RIGHTS OF PERSONS AGAINST SELF-INCRIMINATION

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. YOU ARE REQUIRED TO TELL THE POLICE THAT YOU WILL NOT SPEAK WITH THEM AND THAT YOU WANT AN ATTORNEY EVERY TIME THEY COME BACK TO SPEAK WITH YOU. YOUR REQUEST FOR AN ATTORNEY IS ONLY GOOD FOR 14 DAYS.

There are numerous considerations that must be considered in determining whether your rights have been violated and whether your statements will be kept out of trial.The best course of action for most people when confronted by the police is to REMAIN SILENT and to ASK FOR AN ATTORNEY.

You have the right to remain silent and refuse to answer questions. DO NOT MAKE A STATEMENT and DO NOT WRITE A STATEMENT.
