1. SAFETY IS THE FIRST AND FOREMOST CONCERN! Always obey the lifeguard.
2. ENTRANCE AND REGISTRATION: Entrance to the pool will be granted with residents' use of their household’s electronic Fob. Guests may accompany residents but must be signed in at the front desk by the resident host.
3. CHILDREN:
All children, aged 12 and under, are required to be always accompanied in the pool and pool area by his/her own parent, guardian, or a member 18 years old or older who will be directly responsible for them. (Exceptions: See “B” below). All children are solely the responsibility of their parents. All parents and members agree to release and indemnify the Association from any claims, losses, or liability for whom they are responsible.
Children between the ages of 10 and 12 may use the pool without adult supervision after passing a swimming test. Such a test shall be administered by a lifeguard at a mutually agreed upon time. Upon passing the test, a parent will be required to sign a permission slip, to be maintained at the pool, authorizing the child to swim without adult supervision. The child will also receive a wrist band indicating that he/she has passed the swim test. Wrist bands must be worn at all times when in the pool area without adult supervision.
To comply with health code, children in diapers will not be allowed in the pool without rubber or plastic pants that fit snugly over the diaper. Diapers that are designed for swimming, i.e., Huggies are also acceptable.
4. DAY CARE CHILDREN: The pool is not available to day care children who live outside of the community.
5. GUESTS:
Guests 12 years of age or younger will be admitted free of charge and must be accompanied and signed in by a resident at least 18 years of age who has a valid pool Fob. The resident must always accompany guests - No exceptions.
Guests are free with a resident who has a current pool Fob. Guests must sign in and be accompanied by a resident.
Guests are limited to 5 guests per day unless a private party is booked in advance.
The pool may be reserved for a private party by completing a party reservation form available at the pool. The completed form may be turned in to the pool manager. A separate fee schedule exists for this and is listed on the reservation form. This information may be obtained at the pool or call Swim Club Management Group at 704-766-2726
6. ADULTS: Ten minutes each hour may be set aside for Adults Only Swimming (18 years and older) as announced by the lifeguard. Normally this will be the first ten minutes of each hour, except for the opening hour.
7. HEALTH: Admission to the pool will be denied all people having any infectious diseases. People with excessive sunburn, open sores, bandages, inflamed eyes, colds, nasal or ear discharges, or any other ailments that could adversely affect water cleanliness, and/or endanger the well-being of others will not be permitted in the pool.
8. CLEANLINESS: Caution your children to use the toilet facilities provided in the pool area. Deposit trash in the receptacles. No rocks, debris, gum, or spitting will be allowed in the pool and pool area. No person will be allowed in the pool while wearing street clothes (bathing suits only). There are absolutely no cut-offs permitted. Showering before entering the pool is recommended.
9. DIVING: Diving is allowed in the designated deep end of the lower pool only. Diving may be disallowed for reasons of safety at any time at the discretion of the lifeguards.
10. SAFETY: NO GLASS of any kind is permitted within the pool area - this includes tempered glass goggles and masks. No running, pushing, wrestling, or other horseplay that is unsafe or disturbs the enjoyment of the pool facilities for members is permitted. The pool and the pool area must be evacuated during any electrical storm.
11. FOOD AND DRINKS: Food consumption will be permitted however everyone is responsible for cleaning up after themselves. No glass containers are allowed.
12. INTOXICANTS: Persons under the influence of intoxicants will be denied entrance to the pool area. No alcoholic beverages will be allowed in the pool area.
13. OBJECTS IN THE POOL: No tennis balls or other rigid balls, large toys, floats, rafts, towels, or foreign objects (paper, cans, etc) are allowed in the pool itself. (“Noodles” are acceptable.) Baby floats will be permitted in the upper pool only.
14. NOISE: With due regard to the proximity of some homes to the pool area, and as to not interfere with other pool users, the noise level must be kept to a minimum. Radios and TVs are permitted only with the use of earphones. One radio is permitted on the counter. Volume must be reasonable.
15. POOL EQUIPMENT PRESERVATION: Under no circumstances is any person to play with the cleaning implements. Pool furniture may not be removed from the pool area at any time, nor placed in the pool. Every homeowner is responsible for their family and guests while at the pool. The homeowner may be charged for damage to pool property by a homeowner, their family, or their guest.
16. PETS: Per Mecklenburg County Health Department code, there are to be absolutely no pets in the pool area.
17. PARKING: The circle is for picking up, dropping off, and emergency vehicles only. Violators are subject to having their vehicles towed at the owner’s expense.
18. WEATHER CLOSING: In the event of inclement weather, the pool staff will evaluate pool opening/reopening. A bulletin board will be in a visible place behind the entry gate where information regarding the pool closings will be posted.
19. UTILIZATION: By North Carolina State Law, no person will be permitted to be in the pool or pool area without a lifeguard present.
20. LANGUAGE: No foul language will be tolerated at the pool.
21. SMOKING: No smoking or vaping is allowed inside or near the fenced pool area.
22. RESTRICTED AREAS: No residents are allowed behind the counter, in the office, or in pump rooms except board members, lifeguards and pool committee members unless accompanied by a board member.
23. RULE ENFORCEMENT: The lifeguards and pool manager are responsible for the enforcement of the rules. Any person expelled by the lifeguards or pool manager may also have his or her right to use the pool suspended by the Board in accordance with Article VII, Section 1 (b) of the CC&Rs of the association.
24. POOL PARTIES:
A refundable fee of $100.00 will be required for all parties held at the Brightmoor Pool. A pool party checklist will be given to the party host at the time the request is made for the party. The party host is required to be in the pool area for the entire duration of the party. After the party, the SCMG Pool Management designee will inspect the pool premises to ensure the checklist requirements have been satisfied. If they have, the full deposit will be refunded. If the requirements have not been met, the deposit will be forfeited.
The pool manager will notify a member of the pool committee of any party held at the pool. The committee member along with the pool manager will determine if a party has the potential to create safety hazards to participants, SCMG pool staff or pool facility. If the committee member or manager has a concern, the party host will be contacted for a resolution. If a situation cannot be resolved, the concern will be brought to the Brightmoor HOA Board for an amicable solution.
A reserved party has access to the grills and canopy area but does not have sole use of these areas. Other owners will be permitted to use these at any time.
The party host is responsible for all activities at the party and must always remain present during the party.
NO ONE IS PERMITTED IN THE POOL AREA OTHER THAN DURING POOL HOURS OF OPERATION, WHEN A LIFEGUARD IS PRESENT.
ALL PERSONS USING THE POOL OR THE POOL AREA DO SO AT THEIR OWN RISK.
