Parent/Guardian Notification

Parents/guardians are our partners in education and should be continuously updated on a student’s progress towards English proficiency and academic achievement. To ensure that parents/guardians can make an informed decision for the student, they must receive information regarding assessment results in a timely manner.


Schools must share assessment and MLP placement information with parent(s)/guardian(s).  The shared information must include the student’s proficiency level, and program options and offer an opportunity to opt out of MLP services. This parent/guardian notification must be provided in a language that the parent/guardian requests.

Parent/Guardian Waiver of Services

Parents/guardians can decline to enroll the student in such a program or choose another program or method of instruction if the eligible entity offers more than one program or method. When discussing waiving services for students, the academic benefits of participating in the ML Program and any potential challenges associated with waived services should be addressed.

It is important for the parents to understand that although she/he has declined services for the student, the school must provide the student with equal access and opportunity towards obtaining language proficiency while meeting academic needs. MLs with a waived status are still eligible for classroom and testing accommodations on state-mandated assessments and may have an ILAP as applicable. A waiver exempts the student from receiving direct instructional services, however, they will still participate in yearly English language proficiency testing until they meet the state’s reclassification criteria.

If the parent/guardian still wishes to decline MLP services for the student after this discussion, the parent/guardian must sign the district approved MLP Waiver letter provided by the student’s MLPS indicating this decision. Each year, this written documentation must be completed for a student to be waived from MLP direct services and must be kept on file.
