1. Booking courses and training  

1.1. Where we use the term 'training', this is used as a general term to refer to all our courses, training and events listed on this website. Where we use 'Vulnerable Paths', this is the brand name used to describe training delivered by, or on behalf of, Matt Radford as owner of ©VulnerablePaths. 


1.2. Where we use the term 'order' this refers to requests for training. What you agree to when booking training is sometimes referred to as 'the contract'.


1.3. Details of courses and training are on our website vulnerablepaths.co.uk. We work to describe the content accurately, but we cannot guarantee that training or training materials will be exactly as described. 


1.4. You can make a booking by emailing, online or phoning directly. The training price will be the price on Vulnerablepaths.co.uk when you book, or the price on your booking confirmation.


1.5. Prices shown on our website do not include VAT. This is added to your invoice.


1.6. Discounts on training must be agreed when booking, and can’t be used after training has been booked.


1.7. When your order has been received and accepted, these terms become a legally binding contract between us.


1.8. If we are unable to accept your order, we will let you know in writing and won’t charge for your booking.


1.9. 

a) To continue course accuracy and quality, we may change training or materials content when there are changes in relevant laws, regulations or practice.

b) If we must make significant changes to these terms or the training (example - changing the date or costs), we will notify you. You will have the option to end the contract before the changes take effect.

c) If we must postpone training at short notice (example - a trainer becomes ill and unable to deliver face to face training), we will contact you. Where we cannot give a new date which you are happy with, we will refund your payment.


1.10. In some cases, we need extra information from you for us to give training. We will contact you in writing to ask for this information. If you do not give us this information (within a reasonable time), or if you give us incomplete or incorrect information, we may end the contract (see 'our right to cancel training' below).


1.11. We might need you to download materials as part of training. Trainees are responsible for downloading the correct content before training starts. 

2. Deciding which training is best

2.1. You need to make sure you choose training where you have the right knowledge, experience to participate, and the training is what you want.

3. Your Right to cancel training

3.1. If you are purchasing as a consumer, for most training bought online or over the phone you have a legal right to change your mind within 14 days and receive a refund under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations 2013.


3.2. The right to cancel does not apply to:

a) training that has been specifically tailored to your requirements.

b) Products (such as training materials or other digital products) after you have started to download or stream these. c) Training , once it has started.


3.3. By booking training, where the start date is less than 14 days away, you agree that you have requested that the service begin before the end of the 14 day cancellation period.

If you exercise the right to cancel after booking the training, but before the normal 14 days cancellation period has expired, you will be responsible for the cost of the service provided up until the cancellation date. 

Any refund will be in proportion to the services provided in comparison with the full service.


3.4. To exercise your right to cancel you need to advise us in writing. Please email matt@vulnerablepaths.co.uk. Please provide your name, details of the order and, where available, your phone number and email address.


3.5. If you are eligible, we will refund you the price you paid for your order by the method you used for payment. 

We will make any refunds due to you within 14 days of your telling us you have changed your mind.

4. Changing training date or training type

4.1. To transfer to a different training type or training date :

a) More than 14 days' notice, no charge

b) Less than 14 days' notice, 30% charge

5. Possible costs for cancelling

5.1. You can always end your training with us.


5.2. Except where you are exercising your Right to cancel (see 'your Right to cancel Training' above), the following cancellation fees will apply to training:

a) With more than 14 days' notice, the cancellation fee is 30%

b) Within 14 days of the commencement date, the cancellation fee is 100%

c) Failure to attend any training without notifying Vulnerable Paths incurs a 100% charge.

6. Changing who receives training

6.1. If you can’t attend your training, you can choose someone to take your place at no extra charge, as long as you notify us in writing 30 days in advance of the training date. 

7. Our Right to Cancel Training

7.1. We may cancel training at any time by writing to you if:

(a) You fail to pay by the due date, or within seven days of us reminding you that payment is due.

(b) You don’t, in a reasonable amount of time, provide us with information that is necessary (as highlighted in clause 1.10) for us to provide the training.

(c) If we have to cancel as per (a) or (b) above, we will refund any money you have paid in advance for training we have not provided but we may deduct or charge you all reasonable costs and reasonable compensation for the loss and damage we incur as a result of your breaking the contract.


7.2. Changes and cancellations to our training can be made up to 14 days before they starting. If we cannot find a suitable alternative, we will refund any sums paid. We will not be responsible to refund any travel or accommodation expenses booked before the training.

8. Events outside our control (Somtimes called 'Force Majeure')

8.1. In the event that we can’t carry out our obligations due to something beyond our control, such as but not limited to acts of God; acts of terrorism; travel cancellations; strikes or lock-outs by third party organisations; flood; third parties failing to deliver services; and war, Vulnerable Paths shall be relieved of its obligations and liabilities. 

9. Intellectual Property Rights 

9.1. The Intellectual Property Rights of Vulnerable Paths training, training content, training materials, events, courses, course materials, assignments, recordings and tests are owned by Vulnerable Paths.


9.2. You agree that you will not rent, lease, sub-license, loan, copy, modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works based on the whole or any part of Vulnerable Paths training or use (other than as permitted under these Terms) reproduce, share or deal in the course of training or any part in any way.


9.3. You are welcome to view, copy, and print materials within the Vulnerable Paths training content as long as your use of the information is for informational, personal, and non-commercial purposes relating to your training.


9.4. Vulnerable Paths training participants may not, under any circumstances, upload any of their work or any Vulnerable Paths content or recordings to social media or sharing websites. 

You agree to reimburse Vulnerable Paths for all loss and damage suffered as a consequence of any postings by you on social media. In such circumstances Vulnerable Paths reserves the right to terminate all licences and permissions under this Agreement.

10. Limitation of liability 

10.1. Nothing in the Contract shall limit or exclude Vulnerable Paths liability for:

a) Death or personal injury caused by its negligence, or the negligence of its agents or subcontractors.

b) Fraud or fraudulent misrepresentation.

c) Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law.


10.2. Subject to clause 10.1 above, Vulnerable Paths shall not be liable to the customer, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for: loss of profits; loss of sales or business; loss of agreements or contracts; loss of anticipated savings; loss of use or corruption of software, data or information; loss of damage to goodwill; and any indirect or consequential loss.


10.3. Subject to clause 10.1 above, Vulnerable Paths total liability to the customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to 100% of the total Charges paid under the Contract.


10.4. This clause 10 shall survive termination of the Contract. Reserves the right to terminate all licences, permissions, and membership privileges granted to the member under this Agreement.

11. What payments we accept

11.1.

a) We accept payment by BACS

b) Payment is due 30 days from the invoice date or before the course starts, whichever is sooner.

c) In the event that an invoice is not paid on the due date, we reserve our right to charge statutory interest at a rate of 8% plus the Bank of England base rate from the payment due date until the date of actual payment.

2. We try our best to serve up the highest quality content. In the unlikely event of an issue with any content on the site, we cannot accept responsibility for any loss of money, opportunity, or reputation caused by using our content.


3. There are external links to useful sites on vulnerablepaths.co.uk. We do not accept responsibility for the content on third-party websites – they will have different Terms and Conditions.


4. We work hard to make sure our security is up-to-date, but we cannot guarantee that third-party viruses or other malware will not happen, or that the site will be online and working perfectly 100% of the time. If anything does break, please flag it up and bear with us as we fix it at the soonest reasonable oppertunity.
