These Terms of Use (“Terms”) are a legal agreement between you and the developer, Kaan Dındış (“Vumio,” “we,” “us,” or “our”), governing your use of the Vumio mobile application and related support services (collectively, the “Service”).
These Terms supplement Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”). If these Terms conflict with the Apple Standard EULA or mandatory law, the Apple Standard EULA or mandatory law controls to the extent of that conflict.
By downloading, purchasing, or using Vumio, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you enter information about a baby or another person, you are responsible for ensuring that you are authorized to record and manage that information.
Users who are not legally able to agree to these Terms or make purchases independently should use Vumio and make subscription purchases only with the permission and supervision of a parent or legal guardian.
Vumio is a personal organization and record-keeping tool that helps users log and review baby-care information such as:
breastfeeding and bottle feeding;
pumping and solid food;
sleep and diapers;
walks and baths;
weight, height, and head circumference;
temperature, medicines, doctor visits, vaccines, and illness or symptoms;
mood and milestones.
Features may include timers, history, summaries, charts, reminders, multiple baby profiles, personalization, local storage, and optional iCloud synchronization.
We may add, change, suspend, or discontinue features where reasonably necessary. We do not promise that every feature will always be available on every device, operating-system version, language, or country.
Vumio is not a healthcare provider, medical device, diagnostic tool, treatment service, or emergency service. It does not establish a doctor-patient relationship and does not provide medical advice.
Records, summaries, charts, reminders, suggested tracking choices, and other outputs depend on information entered by users and may be incomplete, delayed, inaccurate, or unsuitable for your circumstances.
Do not use Vumio to diagnose, prevent, monitor, or treat a medical condition, determine medication dosage, or replace professional medical judgment.
Always seek advice from a qualified healthcare professional about health concerns involving you or a child. Never disregard or delay professional advice because of information shown in Vumio.
In an emergency, contact your local emergency services immediately.
You are responsible for:
the accuracy, legality, and appropriateness of information you enter;
obtaining any permission required before entering another person’s information or photo;
reviewing records and correcting errors;
protecting your device and Apple Account;
maintaining any device or iCloud backups you consider necessary;
keeping independent copies of information that you cannot afford to lose;
using Vumio in compliance with applicable law and these Terms.
You must not:
use Vumio for an illegal or harmful purpose;
violate another person’s privacy or rights;
attempt to gain unauthorized access to Vumio or related services;
interfere with or disrupt the app’s operation;
introduce malicious code;
circumvent subscription or access restrictions;
reverse engineer, decompile, or modify the app except where applicable law expressly permits it.
You retain your rights in the baby profiles, photos, notes, and other content you enter into Vumio (“User Content”).
Vumio processes User Content locally on your device to provide the features you request. If you enable iCloud sync, supported User Content is processed through your personal Apple iCloud environment.
The developer does not receive or store your baby profiles, care records, photos, or notes on Vumio-operated servers.
Because this information is stored on your device and, if enabled, in your private iCloud environment, we may not be able to access, restore, or recover it for you.
Vumio stores supported information locally on your device.
If you enable iCloud sync, Apple CloudKit synchronizes supported information using the Apple Account on your device. Sync timing and availability depend on Apple, your device, internet access, available storage, and your settings.
No storage or synchronization system can be guaranteed to be uninterrupted, error-free, or immune from data loss.
Deleting records, profiles, all app data, the app itself, or associated iCloud data may be permanent and may affect other devices connected to the same Apple Account.
You are responsible for maintaining any device, iCloud, or independent backups you consider necessary.
Some or all Vumio features may require an auto-renewing subscription.
The available subscription plan, billing period, price, currency, trial or introductory offer, and included features are displayed before purchase. These may vary by country, eligibility, or time.
Purchases are processed by Apple through your App Store account. We do not directly receive or store your payment-card details.
If you start a free trial or introductory offer, it will convert to the paid subscription shown on the purchase screen unless you cancel before the trial or offer ends.
Subscriptions automatically renew unless canceled through your Apple Account within the period specified by Apple. Apple controls billing, payment processing, renewal, cancellation, refund eligibility, and purchase history.
