Legal proceedings with respect to this demand –
The UPSC aspirant community filed a case : Siddharth Mishra & Ors Vs Union Public Service Commission at CAT ( Central administrative tribunal ) against the preliminary examination which was conducted as on 28th May 2023. The petition at CAT was filed to put stay over prelims result. However, the honorable court refused to put stay. This decision was given by court on June 9, 2023 and postponed the matter till July 6. Amidst all this the prelims result was declared as on June 12.
Later, the UPSC aspirants approached honorable Delhi High court, but due to the absence of UPSC Counsel on June 26, the hearing at High court was rescheduled to June 28, 2023. The Delhi High court on June 28, requested CAT to expedite the hearing. Hon’ble CAT heard both sides on 20th July and reserved the order and released it on Aug 3rd. We moved Delhi High court but our petition was dismiss. We are moving to Suprme court soon.
Argument of UPSC Aspirants at Central administrative tribunal- (Represented by Shri Salman Khurshid Ji)
The Aspirants alleged that PAPER – II ( CSAT ) of 28th May 2023 had questions which were out – of – syllabus. UPSC specifically mentions in its official notification that BASIC NUMERACY in CSAT will be asked from class X level. But the questions in CSAT were asked from topics such as PERMUTATION & COMBINATION which are NOT covered till class X. More than 25 Questions ( approximately 29 ) out of 80 were out of syllabus. Even many of such questions were asked directly from previous years IIT and CAT exams ( we have evidences ). All these things also made it extremely difficult to solve the paper within stipulated time.
Our Court Case Experience :
UPSC lawyers, over the years, have cleverly made sure that SC verdicts are in favor of UPSC and its examination process, and thus made UPSC unstoppable and immovable.
Now these same judgements are being quoted by UPSC lawyers in every such case as ours. Thus, courts have been made to believe that UPSC's examination process is infallible.
UPSC lawyers even resort to cheap tactics of branding aggrieved petitioners as "publicity seekers" in front of hon'ble judges in the court. UPSC lawyers also tried to delay the hearings, as much as possible. UPSC even hurriedly released the 2023 prelims result and broke all its previous records.
All in all, UPSC commits a mistake but doesn't accept it, to preserve its prestige. Lakhs of aspirants who put everything into this preparation are not at the mercy of UPSC's whims.
Such behavior is akin to unbecoming of a constitutional body. To put it bluntly, we lost trust and faith in this body.
After 3rd August CAT order, it was clear that only Higher Courts are the door to Justice in this country.
It looks like CAT Judges didn't even look into the merits before giving final order. Because even a layman can see our case clearly. They wasted out 2 months of precious time with such a biased judgement.
Note : We wrote our experience here to serve as a knowledge transfer to future UPSC aspirants who might have to face UPSC's whims and fancies again.
