Completed application and payment indicate that you have read and understand the Terms & Conditions IN FULL and express your acceptance, agreement, and compliance. If any vendor is found in violation of the Terms & Conditions below, a penalty including but not limited loss of booth fees and/or restriction of further participation may be enforced.
Vendors must follow all Federal, State, and Honolulu City & County laws.
Vendors are responsible for their own merchandise and liability of their products. Vendors are responsible for their own taxes and applicable insurance, permits, and licenses required to run their business. This includes, but is not limited to food trucks and food service vendors.
LIABILITY: Vendors assume full liability and responsibility regarding the guarantee and warranty of all products sold. It is understood and agreed that the company, organization, vendor, or individual submitting this application will release and hold harmless the State of Hawaii, Department of Education, Mililani High School, MHS Athletics Foundation, the individual organizers, and volunteers of the Craft Fair from litigation arising from any damage, loss, theft, illness, or injury to any person or property caused by the activities, equipment and/or exhibit of the undersigned in or about the facilities at Mililani High School during the event that the Vendor has signed up for. The organization/individual submitting this application accepts the location(s) in an "as is" condition, with all faults, known and unknown. MHS Athletics Foundation reserves the right to terminate this Application at any time by giving the Vendor/Organization five (5) days prior written notice. Mililani High School, the MHS Athletics Foundation, and the individual organizers of the Fair assume no liability for any damaged, lost, or stolen items, or bodily injury, including, but not limited to, reason of weather, accident, vandalism, or theft.
DOE INDEMNIFICATION STATEMENT: The undersigned individual(s), group, and/or organization, his or their heirs, personal representative and assigns, or its officers, directors, members, agents, employees, successors and assigns, for and in consideration of the State of Hawai'i Department of Education permitting and allowing the use of the designated school rooms, buildings, and/or facilities jointly and severally agree(s) to indemnify and save harmless the State of Hawai'i Department of Education against any and all loss, liability, demands, claims, suits, action or proceedings of every name, character and description which may be suffered or incurred by or brought against the State of Hawai'i Department of Education for or an account of any injuries or damages to any person or property received or sustained by any person, directly or indirectly, by or in consquence of the use of the facilities by the undersigned individual(s), groups, and/or organization.
PROHIBITED ITEMS: The following products or depictions of said items are strictly prohibited: words, logos, or pictures containing alcohol, tobacco, drugs, profanity, gang identification, bigotry, violence, weapons, or sexual connotations. No clothing, jewelry, or other accessories that may be used as a weapon including but not limited to sharp points, studs, spikes, metal, razors, knives, nooses, or clubs. Mililani High School and the MHS Athletics Foundation reserve the right to ban the sale of any items deemed to be offensive or inappropriate for a family-friendly environment. Any items deemed inappropriate must be removed from sale and display immediately.
NO CAMPAIGNING: Solicitation or campaigning activities for any person, organization, or affiliation is strictly prohibited.
REGISTRATION: MHS Athletics Foundation Food & Craft Fair opens early registration to Returning Vendors first, then remaining spots are made available to the public for registration. (Returning Vendors are those that participated in the SAME EVENT the previous year.) Provide a valid email address and mailing address on your registration form. Craft Fair communication is sent exclusively by email. Only vendor confirmation packets and parking passes are sent by USPS Mail.
BOOTH ASSIGNMENTS
Mililani High School holds multiple fairs annually and the booth map is subject to change from event-to-event, so WE DO NOT RESERVE PREVIOUSLY-OCCUPIED SPACES FOR RETURNING VENDORS. Vendors are able to indicate their preference but specific booth spaces are not guaranteed.
Booth map and vendor assignments are subject to change for any reason at the discretion of Mililani High School and the MHS Athletics Foundation.
CANCELLATION POLICY
THERE WILL BE NO REFUND OF REGISTRATION FEE FOR CANCELLATIONS ONCE YOU HAVE BEEN CONFIRMED FOR A BOOTH.