You can manage or cancel your subscription through your Apple Account subscription settings.
Deleting Vumio does not cancel an active subscription.
You may use Restore Purchases inside the app to restore eligible subscription access. Trial and introductory-offer eligibility is determined by Apple and may be limited to eligible users or Apple Accounts.
We may change subscription prices or included features in accordance with applicable law and Apple’s rules. Where notice or consent is required, it will be handled through the App Store.
Except where required by applicable law or Apple’s policies, payments are non-refundable. Contact Apple for billing and refund requests.
Vumio is licensed, not sold.
Subject to these Terms, the Apple Standard EULA, and the App Store Usage Rules, you receive a personal, limited, revocable, non-exclusive, and non-transferable license to install and use Vumio on Apple-branded devices that you own or control for personal, non-commercial purposes.
Vumio, including its software, design, text, graphics, trademarks, branding, and other content excluding User Content, is owned by the developer or applicable licensors and is protected by intellectual-property laws.
No rights are granted except those expressly provided by these Terms and the Apple Standard EULA.
Vumio relies on third-party services, including Apple services and RevenueCat, for functions such as:
App Store distribution;
purchases and subscription management;
restoration of subscription access;
local device notifications;
Apple Search Ads measurement;
optional iCloud synchronization.
Your use of those services may also be governed by their own terms and privacy policies.
We are not responsible for third-party services or interruptions outside our reasonable control.
We may release updates to maintain security, compatibility, or functionality.
Vumio may occasionally be unavailable or operate differently because of maintenance, network conditions, third-party service interruptions, device limitations, operating-system changes, or events beyond our reasonable control.
We do not guarantee uninterrupted availability, compatibility with every future device or operating-system version, or that every error will be corrected.
To the fullest extent permitted by law, Vumio is provided “as is” and “as available.”
We do not guarantee that:
Vumio will always operate without interruption or errors;
notifications will always arrive at a specific time;
synchronization will always complete immediately;
records or summaries will always be complete or accurate;
Vumio will remain compatible with every device or operating-system version;
information deleted by a user can be recovered.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
Vumio is provided as a personal record-keeping and organization tool, not as a healthcare service, medical device, diagnosis, or treatment tool.
Records, charts, summaries, and reminders rely on information entered by users and may be incomplete, inaccurate, or delayed.
To the fullest extent permitted by law, the developer is not responsible for losses arising from:
inaccurate or incomplete user entries;
delayed or undelivered notifications;
device, network, or iCloud problems;
deletion, corruption, or loss of data;
interruptions or actions of third-party services;
use of Vumio as medical advice or as a substitute for professional medical judgment.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or any mandatory consumer rights available to you.
You may stop using Vumio at any time.
We may suspend or terminate access to Vumio if you materially violate these Terms, misuse the Service, attempt to circumvent subscription restrictions, create a security or legal risk, or if we discontinue the Service.
Where reasonable and legally required, we will provide notice.
Deleting the app or stopping its use does not automatically cancel an App Store subscription. You must cancel the subscription through your Apple Account.
Provisions that by their nature should continue after termination, including intellectual-property provisions, disclaimers, liability limitations, and payment obligations, will remain effective.
We may update these Terms to reflect changes to Vumio, subscriptions, service providers, business practices, or legal requirements.
We will publish the revised Terms and update the “Last updated” date. Where required by law, we will provide additional notice or request consent.
If you do not agree to revised Terms, you must stop using Vumio.
Vumio is licensed under Apple’s Standard EULA, available at:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These Terms supplement rather than replace the Apple Standard EULA.
Apple is not responsible for providing maintenance or support for Vumio. The developer, not Apple, is responsible for Vumio and for addressing questions or claims concerning the app, subject to the Apple Standard EULA and applicable law.
If any provision of these Terms is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of that provision.
You may not transfer these Terms without our consent. We may transfer them as part of a merger, reorganization, transfer of the application, asset sale, or operation of law.
These Terms, the Privacy Policy, the purchase information shown before subscription, the Apple Standard EULA, and applicable Apple terms form the agreement concerning your use of Vumio.
