Tony Serbinski took Lindsay Ross' Chevy Van, boat, and other belongings, and demolished Ross’ shed. Serbinski left these things in the yard belonging to the business of Ross’ Pentoga Trail neighbor John Melchiori:

Ross only learned of this, a month after it had happened, by a mailing from the lawyer of a major landowner named Andreski who is trying to dispossess Ross of his land. Ross filed a federal civil rights lawsuit pursuant to 42 U.S.C. § 1983, based on violation, under color of law, of his rights pursuant to the following provisions of amendments to the U.S. Constitution: 5th that “[n]o person shall . . . be deprived of . . . property, without due process of law”; and 14th, Section 1, that “[n]o State shall . . . deprive any person of . . . property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
