Welcome to Food Pyramid AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Food Pyramid AI ("we," "us," or "our") governing your access to and use of the Food Pyramid AI mobile application (the "App").
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
To use the App, you must:
Be at least 13 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws
If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Food Pyramid AI is a nutrition tracking and food analysis application that provides:
AI-Powered Food Recognition: Analyze food images using artificial intelligence to identify foods and estimate nutritional content
Nutrition Tracking: Log meals and track daily nutritional intake
Real Food Scoring: Receive scores based on alignment with the 2025-2030 US Dietary Guidelines
Personalized Targets: Calculate protein and nutrition goals based on your physical measurements
Educational Content: Learn about the updated food pyramid and healthy eating principles
Our App utilizes cloud-based artificial intelligence services to provide food analysis:
Food images you submit are transmitted to Google's cloud infrastructure via Firebase AI Logic
Images are processed using Google's Gemini AI models
AI features require an active internet connection to function
Processing occurs in real-time to deliver nutritional insights and recommendations
By using the AI features, you acknowledge and agree that:
Your food images will be transmitted to and processed by third-party cloud services
AI analysis results are estimates and may not be 100% accurate
You are responsible for ensuring you have appropriate data connectivity
AI features may be temporarily unavailable due to network issues or service maintenance
You are responsible for:
Providing accurate information when setting up your profile (weight, height, age)
Maintaining the accuracy of your data
All activity that occurs through your use of the App
Your personal data and meal entries are stored locally on your device
We do not create user accounts or store your personal information on our servers
You are responsible for backing up your device to prevent data loss
Food Pyramid AI offers premium features through paid subscriptions:
Weekly Plan: Billed weekly
Yearly Plan: Billed annually
Subscription pricing is displayed in the App and may vary by region.
Subscriptions are processed through Apple's App Store
Payment is charged to your Apple ID account upon purchase confirmation
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage or cancel your subscription at any time through:
Your Apple ID Settings → Subscriptions
The App Store app on your device
Refund requests are handled by Apple in accordance with their refund policies. We do not directly process refunds. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.
Certain features of the App may be available without a subscription. We reserve the right to modify which features require a subscription at any time.
You may use the App for personal, non-commercial purposes in accordance with these Terms.
You agree not to:
Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to reverse engineer, decompile, or disassemble the App
Interfere with or disrupt the App's functionality or servers
Attempt to gain unauthorized access to any portion of the App
Use the App to transmit malware, viruses, or harmful code
Scrape, harvest, or collect data from the App through automated means
Reproduce, distribute, or create derivative works based on the App
Use the App to infringe upon the rights of others
Submit false, misleading, or inappropriate content
Circumvent or attempt to circumvent subscription requirements
When you submit food images or other content to the App:
You retain ownership of your content
You grant us a limited license to process your content for the purpose of providing App services
You represent that you have the right to submit such content
You agree not to submit content that is illegal, offensive, or infringes on others' rights
IMPORTANT: Food Pyramid AI is designed for general informational and educational purposes only. The App is NOT intended to:
Provide medical advice, diagnosis, or treatment
Replace professional healthcare consultation
Treat, cure, or prevent any disease or medical condition
Serve as a substitute for professional nutritional counseling
You should always consult with qualified healthcare professionals before:
Making significant changes to your diet
Starting any new nutrition or exercise program
Making decisions based on information provided by the App
This is especially important if you have:
Medical conditions (diabetes, heart disease, kidney disease, etc.)
Food allergies or intolerances
Eating disorders or history of disordered eating
Pregnancy or breastfeeding
Specific nutritional requirements
You acknowledge that:
AI-generated nutritional estimates are approximations and may contain errors
Food identification may not always be accurate
Portion size estimates are based on visual analysis and may vary from actual amounts
The App cannot account for all ingredients, preparation methods, or individual variations
You assume full responsibility for:
How you use information provided by the App
Decisions you make based on App recommendations
Monitoring your own health and well-being
The App, including its design, features, content, graphics, user interface, and underlying code, is owned by Food Pyramid AI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
"Food Pyramid AI," our logo, and other marks used in the App are our trademarks. You may not use these marks without our prior written permission.
If you provide us with feedback, suggestions, or ideas regarding the App, you grant us the right to use such feedback without restriction or compensation to you.
The App integrates with third-party services, including:
Google Firebase / Gemini AI: For food image analysis
RevenueCat: For subscription management
Apple App Store: For app distribution and payments
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
Integration with third-party services does not imply our endorsement of those services.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT:
The App will meet your specific requirements
The App will be uninterrupted, timely, secure, or error-free
Results obtained from the App will be accurate or reliable
Any errors in the App will be corrected
AI analysis will be 100% accurate
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOOD PYRAMID AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Loss of profits, data, or goodwill
Personal injury or property damage
Health issues arising from dietary changes
Service interruption or data loss
Any other intangible losses
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS ARE A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.
You agree to indemnify, defend, and hold harmless Food Pyramid AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Any content you submit through the App
Your dietary or health decisions based on App information
You may stop using the App at any time by deleting it from your device. To fully terminate, you should also cancel any active subscriptions through your Apple ID settings.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.
Upon termination:
Your right to use the App will immediately cease
Provisions that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification)
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
Posting the updated Terms within the App
Updating the "Last Updated" date at the top of these Terms
Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Food Pyramid AI regarding the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Nothing in these Terms creates any agency, partnership, or joint venture between you and us.
The headings in these Terms are for convenience only and do not affect interpretation.
