Terms of Use

These Terms of Use ("Terms") constitute a legal agreement between Tomoto ("we", "us", "our") and you ("User", "you"). By downloading, installing, or using the Tomoto mobile application ("App"), you agree to be bound by these Terms. If you do not agree, do not use the App.

1. General Provisions

1.1. The App provides Pomodoro-based time management with customizable work and break intervals, task organization, and local notification reminders to help users stay focused.

1.2. We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. License and Access

2.1. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on iOS devices that you own or control.

2.2. You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App;

• Use the App to violate any applicable laws or regulations;

• Introduce any malware, viruses, or harmful code into the App.

3. Free Tier and Premium Features

3.1. The App is available for free with the following limitations:

• Work sessions: up to 3 per day on the free tier.

• Statistics history: up to 7 days on the free tier.

3.2. A Premium subscription unlocks unlimited sessions, full statistics history, and other advanced features. We reserve the right to adjust free tier limits at any time with reasonable notice.

4. Subscriptions & In-App Purchases

4.1. Certain features require a paid auto-renewable subscription (Weekly, Monthly, or Yearly).

4.2. All payments, transactions, and renewals are handled and processed exclusively by the Apple App Store. We do not collect or control your billing or payment information.

4.3. You can manage or cancel your subscription at any time through your Apple ID Account Settings.

4.4. Refunds are subject to Apple's App Store refund policies and must be requested directly through Apple support.

5. Analytics and Data Collection

5.1. The App uses Firebase Analytics (Google LLC) to collect anonymous usage data such as session events, device type, and app version. This data does not identify you personally and is used solely to improve the App.

5.2. No personal data, task content, or session details are transmitted to our servers. For full details, please refer to our Privacy Policy.

6. Intellectual Property

6.1. All intellectual property rights in the App, including design, graphics, code, and trademarks, belong to us.

6.2. Any feedback or feature requests you submit (via GitHub or Email) may be used by us without any financial obligation or restriction.

7. Disclaimer of Warranties & Liability

7.1. The App is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied.

7.2. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, including data loss or productivity loss, arising out of the use or inability to use the App.

8. Apple-Specific Terms (iOS EULA)

8.1. You acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. Apple is not responsible for the App or its content.

8.2. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

8.3. In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.

9. Governing Law

9.1. These Terms are governed by and construed in accordance with the laws of Ukraine.

9.2. Any disputes arising from these Terms shall be resolved through amicable negotiations or in the competent courts of Ukraine.
