Terms and Conditions for Vocab Vault

Welcome to Vocab Vault ("App"). These Terms and Conditions ("Terms") are a legal agreement between you ("you," "user") and EduStar Studio ("we," "our," or "us") governing your access to and use of the Vocab Vault mobile application and related services ("Services").

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Description of the Services

Vocab Vault is a mobile application for learning vocabulary using spaced repetition. The App currently focuses on GRE vocabulary. The Services include, but are not limited to:

• Browsing and enrolling in vocabulary decks

• Studying flashcards in daily batches, scheduled by a spaced repetition algorithm

• Tracking your progress, statistics, and study history

• Adding your own notes and mnemonics to individual words

• Synchronizing your progress to our servers while you are signed in, so it is available on your other devices

• Vocab Vault Pro subscription: an ad-free experience and access to premium decks

• A free tier supported by advertising. Free users may see an ad after completing a study session, but viewing an ad is not required to study.

We may add, change, or discontinue features from time to time, including the decks and exams we cover. Continued use of the App after such changes constitutes acceptance of the updated Services.

2. Eligibility and Account

2.1 Eligibility

You must be at least 13 years of age, or the minimum age in your jurisdiction to consent to these Terms, to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2.2 Account Registration and Accuracy

• An account is required to use the App. You can create one with an email address and password, with Google Sign-In, or with Sign in with Apple.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2.3 Account Security

Notify us promptly at edustarstudio@gmail.com if you suspect unauthorized access to your account. We are not liable for loss or harm resulting from unauthorised use of your account caused by your failure to protect your credentials.

3. Acceptable Use

3.1 Permitted Use

You may use the App only for personal, non-commercial study, in accordance with these Terms and applicable law.

3.2 Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable law.

• Copy, modify, distribute, sell, or create derivative works from the App or its content, including deck content, except as expressly allowed by us.

• Reverse engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.

• Use automated means such as bots or scrapers to access the App or collect data without our permission.

• Interfere with or disrupt the App, our servers, or networks, or circumvent any access or security measures.

• Impersonate another person or entity, or misrepresent your affiliation.

• Use the App to harass, abuse, or harm others, or to transmit malicious code or content.

• Resell, sublicense, or commercially exploit the App or any content provided through it, except as we may explicitly allow.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.

4. Subscriptions, Payments, and Refunds

4.1 Vocab Vault Pro and In-App Purchases

• Vocab Vault Pro is offered as an auto-renewing subscription through the app store from which you downloaded the App. Payment is processed by that store and its payment providers. We do not receive or store your payment details.

• Subscriptions are available in monthly, six-month, and yearly terms. The exact title, duration, and price are shown in the App and in the store at the time of purchase, in your local currency.

• Payment is charged to your store account at confirmation of purchase.

• A subscription service provider helps us verify your purchase and provide Pro access. Your purchase is also subject to the applicable terms of your app store.

4.2 Renewal and Cancellation

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of that period, at the price then in effect.

• You can manage or cancel your subscription in your store account settings — on iOS, Settings, then your name, then Subscriptions; on Android, in Google Play subscription management. We cannot cancel a subscription on your behalf.

• After cancellation you keep Pro access until the end of the paid period, after which your account reverts to the free tier, including advertising.

• Deleting the App does not cancel a subscription. You must cancel through your app store.

4.3 Refunds

• Purchases are made through the app stores, and refunds are handled under their policies, not by us. For Apple, request a refund at reportaproblem.apple.com. For Google Play, see Google Play’s refund policy.

• We may, at our discretion, offer support or exceptions in specific cases. For account or billing issues, contact us at edustarstudio@gmail.com with the subject line "Billing Issue – Vocab Vault".

5. Intellectual Property

• The App, including its design, code, layout, and branding, and any content we provide, such as vocabulary decks, text, illustrations, and materials we own or license, are owned by us or our licensors and are protected by copyright and other intellectual property laws.

• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use in accordance with these Terms.

• Notes and mnemonics you write remain yours. You grant us only the licence needed to store, synchronise, and display them back to you as part of providing the Services.

• You do not acquire any ownership rights in the App or our content. Any feedback or suggestions you provide may be used by us without obligation to you.

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights. By using the App, you consent to the practices described there.

7. Disclaimers

• Educational use: The App is for educational and self-study purposes. We do not guarantee any particular result, such as a GRE score or exam outcome. Learning outcomes depend on your own effort and on many factors we do not control.

• "As is": The App and Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• Availability: We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that synchronisation will always succeed. You are responsible for keeping your own records of anything you cannot afford to lose.

• Local law: Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Limitation of Liability

• To the fullest extent permitted by applicable law, we, and our affiliates, officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the App or these Terms.

• To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the App or these Terms shall not exceed the greater of the amount you paid us for the Services in the twelve months preceding the event giving rise to the claim, or ten United States dollars.

• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

9. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or related to: (a) your use of the App; (b) your violation of these Terms or applicable law; or (c) your violation of any third-party rights.

10. Termination

10.1 By You

You may stop using the App at any time. You may also delete your account from the profile screen in the App, or by contacting us. Deleting your account removes your learning data as described in the Privacy Policy.

10.2 By Us

We may suspend or terminate your access to the App or your account, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or for operational, legal, or security reasons.

10.3 Effect of Termination

Upon termination, your right to use the App and Services ceases, and we may delete or retain your data in accordance with our Privacy Policy. Sections that by their nature should survive — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive termination.

11. Apple App Store — Additional Terms

The following applies where you obtained the App from the Apple App Store. In the event of a conflict, this section prevails over the rest of these Terms for those users.

• These Terms are between you and EduStar Studio only, not with Apple. Apple is not responsible for the App or its content.

• Apple has no obligation to provide any maintenance or support for the App.

• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

• Apple is not responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

• If a third party claims the App infringes their intellectual property rights, EduStar Studio, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.

• You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.

• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

12. Governing Law and Disputes

These Terms are governed by the laws of Nepal, without regard to conflict of laws principles.

If you are in a jurisdiction whose law gives you the right to bring proceedings locally, or to rely on mandatory consumer protections, nothing in these Terms removes that right.

You may also have the right to bring a complaint before a consumer protection or supervisory authority in your country.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website, and by updating the "Last updated" date at the top.

Your continued use of the App after the effective date constitutes acceptance. If you do not agree, you must stop using the App and may delete your account.

14. General

• Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the App, and supersede any prior agreements.

• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

• Waiver: Our failure to enforce any right or provision does not waive that right or provision.

• Assignment: You may not assign these Terms. We may assign our rights and obligations without your consent.
