WHAT HAPPENS IF I'M STOPPED WHILE DRIVING?
What should I do if I am contacted by the police or stopped while driving? Anytime law enforcement contacts you, consult an attorney BEFORE answering questions. You ALWAYS have the right to REMAIN SILENT! For most people, that is the best thing to do. You will not be able to talk the police out of arresting you. You are much more likely to hurt your case than to help yourself. The police will write a report later, and somehow, that police report always seems to cast your conversations with them in the worst possible light.
If you are required you to sign a traffic ticket, sign the ticket. Signing the ticket is NOT ADMITTING GUILT. If you refuse to sign, an the officer can arrest you.
REMEMBER:
DO NOT interfere with the office issuing the ticket.
DO NOT argue with the officer.
DO NOT lie.
DO NOT be rude.
DO NOT try to explain or try to deal with the situation at the scene; an attorney can argue in
Court that you rights may have been violated.
**A special note for anyone stopped by the police for drinking and driving (In Colorado until you are arrested, you do not have the right to ask for an attorney as it may be seen as a refusal to take an alcohol or drug test.):
DON'T answer any questions!
DON'T answer questions about what you had to drink!
DON'T do field sobriety tests! They are voluntary.
DON'T say the alphabet!
DON'T follow any object with your eyes!
DON'T stand on one leg!
DON'T give the police any information!
