End User License Agreement (EULA) for TraceAI

This End User License Agreement ("Agreement") is a binding legal contract between you ("User") and TraceAI. By installing, accessing, or using the TraceAI mobile application, you agree to be bound by these terms. If you do not agree, do not use the app.

1. License Grant

We grant you a personal, non-exclusive, non-transferable, limited, revocable license to use TraceAI on any compatible Apple device that you own or control, strictly for personal, non-commercial use and in accordance with this Agreement and applicable law.

2. What TraceAI Is — and Is Not

TraceAI helps you track visual grooming progress using your own face photos, scores, routines, streaks, and before/after comparisons.

TraceAI does not diagnose, treat, prevent, or cure any medical condition. Scores, insights, and suggested routine items are for personal visual progress tracking only. They are not medical advice, clinical assessments, or attractiveness rankings. Always consult a qualified professional before starting or changing any medication, supplement, or treatment.

3. User Content and Privacy

Data Ownership: You retain ownership of the photos and information you submit to TraceAI, subject to the license below.

License to Operate the Service: You grant us a limited license to host, store, process, reproduce, and display your content solely as needed to operate TraceAI, including cloud scan processing, progress tracking, backups, and support.

Privacy: Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, store, and delete your data.

4. Subscriptions and Purchases

TraceAI offers premium access through auto-renewable in-app subscriptions processed by the Apple App Store.

Billing: Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Managing Subscriptions: You must manage, change, or cancel subscriptions through your Apple ID account settings in the App Store. We cannot manually refund or cancel subscriptions processed by Apple.

Restore Purchases: If you reinstall TraceAI or switch devices, you may use the in-app restore purchases option where available.

Pricing: Current subscription options and prices are displayed in the app and may vary by region. Example product offerings may include weekly and yearly plans.

Access After First Scan: TraceAI may require an active subscription to continue using premium features after your initial scan, as described in the app.

5. Acceptable Use

You agree not to:

• Use TraceAI for any unlawful purpose

• Upload content you do not have the right to use

• Attempt to decompile, reverse engineer, disassemble, or extract the source code of the app except where permitted by law

• Interfere with or disrupt the app, servers, or networks connected to the app

• Misuse scan results as medical advice or as a substitute for professional care

• Use the app to harass, abuse, or harm others

We may suspend or terminate access if you violate these terms.

6. Intellectual Property

TraceAI, including its design, software, branding, and content provided by us, is owned by us or our licensors and is protected by intellectual property laws. This Agreement does not transfer any ownership rights to you.

7. Disclaimer of Warranties

TraceAI is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• Scan results will be accurate, complete, or reflect real-world outcomes

• The app will be uninterrupted, error-free, or free of harmful components

• Any grooming routine or suggested item will produce a specific result

You use TraceAI at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, personal injury, or emotional distress arising from your use of TraceAI.

Our total liability for any claim relating to the app shall not exceed the greater of (a) the amount you paid us for TraceAI in the twelve (12) months before the claim or (b) fifty U.S. dollars (USD $50), except where such limitation is prohibited by law.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Apple Terms

If you downloaded TraceAI from the Apple App Store, you acknowledge that:

• This Agreement is between you and TraceAI, not Apple

• Apple is not responsible for the app or its content

• Apple has no obligation to provide maintenance or support for the app

• Apple is a third-party beneficiary of this Agreement and may enforce it against you

Your use of TraceAI must also comply with Apple’s applicable App Store terms and policies.

10. Termination

This license is effective until terminated. You may terminate it at any time by deleting the app and discontinuing use. We may terminate or suspend your access if you breach this Agreement or if we discontinue the service.

Upon termination, your right to use TraceAI ends immediately. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, and governing provisions.

11. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the “Last Updated” date above. Continued use of TraceAI after changes become effective constitutes acceptance of the updated terms.

12. Governing Law

This Agreement is governed by the laws applicable in the jurisdiction where the operator of TraceAI is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.