Refunds will only be issued if we are unable to place you in a booth.
Credits will be issued if cancellation is received in writing to craftfairs@mhsathleticsfoundation.com no later than 30 days prior the event date. Credits may be used only toward booth fees for a future MHSAF Food & Craft Fair.
Refunds/credits will not be issued in the event of cancellation due to vendor non-compliance.
SETUP/BREAKDOWN (may vary depending on event):
For MHSAF November & April events: You may arrive as early as 7:00 am and should be set up by 8:45 am. Be advised that volunteers will not be available to assist you if you arrive prior to 7:00 am.
PARKING LOT VENDORS: Vendors may drive up to unload everything at your assigned space(s), then immediately move to one of the designated vendor parking areas.
To reduce vehicular congestion and maintain safety in the parking lot vending area, do NOT set up as you unload and conversely, at the end, do not pack up as you load. ACTIVE LOADING/UNLOADING ONLY.
For the safety of customers, at the close of the event, vendors will not be allowed to drive their vehicles into the parking lot vending area until AFTER 2:15 pm.
For vendors assigned to building walkway booths, cafeteria, or on-campus booths, there will be designated drop-off areas for you to unload. Our athletes and coaches will be available to help you transport your things to your assigned booth.
PARKING: Vendors may use the MHS upper parking lot for unloading/loading before and after the event. We reserve parking in the upper lot for the convenience of the shoppers. Please park in the designated vendor parking areas on-campus (enter from the back of campus on Kipapa Drive) or at Mililani Waena Elementary School. If you require Disabled Parking accommodations, please contact the Event Coordinator.
EQUIPMENT: Your display is very important. Please provide an attractive display that includes all the equipment you need. You must bring your table, chairs, racks, displays etc. to fit your space. Measure your merchandise before the Fair and adjust accordingly.
TENTS: You must fit in the space you purchased with no part of your setup (including tarp, guide wires, chairs, tables, merchandise, etc.) extending beyond your boundaries. Please secure all tents with sandbags or weights (no stakes) to avoid tents flying away. You will be financially responsible for any damage your tent may cause to other vendors, shoppers, and/or property of Mililani High School.
POWER: Power is not provided. To ensure the comfort and safety of our vendors and shoppers, generators are only allowed in designated areas. Generator use must be approved by the Event Coordinator ahead of the event. Unauthorized generators will be shut down and booth fees will not be refunded.
CHILDREN: If your children are accompanying you, they must stay in your booth and not wander the property unattended.
WEATHER: The MHS Athletics Foundation Food & Craft Fair will go on, rain or shine. Be prepared for inclement weather. The date of the Craft Fair may be subject to change in the event of a natural disaster or due to Department of Education mandates.
CLEANUP: You are responsible for disposal of your own trash. You may take it with you or dispose of it in the dumpster behind the cafeteria. Please clean your space before leaving.
ILLNESS: For the safety of our vendors, volunteers, and shoppers, if you are experiencing any COVID-like symptoms which include (fever higher than 100°F, chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, or diarrhea), please DO NOT ATTEND this event. Please find a replacement to work your booth. Be safe and stay home.
CONDUCT POLICY: We are committed to providing a safe and respectful environment for all our customers and vendors. Any form of inappropriate or violent behavior, including but not limited to verbal harassment, threats, or physical aggression, will not be tolerated. We reserve the right to take appropriate action, including removal and termination of services against individuals or entities who engage in such behavior. Maintaining a positive and safe atmosphere is our priority, and we appreciate your cooperation in upholding these standards.
DRESS CODE: All vendors and their products must comply with school policies, including school dress code, as this event takes place on school grounds. Please refer to the Mililani High School website for the full dress code policy.
Tops/shirts must meet or cover the waistband of bottom attire when standing or sitting normally –No midriff skin or undergarment is allowed to be shown. Necklines for tops must not be lower than the “line” across the underarms.
