, create or remove any laws of Estragalles, at any time.
Any officially recognised Priest, or representative of the Churches of the Land, may argue for clemency on behalf of the accused if they believe that their crime was an act of fervour, worship or upholding of the Tenets.
For clemency to be accepted, the accused must accept responsibility and guilt for their crime. The accused will be punished accordingly still, but their punishment may be reduced.
Pleas of clemency must be made by the associated Priest, and will be taken into consideration when the judging parties declare the punishment for the crime. Note, the judging parties are not required to accept the plea of clemency by the officially recognised representative of the Churches of the Land.
- Trespass - Entry into land or property without given permission of the legal owner
- Petty theft - Misappropriation or swindling of any property or services belonging to or provided by another, with a given value of less than five gold
- Assault - Causing unpermitted harm or injury to another
- Disturbing the peace -Behaviour which disturbs the proper order of conduct within a given space. Owner of said space is arbiter on what constitutes improper conduct. Specifically non violent; violent disturbance is classified as rioting.
- Selling poor or prohibited goods - The provision of goods which are not befitting of a citizen of Estragalles - as judged by a council of Estragalean craftspeople if in doubt,, or is prohibited by order of the law, this includes:
- Gravedust
- Art featuring the Dauphin which has not been approved by his person
- Wines and spirits which have not been prepared within Estragalles. Travelling providers of alcohol can apply for limited-duration license to sell such alcohols of inferior nature
- Unicorns Horn
- Unsanctioned Livestock
- Rioting - A violent disturbance of the peace, as explain in misdemeanours
- Inciting riot - Incitation of the above action
- Piracy - Engaging in the action of attacking, robbing or otherwise hindrance of ships
- Sentience Misappropriation - the control of another’s mind, through magic, alchemy or other means unless in self defence, prevention of a crime or acts of war.
- Destruction of property - including damage, of the property of another
- Theft - Misappropriation or swindling of any property or services belonging to or provided by another, with a given value of more than five gold
- Bribery - The Giving or offering of coin or otherwise in the influencing of an official of Estragalles, this includes but is not limited to: Appointed Law Authorities, Overseeing Craftspeople, Military Captains
- Robbery - The unashamed thievery or swindling of a person, by force or threat of force
- Rape - Unlawful and unconsented sexual activity carried out, with violence, coercion or otherwise.
- Murder - Unlawful and premeditated killing of one sentient being by another. This also includes the use of non-sentient beings under one's control in the killing of sentient beings, or the unwilling influence of another’s mind to force them to take a life.
- Treason - Betraying the Blessed Country of Estragalles, or its interests. Including overthrowing, attempting to overthrow the Dauphin, or the Courts of Estragalles, or discussion with that intent. Including any talks, imagery or writing which depicts the Dauphin, or Estragalles in an unbefitting manner.
- Impersonating the Dauphin - Any act which mirrors notable actions of, or is a deliberate parodied impressions of the Dauphin, also dressing similarly as The Dauphin or acting with the intention of being perceived or to be presenting an example of the current Dauphin, or any Dauphin past or yet to be.
