Texas is one of the most homeschool-friendly states, and one reason is that homeschools are legally recognized as private schools under state law.

Here's how it works in simple terms:

Homeschooling in Texas = Private Schooling at Home

In 1987, the Texas Supreme Court ruling in Leeper v. Arlington ISD confirmed that homeschools are considered legally equivalent to private schools.

Instead, Texas law assumes that if you’re homeschooling, you’re operating a private school—and you're free to do that with minimal oversight.

To legally homeschool in Texas, you must:

Teach in a bona fide (genuine) manner
→ You can’t pretend to homeschool just to avoid school attendance.
Use a written curriculum
→ It can be purchased, self-made, or part of a program like Classical Conversations.
Cover the following five subjects:
- Reading
- Spelling
- Grammar
- Mathematics
- Good citizenship (this can include civics, history, or character studies)

No Testing or Reporting Requirements:
- You don’t have to register or notify the state
- No testing, portfolios, or evaluations are required
- If your child is withdrawing from a public school, you simply submit a letter of withdrawal