Skirts and shorts shall be worn at an appropriate/acceptable length for sitting as well as standing. Skirts and shorts should be no shorter than your fingertips when arms are extended downward to the sides. No exposed skin through garments.
No dress or fashion which include words, logos, or pictures containing alcohol, tobacco, drugs, profanity, gang identification, bigotry, violence, weapons, or sexual connotations.
Underwear may not be worn as an outer garment and should not be exposed when sitting or standing normally.
No see-through, backless, or tight, form-fitting clothes that are too revealing.
No tube tops/bandeau, midriff tops or strapless tops.
No cut, torn, ripped, or frayed clothing that shows undergarments or where tear is above the thigh.
No clothing, jewelry, or other accessories that may be used as a weapon including, but not limited to sharp points, studs, spikes, metal, or sharp pointed finger nails, razors, knives, leashes, nooses, or clubs.
Remember, the images depicted on the shirt must also comply with dress code.
We reserve the right to refuse service to anyone.
ADDITIONAL GUIDELINES FOR FOOD TRUCKS/FOOD SERVICE POP-UPS:
Food Vendors, please ensure that you are in compliance with Hawaii Department of Health guidelines as it applies to your products. You are not required to submit the food permit to us, but please have documentation available in the event of a Dept. of Health visit. If you are not in compliance, you may be subject to fines or be shut down. In the event of a closure due to non-compliance, booth fees will not be refunded.
Food Service Vendors must provide a Certificate of Liability Insurance naming the following as additionally insured:

Email your COI to craftfairs@mhsathleticsfoundation.com no later than one month out from the event or risk cancellation of your registration.
A Special Event Food Permit must be obtained unless your products fall under the exemptions as stated below. A copy of the permit should be on hand in the vendor's booth on the day of the event.
EXEMPTIONS TO SPECIAL EVENT FOOD PERMIT:
Vendors who distribute or sell prepackaged foods that are also non-potentially hazardous, or vendors who distribute or sell “homemade food products*” or “hand-pounded poi” directly to the consumer, are not required to obtain a Special Event Food Establishment permit. “Homemade food products” means not potentially hazardous food produced or packaged by the vendor in their home kitchen. Some common examples of “homemade food products” are baked goods, chex mix, popcorn, but DOES NOT include cream-filled pastries, baked goods with meat, pickled food items, homemade salsas, jerky or smoked meats/fish, low acid canned foods and garlic in oil. Vendors cooking on-site with an open fire or propane must have a working fire extinguisher in your space and should be easily accessible and visible. All cooking vendors must use a metal drip pan or cookie sheet under their cooking apparatus. Rug/carpets/cardboard are not allowed.
SAMPLES: All food samples must be individually packaged (i.e., sample cups), no toothpicks. If offering samples, you must also provide a trash receptacle for sample waste.
No canned or bottled water/soda are allowed as the school will be doing a drink booth to fundraise.
Special Instructions for Vendors Selling “Homemade Food Products"
Vendors selling homemade food products made in a home kitchen must comply with the Hawaii State Department of Health food safety code for Homemade Food Operations. Visit the Dept. of Health website at http://health.hawaii.gov
Examples of Homemade Food (HMF) Products include, but not limited to:
Breads, rolls, mochi
Cakes, cookies, and pastries
Candies and confections
Jams, jellies, and preserves
Cereals, trail mixes, and granola
Popcorn
Puffs & pies and similar food items that require refrigeration will not qualify as an HMF.
All HMF products require specific labeling with the following information (see example below):

FOODS NOT ALLOWED AS “HOMEMADE FOOD PRODUCT” AND REQUIRE A SPECIAL EVENT FOOD PERMIT:
Fermented foods, acidified foods, canned or bottled foods, dried meats or seafood, low acid canned foods, and garlic in oil. Examples of these foods include: kimchee, pickles, beef jerky, and the like.
