All building plans, including extensions or alterations, must be submitted for approval by the Controlling Architect and Aesthetic Committee of Waterberry Estate; before submission to City Council for final approval. No construction will be allowed on Waterberry Estate without these processes being followed.
Important to familiarize yourself with the Rules of Waterberry Estate, before any construction commences:
1. Make an appointment with the Controlling Architect and Aesthetic Committee to discuss the Rules and Procedures.
2. Submit the following to the Managing Agent:
Building deposit - Proof of payment (R 10 000.00 for a house and R 2 500.00 for extensions or alterations) Paid to Waterberry Estate HOA account.
Controlling Architect fee - Proof of payment (R 3 000.00 for a house and R 1 500.00 for extensions or alterations) Paid to Controlling Architect account.
4 copies of plans (1 colour and 3 black and white) for approval, by the Controlling Architect and Aesthetic Committee
Plans for approval must consist out of the drawings and information as set out in the Rules. Click here for more info.
The Controlling Architect will also follow up with the Managing Agent if the following criteria has been met by the owner:
The HOA levies of the owner is up to date
The person applying is the owner of the property
The Building deposit has been paid
3. After approval from the Controlling Architect and Aesthetic Committee the owner must submit the plans to City Council with the Waterberry Estate stamp on.
4. After approval from City Council the owner and contractor signs the Contractors Rules and registers his/her contractor at the Managing Agent's offices: 17 Goetz Street, Potchefstroom.
1. The following preparation is done on the stand:
Stand must be enclosed with green shade cloth (at least 60%) on the border of the stand, at a minimum height of 1.8m and a gate for entrance before any further steps
Boundary must be identified by erven pens
Water meter must be installed with a tap (the owner must contact the developer to get a water meter: christa@moedi.co.za)
Contractor’s electricity box must be installed and switched on by Voltano (at the owner’s expense)
Chemical toilet must be installed on the stand
No material my be delivered to the stand prior to inspection and approval of site establishment
2. The Controlling Architect with the Aesthetic Committee is informed to do inspection on site, before construction may continue.
The following documents must be presented at the inspection:
Builder's NHBRC certificate
NHBRC enrollment certificate of the house
Approved plans by HOA and City Council
1. Weekly inspection is done by the Aesthetic Committee and the Managing Agent.
2. The contractor and his staff compliment are not permitted to walk around the Estate. The contractor and his staff compliment shall only be permitted to enter or exit the Estate through the designated points at the entrance, and only by being transported by a vehicle of the contractor.
3. The owner has 1 calendar year (12 months) to complete construction from the date of enclosing stand or materials delivered to the stand.
4. The site must be enclosed at all times and only once construction is completed, may the green shade cloth and chemical toilet be removed from site.
5. Construction activity: Monday – Friday 06:30 – 17:30 Saturday 07:30 – 13:00 Sunday/Public Holidays - No contractors allowed
The following certificates must be sent to the Managing Architect when requesting Final Inspection:
1. Foundation certificate from WEARC
2. Final Inspection certificate from WEARC
3. Occupation certificate from JB Marks Municipality
4. Foundation certificate from Structural Engineer
5. Roof certificate from Structural Engineer
6. C.O.C. certificate from Electrical Contractor
7. Aluminium frame windows & door Certificate
8. Gas Installation Certificate
9. Plumbers Certificate
10. Letter from the architect, that inspection has been done and that everything is built according to the approved plan
11. As-built plans sent to the Managing Architect
12. Approved set of plans
At the Final Inspection, the following will be inspected by the Managing Architect and Aesthetic Committee:
• The stand must be clean, including the road and any other stand due to the construction
• The shade net, chemical toilet and contractors’ electricity box must be removed (and only when all construction is completed)
• The construction must be done according to the plans approved
After the final successful inspection from the Controlling Architect and Aesthetic Committee may the Building Deposit be refunded to the owner.
Please familiarize yourself with the Rules of the Estate, not to be fined for not complying. Here are only some of the fines as explained in the Rules:
The speed limited within the Estate is 30 kph for ordinary cars and 20 kph for delivery vehicles. Transgression of road signs, speed limit, and / or reckless driving will not be accepted within the Estate. Due care must be taken that no road/s are blocked during loading or off-loading of material and equipment at any building sites. Those who transgress this rule will be liable to pay a fine of R500,00 and such fine is to be paid within 5 days after it has been imposed.
The staff compliment of the service provider shall be transported by vehicles to and from their place of work within the Estate by the service providers or designated personnel. The staff compliment who is working on more than one site and who has to move between different sites in the Estate shall only do so by means of a vehicle.
All building activity must be done inside the shade net, that has been erected on the boundary of the stand. No building related activity might encroach onto adjacent stands, park areas, or any communal areas. Any service provider transgressing this rule is subject to a R2 000,00 fine being imposed by the Association. The said penalty is to be paid within 5 days after it has been imposed.
The service provider and owner hereby declare that they understand the contents of the rules and confirm that they are bound by the terms and conditions contained herein. The service provider and the owner further undertake to enforce the said rules to other third parties who will carry out work at the Estate through them.
The service providers and owner further undertake to comply with any other rules and regulations to be imposed by the Association from time to time. The service provider shall provide his particulars by completing an application form to be provided by the Association prior to the commencement of work. If any of the particulars provided change; the service provider shall notify the Association accordingly by completing another form.
Failure by the service provider to comply with the rules will result in the enforcement of penalties, fines and suspension as stipulated in the rules.
The Association shall enforce the penalties, fines and suspension imposed as a result of the contravention of the Rules.
Any fine imposed will be payable to the Home Owners Association within 5 working days at the managing agents offices. If the fine is not paid within the prescribed period, building operations will be suspended until such time as payment has been made.
