If you think you are being treated unfairly, you have a few options. Any questions or problems regarding one’s employment status, working conditions, or assignment should be discussed first with the immediate supervisor (e.g., Dean). If a satisfactory solution is not achieved, all other administrative channels should be explored. Every effort will be made to work out problems in a mutually satisfactory manner. Any problem not resolved to your satisfaction should be referred to the FA Chabot Grievance Officer or the FA Las Positas Grievance Officer.
When meeting with a dean or supervisor you may request the presence of a Union Representative. It is your legal right to have Union representation at any point in the process. It is essential that you document and archive any and all contact and communications during each stage of the grievance process. Please see Article 24D in the faculty contract for more information.
If you have issues around class assignments, load, or the peer (or tenure) review process, salary, or benefits, the Union can work with you to reach a resolution. These three areas are addressed in the CLPCCD contract, and although not every detail and experience is covered in contract language, your Union representative will help you to interpret and investigate the issue and look for possible resolutions. All other problems or instances of unfair treatment, even if they are not specifically addressed in the contract can be discussed with your Union representatives. Just talking through it with an experienced colleague with a Union background can be extremely helpful.
More often than not, just speaking with your dean or supervisor will be enough to resolve any conflicts but if you are not satisfied with the outcome, you can reach out by email to the FA Chabot Grievance Officer or the FA Las Positas Grievance Officer. The grievance process is outlined in Article 7 and contains 4 levels. The first step is always required and referred to as Level I. Level I involves meetings with the dean and supervisors involved with or without the presence of the Union rep. The objective is to resolve the matter informally in Level I without a permanent record. If the grievance is not resolved in these meetings further escalation to the college president will be required and you will have the support of your Union rep through the entire process.
