7) Service Agreement

COMPUTER REPAIR / SERVICE AGREEMENT

Please read this service agreement, as it is the contract between you and DunganSoft Technologies, should you desire our services.

This may be updated at any time, and DunganSoft Technologies shall not be required to notify on such an update.

1. DISCLAIMER

1.0 DunganSoft Technologies, performs and provides services, consultation, repairs, and upgrades as requested by the Customer.

DunganSoft Technologies conducts honest, reasonable, and considerate services.

Our goal is to provide the highest quality of service and support, but specific results cannot be guaranteed.

1.1 Service, Repairs and Consultations are provided as a payable service, and payment is expected at the conclusion of the service.

1.2 There may be circumstances under which Services, Repairs, or Consultations cannot be provided.

1.3 The length of time required to complete such Service, Repair, or Consultation cannot be predicted.

1.4 Customer understands and agrees that in the process of working on their equipment, there is a potential for data loss.

The Customer agrees that they have made the necessary backups of data so that, in the event of such loss, the data can be restored.

DunganSoft Technologies, will not be responsible for data loss nor be responsible for restoring lost data.

1.5 DunganSoft Technologies, may refuse to provide services to, or report persons to law enforcement that:

A) Willing and blatantly use unlicensed software or equipment.

B) Are in possession of materials that by law, require us to report.

We will provide every effort and courtesy to Customers should they seek assistance to remove such material or are obtaining

legitimate and legal software or equipment.

1.6 You authorize the technician(s) providing the service or repair to preform any necessary action or install any necessary software to

perform required services. Such software may be deleted or uninstalled upon completion of the service.

1.7 DunganSoft Technologies assumes that the Customer is procuring services for equipment they own, and that the Customer has the

full ability and right to set forth the manner of repair and or disposition of the equipment.

1.8 The Customer acknowledges that Service is preformed with the agreement that equipment is placed under an express technicians

lien to secure payment of services, storage or repair.

1.9 All Remote Repair services are subject to the terms in this agreement.

1.10 if any provision of this agreement is, or is found to be, unenforceable under an applicable law, that will not affect the enforceability

of the other provisions of this agreement.

2. BILLING TERMS

2.0 Computer services/repairs/consultations are billed as stated on the service order or invoice provided. The most common services are

charged fees that are agreed upon between the Customer and DunganSoft Technologies at the time of service. Base examples

of such fees can be found on the services page of http://www.dstaftn.net/home/services. Services not listed on the Services page

may be charged by the hour.

2.1 The minimum charge for any service is one (1) hour. Minimum invoice amount is $25.00 Standard Hourly Fees are $35.00 per hour.

2.2 Not all services can be completed on site. Some Services may require a trip or mileage fee.

2.3 An estimate of cost for work will be provided before performing computer Services/Repairs. Estimates are not guaranteed.

2.4 In the case that there is an unforeseen deviation beyond the above estimated amount, every effort will be made to contact the

customer and inform them of the situation and receive authorization to continue or stop at the estimate limit.

2.5 In the case that you cannot be reached, work will stop until contact is established. Once you are reached; your decision to continue

or stop will be honored by DunganSoft Technologies, but the customer will be charged for time and services accrued.

2.6 All services/repairs are subject to Colorado State Sales Tax, if applicable.

2.7 Services or Repairs may require a good faith deposit, of at least 50% of the expected estimate. Such deposits are applied to the

balance of the bill, and refunds will be provided should it be in excess of the invoiced amount.

2.8 Obtaining legal and legitimate software or equipment is not considered an unforeseen deviation beyond any estimated amount.

Customers will still be charged for time and services accrued should the customer decline the procurement of required items.

2.9 Storage of equipment is billed at a minimum rate of five ($5.00) dollars per day, per item, for up to thirty (30) days, where the item

will then be considered abandoned and forfeit to any claim. Such items will be disposed in any necessary manner to recover costs

incurred, should an item be lost to abandonment, no refunds will be given, should the disposal net more than the costs incurred.

