Three Brooks’ protective covenants govern the usage of residential properties as well as the common land and nature reserves within the community. The protective covenants form part of your property deed and transfer to a new owner whenever the property changes title of ownership. An official copy of both your deed and its associated protective covenants can be found at the Nova Scotia Land Registry Office.
It is noted that a review of the protective covenants was conducted by the TBHOA Executive Committee during 2019 and 2024. They found that many of the protective covenants had been overtaken by laws, acts and regulations of Nova Scotia and bylaws of Halifax Regional Municipality (HRM). The TBHOA protective covenants do not supersede any laws, acts, regulations or bylaws so be sure to check these first before you consider property use and changes.
The are 160 properties within the TBHOA catchment area that were developed by either the Three Brooks Development Corporation or RAMAR Homes. Three Brooks Development Corporation stated at paragraph 27 of their protective covenants that "they shall have the power" to "waive, alter or modify the above covenants" thus not all protective covenants are identical. RAMAR Homes states at paragraph 23 of their "restricitve Deed covenants" that they "may later, waive or modify any of the foregoing building and other restrictions".
TBHOA has never been assigned the power to waive, alter or modify the covenants by either Three Brooks Development Corporation and RAMAR Homes.
