Dear Owner/HOA Members:
Please see the attached and finalized copy of Resolution 19-02 (Clarification of the Requirements for Fences in Excess of Four Feet in Height Within the Bohicket Landing HOA). This updated copy corrects a few grammatical errors and clarifies that the variance must be filed at the Onslow County Register of Deeds by the Board of Directors (BoD). The owner is responsible for completing the application and reimbursing the HOA for any fees charged by the county that are associated with the filing.
Since there have been no objections or other comments submitted by the membership when this rule was distributed on 13 AUG 19, the resolution is adopted as amended on 19 AUG 19. If you submitted a request for variance after 13 AUG 19, you do not need to submit another one. The BoD will review applications in the order they are received, but since we expect to review more than 20 requests it will likely take several weeks to complete them all. If you have any questions or concerns, please contact a BoD member.
As mentioned in the past few emails and web site postings, compliance notices were mailed to individual owners today, 27 AUG 19. Each notice outlines a compliance issue and provides a reference to the article or paragraph in the covenants, ASC guidelines, or other HOA governing document that is in question. Each issue in the notice was checked multiple times by a different BoD member to ensure it was an actual violation of a HOA governing document.
While some of the violations are recent occurrences (such as the need to file a variance for fences > 4 feet, trash receptacles not stored properly, etc.), many others have been issues for many months (such as failing to maintain ditches or swales on the property, unfinished repairs, etc.). If you receive a notice, please make corrections, within the timeline specified in the letter. If you have questions about an issue recorded in the letter, wish to dispute an issue, or need additional time to make any repairs, please contact a BoD member in writing or by email. The purpose of recording the request in writing is to ensure the question, request, or dispute is clearly understood and to ensure there is a record of the issue in the event there is a dispute between the HOA and the owner.
On a different note, the BoD is currently taking proposals to improve the boat ramp common area. This will include at street lights at the ramp/parking area, nautical themed rope borders, a picnic area, and other hardscape or landscape improvements. Once a final bid is accepted, we’ll forward completed plans and other details to the membership. I expect the construction to begin sometime this fall/winter so as to have the least impact on those who use the ramp area.
