ClimbOn Terms of Use

These Terms of Use define the conditions for using the iPhone application “ClimbOn” provided by [Provider Name] (“Provider”). By using ClimbOn (“the App”), you agree to these Terms.
1. Purpose of the App
ClimbOn is an app designed to support hiking, mountaineering, and other outdoor activities.
The App includes features such as:
• Creating and saving hiking plans
• Importing, saving, and sharing GPX files
• Displaying and recording current location and movement tracks
• Showing route distance, elevation, ascent/descent, remaining distance, and off-route distance
• Displaying maps and saving some map data for offline use
• Pre-hike checklists
• Emergency contact settings
• SOS information display and support for creating SMS/share messages
• Descent notification message creation
The App does not replace hiking judgment, emergency calls, rescue requests, medical judgment, weather judgment, or official safety information.
2. Safety Notice
Hiking and mountaineering involve risks, including falls, injuries, getting lost, hypothermia, heatstroke, rockfall, encounters with wildlife, sudden weather changes, loss of communication, device failure, and battery depletion.
Do not rely solely on the App. Always use additional safety resources such as paper maps, a compass, spare batteries, appropriate gear, current weather information, trail information, local signs, and information from authorities or mountain safety organizations.
Routes, current location, distance, elevation, remaining distance, off-route distance, estimated arrival time, maps, offline maps, pre-hike checks, and SOS messages shown in the App are reference information only and may differ from actual conditions.
3. Location and Map Information
The App uses the device’s GPS, sensors, maps, and external services to display location and map information.
Information may be inaccurate or unavailable due to:
• Reduced GPS accuracy
• Mountains, valleys, forests, buildings, or weather conditions
• Compass or sensor errors
• Outdated or incorrect map, trail, road, terrain, or facility data
• No signal or network failure
• External service changes, outages, delays, or errors
• Device power-saving settings, OS settings, or app permission settings
• Battery depletion, device failure, or app termination
The Provider does not guarantee the accuracy, completeness, timeliness, or usefulness of location, map, route, elevation, or distance information.
4. Route Creation and GPX Import
The App allows users to create routes and import routes from external GPX files.
When importing GPX files, the App may simplify or reduce track points for display and performance. As a result, imported routes may not be displayed or saved with the exact same shape or number of points as the original GPX file.
The Provider does not verify the content, accuracy, safety, trail availability, copyright status, or usage rights of external GPX files. Users are responsible for using GPX files at their own risk.
5. Offline Maps
The App may save some map tiles around saved routes on the user’s device.
Offline maps do not guarantee complete map availability. Maps may be unavailable due to unsaved areas, failed downloads, cache deletion, insufficient storage, or map service changes.
Always use paper maps, a compass, or other backup navigation tools when hiking.
6. Pre-hike Check Feature
The pre-hike check feature is intended to help users review gear and preparation.
The templates and checklist items shown in the App do not cover every mountain, season, weather condition, trip length, skill level, or physical condition. Users must decide what equipment is necessary based on the mountain area, season, weather, route, duration, group size, experience, and personal condition.
Water and food amounts entered in the App are user-entered reference information and do not guarantee actual remaining supplies.
7. SOS Assist Feature
The SOS feature displays emergency-related information such as current location, hiking plan, battery level, pre-hike check status, water amount, and food amount. It also helps create SMS and share messages.
The App does not automatically contact emergency services, police, fire departments, rescue teams, or any other organization. Due to iOS and device limitations, SMS and share messages must be sent by the user.
SOS information display, sharing, or sending may fail due to no signal, device settings, SMS settings, network failure, battery depletion, or app errors.
In an emergency, do not rely solely on the App. Directly contact emergency services, local authorities, nearby people, mountain huts, police, fire departments, or rescue organizations.
8. Background Recording and Battery
Depending on settings and permissions, the App may record location data in the background.
Background recording consumes battery. Recording may be interrupted, incomplete, or stopped due to iOS settings, location permissions, power-saving settings, device conditions, or other factors.
The Provider does not guarantee that recording data will be complete, saved successfully, or restored successfully.
9. Data Storage and Management
Hiking plans, GPX files, recorded tracks, pre-hike checks, emergency contact information, and related data are generally stored on the user’s device or in the device’s file storage area.
If users share data through SMS, share sheets, AirDrop, email, messages, or other apps, the terms and privacy policies of those apps or services apply.
Data may be lost due to device failure, loss, initialization, app deletion, OS issues, insufficient storage, or other causes. Users are responsible for backing up important GPX files and records.
10. Prohibited Conduct
Users must not:
• Violate laws or public order
• Infringe the rights, property, or privacy of others
• Perform unauthorized access, modification, analysis, or reverse engineering
• Place excessive load on the App or external services
• Send false emergency messages or cause harm or nuisance to others
• Engage in any other conduct the Provider considers inappropriate
11. Disclaimer
The Provider does not guarantee that the App is accurate, complete, current, safe, useful, suitable for a particular purpose, continuously available, or free from defects.
The Provider is not responsible for accidents, getting lost, injuries, death, property damage, data loss, communication costs, battery consumption, disputes with third parties, or any other damages arising from the use or inability to use the App, except where liability cannot be excluded under applicable law.
12. External Services
The App may use external services or device functions related to maps, location, routes, elevation, and sharing.
Some features may become unavailable due to changes, outages, restrictions, errors, or changes in terms by external service providers. Use of external services is subject to the terms of each provider.
13. Changes or Suspension of the App
The Provider may change, add, remove, suspend, or discontinue the App’s content, features, specifications, supported OS versions, display content, or data storage methods without prior notice.
14. Changes to These Terms
The Provider may revise these Terms when necessary. Revised Terms become effective when posted on the support page or displayed in the App.
15. Governing Law
These Terms are governed by the laws of Japan.
