Many people are aware if fireworks are allowed or not in their state or country. However, many are unaware of the specifics of fireworks or the harm they may be causing. For New York States the specifics can be found in Penal (PEN) CHAPTER 40, PART 3, TITLE P, ARTICLE 270; unlawful dealings with fireworks and dangerous fireworks.
It is important to understand the definitions of fireworks, dangerous fireworks and sparkling devices before searching for the regulations present where you live. Below are tabs with information about what classifies fireworks at each type, and which states do and do not allow said firework type.
What are dangerous fireworks?: Dangerous fireworks are defined as high powered items capable of causing serious harm.
Examples of dangerous fireworks: large firecrackers, M-80, M-100, silver salutes, quarter sticks and cherry b-mbs.
What States allow dangerous fireworks?: Currently no states permit the use, possession or distribution of dangerous fireworks.
What are fireworks?: Fireworks are either ground based or aerial and are categorized as display fireworks.
Example of Fireworks: cakes, bottle rocket, roman candles.
What are sparkling devices?: Ground-based or handheld items and novelties.
Examples of sparkling devices: fountains, wooden sparklers, party poppers, snappers.
Many states only permit certain kinds of fireworks, this includes the sale and possession of any of the types mentioned above. Even if they are bought out of state and brought in you still have to follow the laws for your state. There are a multitude of misdemeanors that can be given out if firework regulations are violated.