3. PAYMENT TERMS

3.0 Full payment is due upon completion of services, upgrades, or repairs.

3.1 DunganSoft Technologies may provide payment arrangements, and such agreements must be in writing.

3.2 Computer parts, hardware, and software that need to be special ordered must be paid in advance.

3.3 DunganSoft Technologies accepts cash, or check. Major credit cards can be used to pay online. Customers will be charged

a $75.00 service fee for any returned check and all credit card payments will have a $2.00 transaction fee included to the

total amount of the bill. Should a bill become past due more than thirty (30) days, Any collection effort, or service fee required will be

added to the unpaid balance of the bill.

3.4 As defined in section 1.8, The Customer acknowledges that an express technicians lien is placed on their equipment, until full

payment for services is satisfied. Placing of liens, Retrieval of equipment, or the disposal of stored equipment will commence

alongside any collection effort.

3.5 Storage fees must be paid in full, before the release of any item, even if a payment arrangement is made to satisfy the balance of an

account.

4. LIABILITY

4.0 Service(s) are provided in an effort to fix, upgrade, or otherwise repair the computer system(s) for which you request such service(s).

4.1 Your system will not be intentionally harmed. The primary goal is to fix your computer; not damage it.

4.2 In the case of accidental damage to your system, including data loss caused by already existing problems in your system such as

viruses, poorly configured software, hardware problems or hardware failures; You agree to hold DunganSoft Technologies, and any

person(s) associated with DunganSoft Technologies or involved in the work being done for you harmless from damages resulting

from such problems.

4.3 It is your responsibility to backup your data. DunganSoft Technologies will not be responsible for data loss or any other damages.

(See 1.4 above).

4.4 DunganSoft Technologies is not responsible for software deemed to be unlicensed. Our default action will be to verify that such software is actually unlicensed, obtain any products needed to complete compliance, then charge the customer for the costs

to bring them into compliance. Again, at the Customers option we will remove the software or equipment that is unlicensed

in order to satisfy licensing requirements, with the understanding that this may effect the operation of such equipment

or services to be rendered.

4.5 Should DunganSoft Technologies report content on your equipment, you agree to hold DunganSoft Technologies, and any persons

associated with DunganSoft Technologies or involved in the work being done for you, harmless from damages or loss resulting from

such problems. DunganSoft Technologies may charge you for forensics or legal fees should reporting be required.

5. SUPPORT

5.0 Customer satisfaction is our utmost importance.

5.1 All services will be conducted in a professional, reasonable, and timely manner. Also, taking into consideration the circumstances

and nature of the technical problems.

5.2 Free support will be provided for problems to be resolved from the service order that were not resolved. After 7 days from the

date on the invoice, DunganSoft Technologies will no longer offer free support.

5.3 Warranty work will only be covered if it is related to the work on the invoice. Unrelated work will not be covered by the warranty

and may be charged accordingly.

6. REPAIRS & SERVICE GUARANTEE

6.0 All services and repairs are guaranteed for 7 days from the date on the Invoice or Service Order.

6.1 If later found that the service or repair was incorrectly diagnosed by the technician; then DunganSoft Technologies will perform the repair/service free of any labor charge. Only parts will be charged if needed to correct the problem.

7. ESTIMATES

7.0 DunganSoft Technologies offers free estimates over the phone or E-mail.

7.1 For in home/on site estimates there will be a Minimum $25.00 fee. If you decide at that time you would like DunganSoft

Technologies to work on your system, this fee will be waived and you will only be charged for the service being performed.

(See 2.1 above).

7.2 If you decide at the time of the in home service call you would not like DunganSoft Technologies to fix your computer; you will be charged the $25.00 service call fee and will have to pay for the full price of any service performed in the future (The $25.00

dollar fee will not be waived).
