Terms of Sale
1. General Conditions
This agreement applies to all sales of products by XepherTech, including digital goods (software license keys) and physical goods (new, used, or refurbished hardware). All sales are final, with exceptions as specifically outlined below.
2. Sales of Digital Goods (Software Licenses)
Nature of the Sale: The sale is for a non-physical, digital license key. The use of the software is governed by the End-User License Agreement (EULA) of the original software company, not by XepherTech.
Delivery: All purchased license keys will be delivered electronically to the email address you provide.
Refunds and Swaps: All sales of software license keys are final and non-refundable once delivered. However, if a key is found to be non-functional upon first use, a one-time swap for a new key may be provided.
Verification: You agree to allow a XepherTech technician to remotely or in-person verify that the key provided is non-functional before a new key is issued.
Resolution: Upon verification of a non-functional key, a replacement key will be provided. XepherTech is not responsible for any issues resulting from a key that was already activated or used.
3. Sales of Physical Goods (Hardware & Components)
Condition of Products: Products sold may be new, used, or refurbished. The condition of each item will be clearly described on its product listing or invoice.
Sourcing: Products sold by XepherTech may be acquired from a variety of retail, business, and online marketplaces. We ensure all products are thoroughly inspected and, if necessary, refurbished to meet our quality standards before being offered for sale.
Warranty:
New Products: Any warranty on new products is provided by the original manufacturer. XepherTech will assist in the warranty claim process where possible but is not the warrantor.
Refurbished Products: XepherTech provides a limited warranty for a period of 30 days from the date of sale on refurbished hardware. This warranty covers hardware defects that are not a result of customer misuse, physical damage, or unauthorized modifications.
Warranty Exclusions: This warranty does not cover software issues, damage from viruses, misuse, drops, spills, power surges, or any repair or modification attempts by you or another party.
Returns and Refunds:
You may request a return within 7 days of the date of sale for a refund or exchange. The item must be returned in the exact condition in which it was sold, including all parts, accessories, and original packaging.
Items that have been damaged, modified, or are not in their original condition are not eligible for a return.
XepherTech reserves the right to charge a restocking fee of up to 15% for returned items.
4. Acceptance of Donated Goods
XepherTech may accept donations of hardware and components. By donating an item, you agree to transfer full ownership of the item and all its contents to XepherTech. You acknowledge that donated items may be used for parts, refurbished for sale, or responsibly recycled at our discretion.
5. Limitation of Liability
XepherTech’s total liability for any issue related to a sale shall not exceed the purchase price of the product. XepherTech is not responsible for any indirect, special, incidental, or consequential damages, including but not limited to lost data or business interruption, even if advised of the possibility of such damages.
