These Terms of Service ("Terms") govern your access to and use of the BeWithMe - (Elders) mobile application ("App") and related services ("Services") provided by BeWithMe ("we," "us," or "our").
By downloading, registering for, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
BeWithMe - (Elders) helps older adults and their guardians stay connected through messaging, wellness tracking, reminders, meditation, events, notifications, and safety features such as SOS alerts. The App is a companion tool and is not a medical device, emergency dispatch service, or substitute for professional medical, legal, or emergency advice.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, or use the App under supervision of a parent or legal guardian who accepts these Terms on your behalf. You represent that the information you provide is accurate and that you have authority to use the phone number you register.
Accounts are created using a phone number and selected user role (guardian or elder).
You are responsible for maintaining the security of your device and account.
You may link guardian and elder profiles using in-app pairing features such as QR codes.
You agree not to impersonate others or create accounts using phone numbers you do not control.
Certain features require an active subscription or free trial. Subscription plans may include monthly, 6-month, and yearly options. Prices are displayed in the App and may vary by region.
Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel subscriptions in your App Store or Google Play account settings.
Free trials, if offered, convert to paid subscriptions unless canceled before the trial ends.
Refunds are handled by Apple or Google according to their policies.

You agree not to:
Use the App for unlawful, harmful, or abusive purposes
Harass, threaten, or endanger other users
Upload content that is illegal, offensive, or infringes others' rights
Attempt to reverse engineer, disrupt, or compromise the App or servers
Use automated systems to access the Service without permission
Misuse SOS or emergency features
We may suspend or terminate accounts that violate these Terms.
BeWithMe - (Elders) provides wellness reminders, activity tracking, and communication tools for informational and supportive purposes only. The App does not provide medical diagnosis, treatment, or emergency response services.
Do not rely on the App as your only safety or medical solution.
SOS alerts notify linked guardians; they do not contact police, ambulance, or emergency services automatically.
In a life-threatening emergency, call your local emergency number immediately.
Always follow guidance from qualified healthcare professionals regarding medications and care.
You retain ownership of content you submit (messages, photos, voice notes, writing, and similar materials). You grant us a limited license to store, process, and display that content solely to operate the Services, including sharing with linked guardians or elders as intended by app features.
You are solely responsible for content you submit and must have the rights to share it.
The App may integrate with or link to third-party services (including Apple App Store, Google Play, Firebase, radio streams, TV content, and external websites). We are not responsible for third-party services, content, or policies.
The App, including its design, software, text, graphics, logos, and branding, is owned by BeWithMe or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the App ends, but sections that should survive (including disclaimers and limitations of liability) will remain in effect.
THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEWITHME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50 IF NO FEES WERE PAID.
You agree to indemnify and hold harmless BeWithMe from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.
We may update these Terms from time to time. Updated Terms will be posted with a revised effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws applicable in the jurisdiction where BeWithMe operates, without regard to conflict of law principles. Mandatory consumer protection laws in your country may still apply.
