Due to the lack of federal programming and funding for gifted education, most gifted legislature and funding is left to the states. North Carolina's state statue regarding gifted education is Article 9B. This statute defines academically gifted and talented students as exhibiting high performance capability in intellectual areas, specific academic fields, or in both intellectual areas and specific academic fields. The article identifies a need for differentiated programming and services and states that giftedness is present in students from all cultural and socioeconomic groups. The article also states the responsibilities of local district LEA's and the State Board of Education in regard to gifted programming and funding. Each school district is responsible for creating a local plan designed to identify and establish a procedure for providing appropriate educational services to each gifted student.
