RELIGIOUS PERSECUTION PROTECTION
Definition:
Religious persecution protection refers to legal and humanitarian measures designed to safeguard individuals or groups who face threats, discrimination, or violence because of their faith, belief, or religious identity. It is recognized under international human rights law as a fundamental right to freedom of religion and belief.
1. International Legal Framework
a. Universal Declaration of Human Rights (UDHR)
Article 18: Everyone has the right to freedom of thought, conscience, and religion.
Protects the right to change religion or belief and to manifest it in teaching, practice, worship, and observance.
b. International Covenant on Civil and Political Rights (ICCPR)
Article 18: Reinforces freedom of religion and prohibits coercion that impairs this freedom.
States must ensure protection against discrimination based on religion.
c. 1951 Refugee Convention
Defines a refugee as someone with a well-founded fear of persecution for reasons including religion.
Provides the right to seek asylum and protection from refoulement (forced return).
d. UN Human Rights Council and Special Rapporteur on Freedom of Religion or Belief
Monitors global violations and issues urgent appeals or reports to the UN General Assembly.
2. Forms of Religious Persecution
Violence and Intimidation: Physical attacks, killings, or threats against religious minorities.
Legal Discrimination: Blasphemy laws, forced conversions, or restrictions on worship.
Social Exclusion: Denial of education, employment, or housing due to faith.
Destruction of Religious Sites: Targeting churches, mosques, temples, or cemeteries.

a. National Protection
Constitutional guarantees of religious freedom.
Human rights commissions or ombudsman offices.
Legal remedies through courts or human rights tribunals.
b. International Protection
Asylum and Refugee Status: Granted by host countries under UNHCR supervision.
Human Rights Petitions: Filed before the UN Human Rights Committee or regional courts (ECHR, IACHR, ACHPR).
