Quick Overview
McKinney-Vento is federal legislation that protects the education of students in transition (ie., homeless) [42 U.S.C. § 11432(g)(6)(A)(i)].
The legislation defines what homeless means (living temporarily due to loss of housing as a result of financial or other hardship) which includes living with others and hotels.
The McKinney-Vento Act's definition of homeless is different from the HUD definition of homeless.
HUD definition does not include doubled up or hotel living situations.
Community resources that use HUD funds cannot use the funds for doubled up or hotel situations. They must rely on private or other funds.
If a student qualifies for the program, the student is provided rights and services to aid in removing any barriers to accessing and participating fully in school.
