Parents/guardians have a right to inspect and review any of their child’s educational record(s) within 5 business days after their request, and before any meeting of an Individualized Education Program (IEP) or hearing related to identification, evaluation or placement of the child.
Requested records must be made available within five (5) business days of the request. Requests received after school hours will be noted as received on the next business day.
When school is not in session in excess of five school days (i.e., winter break, summer), a district representative will contact the school of attendance in order to gain access to the physical records at the site in order to provide the records within the five (5) day requirement.
Parents may access student IEPs electronically via the Parent Portal. Older IEPs (prior to 2015) are not available in the Parent Portal, but are within a student's cumulative folder.
All special education records are kept at the student's last school of attendance, therefore requests for those records should begin at the last school of attendance. The request made at the school site may be in person, orally or in writing, including via fax, recognized email or email attachment. If circumstances prevent this, the parent may go directly to the Education Center, Special Education Division (Annex 6A) and complete a “walk-in” request form. This request will be forwarded to the school to process.
Other records not available at the school site may be requested in person at the Education Center Annex 6A or via email at specialedrecords@sandi.net.
Within 5 business days, school staff should prepare the records and communicate with parents that records are ready for review and may be picked. There is no cost associated with the first copy of the records.
The parent may review or pick up records in the school office. Additional copies can be made upon request at 10 cents per page.
A signed notice of representation by an attorney or advocate that has been provided to the school site/district does not require the school district to provide the records to the representative. Parents may request an additional copy for their attorney or advocate with an associated cost of 10 cents per page and then provide that copy to their representative.
