The No Pass/No Drive law (HB 32) was implemented on August 1, 2007. In the new legislation, this law will apply to ALL students 15, 16, and 17 years old who apply for a permit or license on or after August 1, 2007.
It is important to understand that when a fifteen, sixteen, or seventeen year old goes to the circuit court clerk’s office to obtain a permit, a School Compliance Verification Form must be presented verifying that the student is in compliance with KRS 159.051.
The School Compliance Verification Form may be picked up in the Pulaski County High School Counselor's Office for students enrolled at Pulaski County High School.
In order for a student to be in compliance with the law and receive the verification form, they must be passing 4 of 6 classes and must not have 9 unexcused events in the semester.
If a sixteen or seventeen year old does not present a school compliance verification form he/she will not be eligible to obtain a permit.
When a sixteen or seventeen year old student drops out of school, has 9 unexcused events in a trimester or is declared to be academically deficient (not passing 4 out of 6 classes),the permit/license will be suspended. The Division of Driver Licensing will suspend the student’s privilege to drive and notify the driver of the suspension. At the end of the following semester, if all criteria is met the permit/license will be reinstated.
