In North Carolina there are a number of documents that govern the establishment and operation of Home Owner Associations (HOA). Essentially there are three types of governing documents; (1) Declaration of Covenants, Conditions, and Restrictions (CCR), (2) HOA ByLaws, and (3) Rules, Guidelines, & Regulations. The attached PDF file (EXPLANATION OF HOA GOVERNING DOCUMENTS) provides a general description of each of these types of documents.
All CCR, Bylaws, and Rules that pertain to the Bohicket Landing HOA are available for review or download on the HOA website’s Resource Center.
North Carolina HOAs are also governed by two important state laws; (1) NC General Statute (G.S.) 47F – The North Carolina Planned Community Act and (2) NC G.S. 55A – The North Carolina Nonprofit Corporation Act. NC G.S. 47F provides for the establishment and regulation of a HOA, the responsibilities, authority, and rights of HOA members and directors, and other measures governing a HOA. NC G.S. 55A establishes that HOAs must operate as nonprofit organizations and imposes other state requirements.
