THIS INDENTURE made the 10th day of Octr. in the year of our Lord God 1664 Between PETER JOHNSON of the County of Rappa: & Parish of Sittingbourne Planter of the one partie & the VESTRY of the PARISH aforesd on the other party Witnessoth that the sd PETER JOHNSON for & in consideration of the sum of five hundred pounds of good lawfull tobacco in hand received of the PARISH aforesd hath given sold & made over & doth by these presents fully give & make over from him the said PETER JOHNSON his heirs & Successors four acres of land with the appurtenances set lying and being in the Parish aforesaid & on the South POINT that maketh the mouth of a Creek called OCCUPACY & to be laid out as neer as may be Square on the sd POINT the same to have and to hold from the date hereof for ever & further that the sd PETER JOHNSON his heirs or assignes shall & will before the last day of November next or sooner if thereunto lawfully called by the PARISH or VESTRY of the same make & execute or cause to be made a good sure rightfull perfect absolute & lawful! estate in the Law of the said land to the only proper use of the said Parish for ever with warranty at& all men whatsoever by from or under him claimeing or pretending any claime to any part or parcell thereof. My will is that my son-in-law Jno Martin go free and be for himself and that he have the tuition of my son Peter Johnson until he be twenty years of age alwaies Provided that the said John Martin give my son Convenient Education and Maintenance and take no ill Courses wherein if he falters in any Respect my will is that my executor James Jackson to take my son Peter into his Guardianship and that he remains with my executor the terme aforesaid. From the above information we see that Ann Johnson formerly Ann Martin married to John Martin 1630-1667 was still alive in 1672 but not mentioned in Peter Johnson's will of 1683. Ann Martin had two children named Katherine and John prior to her marriage to Peter Johnson, proved by sale of cattle to the children.
Peter Johnson stated in his will that John Martin was his son-in-law which at that point in time was the terminology used for step-son. The term step-son did not become the popular term until the late 1850s. He also said he was to be set free which may have meant that he was nearing the age of 21. He also mentioned his son Peter Johnson who was to inherit everything was a minor in 1683. So Peter Junior was probably born about 1670?

This Peter Johnson has to be the son of the Peter Johnson whose will was recorded in 1683. This John Martin making the purchases was most likely John Martin '41 as the John Martin mentioned in Peter's will died in 1715. This John Martin above purchased a parcel of old pewter (from the actual document) and several other items. In John Martins '41 inventory at his death it was described that he had a parcel of old pewter.
