Pupil Rights

NOTIFICATION OF RIGHTS UNDER THE PROTECTION OF THE PUPIL RIGHTS AMENDMENT (PPRA)

Parental consent must be obtained for a child to participate in any student survey, analysis, or evaluation that concerns one or more of the eight areas of protected information surveys. Parents must also consent to the collection, disclosure, or use of student information for marketing purposes and certain physical exams and screenings.

The eight areas of protected information surveys are:

• political affiliations or beliefs of the student or student’s parents;

• mental or psychological problems of the student or student’s family;

• sexual behavior or attitudes;

• illegal, anti-social, self-incriminating, or demeaning behavior;

• critical appraisals of others with whom respondents have close family relationships;

• illegally recognized privileged relationships, such as with lawyers, doctors, or ministers;

• religious practices, affiliations, or beliefs of the student or parents; or

• income, other than required by law, to determine program eligibility.

Parents/guardians and eligible students have the right to be notified of, to inspect, and to opt out of participation in any of the above surveys, analyses, or evaluations as well as any survey that is sponsored/funded by sources other than the U.S. Department of Education.
