Colorado voters approved the paid Family and Medical Leave Insurance (FAMLI) program in 2020. FAMLI ensures Colorado workers have access to paid leave in order to take care of themselves or their family during life circumstances that pull them away from their jobs, so workers don’t have to choose between earning a paycheck and taking care of their families. When life happens, FAMLI has you covered.
FAMLI benefits officially became available on January 1, 2024. Covered Colorado workers may receive up to twelve weeks of leave per year to:
Bond with a new child, including adopted and fostered children.
Care for themselves, if they have a serious health condition.
Care for a family member’s serious health condition.
Make arrangements for a family member’s military deployment.
Address the immediate safety needs and impact of domestic violence and/or sexual assault.
Those who experience pregnancy or childbirth complications may receive an additional four weeks for a total of 16 weeks per year.
Both employers and employees contribute premiums to the program. Premium contributions began in January 2023. Use the FAMLI Premiums & Benefits calculator to estimate the cost of your premiums and your potential benefit payment.
Flight Attendants are eligible to take CO FAMLI paid leave after they have earned at least $2,500 (having completed at least one "closed" financial quarter) in wages that were subject to FAMLI premiums, anytime over the last 15 months (for new hire flight attendants, that's just 87 flight credit hours).
New hire Flight Attendants, who were employed in Colorado prior to being hired at United, may already be eligible based on earnings from their previous employer.
Flight Attendants have 30 days, after the first day of work missed to start a CO FAMLI claim (up to 90 days if there were extenuating circumstances
Per C.R.S. 8-13.3-509(5) "It is unlawful for an employer to count paid family and medical leave taken under this part 5 (CO FAMLI) as an absence that may lead to or result in discipline, discharge, demotion, suspension or any other adverse action."
This means that any absence which is certified as CO FAMLI should not have attendance points, IE levels (for probationary FAs), or any other discipline assessed. (See Retaliation and Compliance)
Your leave, if approved, is paid by the State of Colorado. Benefits are calculated on a sliding scale using the individual's average weekly wage from the previous five calendar quarters in relation to the average weekly wage for the state of Colorado and may increase over time.
