1. Terms and Conditions of Use
Your access to, browsing, use of, or transacting on the Site (including Traveloka's website and application) is deemed as confirmation that you have read, understood, and agree to be bound by these entire Terms and Conditions of Use, along with other referenced policies and documents. These Terms constitute a legally binding agreement between you and Traveloka. Traveloka reserves the right to adjust or modify these Terms at any time as necessary to comply with the law or to suit changes in business operations, and will endeavor to provide notification of updates.
2. Our Website and Services
Traveloka operates the Site as an online platform to connect users with third-party Providers. The core service is to provide the ability to browse, search, book, purchase, and pay for a variety of "Products," including Travel Products (such as Flights, Ground Transportation, Accommodation Services, Travel Activities), Financial Services, and Other Activities and Products. Unless explicitly stated otherwise, all Products are operated and provided by third-party Providers, and users will be subject to the specific Product Terms of the Provider in addition to Traveloka's Terms.
3. Booking and Transactions on the Site
Users must be of sufficient age and legal capacity under applicable law to access and transact on the Site. You are responsible for providing accurate information and maintaining the confidentiality of your account details, booking numbers, or unique codes. Traveloka and the Providers are not responsible for the loss, theft, or destruction of this information. Traveloka reserves the right to refuse or cancel any booking, including those related to a "Manifest Error" (an unusual price display error), regardless of where the error originated.
4. Intellectual Property Rights and User Content
All content appearing on the Site, including text, images, software, trademarks, and other elements, is the intellectual property of Traveloka or its Providers. For Content uploaded by users (such as reviews, images, videos), you must ensure you own all rights to them and grant Traveloka a perpetual, royalty-free license to use such Content in its business operations. User Content must be accurate, neutral, and must not contain illegal, offensive, or violent elements.
5. Disclaimers and Limitation of Liability
Traveloka disclaims and makes no representation regarding the accuracy, availability, or completeness of any information about Products provided by Providers. Traveloka is not responsible for errors (including typographical errors), interruptions, or misleading information regarding the Products. In the event a Provider fails to perform the service, you must make a claim directly against that Provider and not Traveloka. Traveloka's maximum liability for any damages, if any, is limited to the total payment amount you made for the relevant product.
6. Indemnification and Personal Data Protection
You agree to indemnify Traveloka against all losses, claims, or legal costs arising from your breach of these Terms or any applicable laws. Regarding personal data, the processing of your information is governed by Traveloka's Privacy Policy, which is considered an integral part of these Terms, ensuring that data usage practices are transparent and clear.
7. Governing Law, Dispute Resolution, and Force Majeure
Unless provided otherwise, these Terms shall be governed by and construed in accordance with the laws of Singapore. Any dispute arising from or relating to these Terms shall be discussed by the parties in good faith to reach an amicable resolution. If negotiations fail within 60 days, the dispute shall be resolved at the Singapore Mediation Centre. If the dispute is still not resolved thereafter, the parties agree that the courts of the Republic of Singapore shall have non-exclusive jurisdiction. Additionally, Traveloka is exempt from liability for non-performance of its obligations due to force majeure events (natural disasters, epidemics, wars, etc.).
8. Country-Specific Terms
These Terms include additional provisions that apply specifically to users in certain countries (e.g., Australia, Indonesia) to ensure compliance with local laws. These terms may include provisions regarding consumer rights that cannot be limited, modified, or excluded by these Terms under local law.
