It is a felony to make a false or fraudulent material statement to obtain or deny any compensation. It is a crime to knowingly assist, conspire with, or solicit any person in an unlawful act of workers' compensation insurance fraud.
Penalties
A felony conviction can result in up to five years in prison and a fine of up to $150,000, or double the amount of fraud, whichever is greater.
Prohibited Conduct
This includes making false statements to obtain or deny compensation, or to discourage an injured worker from claiming benefits.Â
Examples of Fraud
This includes exaggerating or fabricating injuries, claiming benefits for non-work related injuries, or receiving benefits from more than one employer for the same injury.
