Information technology disputes (and how to avoid them)

While the root cause of many Information Technology disputes revolves around a lack of specification, that is by no means the only cause of IT disputes. As well as exploring what we mean by a “lack of specification”, Dai will look at other common causes of IT disputes.

Some IT disputes stem from the procurement process and what goes wrong in the procurement process. Perhaps you believe that will not happen when you buy software on a trial basis and test it out first? However it is easy to be caught out and end up in a contract that you don’t want in that situation, also.

What happens when there is no “formal” contract, but you buy software by clicking to accede to an agreement on the web: a so-called “click-wrap” agreement?

When a business uses a consultant to write the software who owns the software: the business or the consultant? What happens when the agreement between the business and the consultant is silent on this point, or there is no agreement?

In his keynote, Dai will be exploring the causes and impact of IT disputes, as well as looking at what can be done to resolve them.

Dai Davis is a Technology Lawyer and Chartered Engineer. He holds Masters degrees in both Physics and Computer Science. He is a Chartered Engineer and Member of the Institution of Engineering and Technology. Dai has for decades consistently been recommended in the Legal 500 and in Chambers Guides to the Legal Profession. Having been national head of Intellectual Property Law and later national head of Information Technology law at Eversheds, Dai is now a partner in his own specialist law practice, Percy Crow Davis & Co.

Dai has a nationwide legal practice, including many London clients. Dai advises clients on Information Technology law, Intellectual Property law and Data Protection issues. Dai is a non-executive director of FAST (The Federation Against Software Theft) and a Liveryman of the City of London through the WCIT (Worshipful Company of Information Technologists).

He is primarily a transactional lawyer, drafting and helping clients to negotiate agreements in his specialist area. Further “super specialisms” that Dai has practised for over two decades are software security issues, high-tech product safety and product recall, including the law relating to the CE, UKCA and UKNI Markings.
