利用規約
/ Terms of Use

本利用規約（以下「本規約」）は、SparklyForce（以下「当方」）が提供するアプリ「Ballet Day」（以下「本アプリ」）の利用条件を定めるものです。利用者は、本規約に同意のうえ本アプリを利用するものとします。

1. 利用にあたって（録音・録画・プライバシー）

1. レッスンの録音・録画の取り扱いには十分ご注意ください。被写体・施設・主催者等の方針に従い、第三者のプライバシー、肖像権、著作権その他の権利を侵害しないようにしてください。

2. 利用者が本アプリを用いて行う録音・録画・コンテンツの利用に関する責任は、利用者が負うものとします。

3. 録画映像は、端末内の本アプリおよび端末の写真アプリ等に保存されます。端末やOSの設定・仕様により保存場所や挙動が変わる場合があります。

2. 収集する情報（匿名の利用状況データ）

当方は、本アプリの改善のため、利用状況（例：再生した曲、日時、機能利用状況等）を、個人を直接特定しない形（匿名情報）で収集することがあります。

※収集範囲・目的・第三者提供等の詳細は、プライバシーポリシーをご確認ください。

3. 楽曲・動画・YouTube等コンテンツの取り扱い

1. 本アプリに事前に登録している曲は、当方の確認した範囲で、権利者の許可なしで利用可能な音源（CC/パブリックドメイン等）を使用しています。ただし、利用地域・用途等により条件が付される場合があるため、最終的な利用可否は利用者の責任でご確認ください。

2. 利用者が本アプリに取り込む楽曲・動画等のコンテンツは、提供元（例：コンクール主催サイト等）のライセンス/利用規約に従って利用してください。必要に応じて、利用者自身で権利者の許諾を取得してください。

3. 取り込んだ楽曲は、原則として当該端末内に保存されます（端末の設定・バックアップ機能等により挙動が変わる場合があります）。

4. YouTube等のコンテンツはストリーミング再生のみを想定し、ダウンロード等、提供元の規約に反する行為を行ってはなりません。提供元の仕様変更・提供停止等により、本機能は予告なく変更または停止される場合があります。

5. コンテンツの権利や使用可否、利用規約の遵守は利用者の責任でご確認ください。

4. 免責事項

1. 当方は、本アプリが特定目的に適合すること、正確性、完全性、継続性等について保証しません。

2. AIによる文字起こし結果や比較動画の同期検出の正確性、コンテンツの利用可否や権利関係について、当方は保証しません。

3. 端末・OS・通信環境・外部サービス（YouTube、OpenAI、各ストア、広告配信等）の障害や仕様変更により、本アプリの全部または一部が利用できない場合があります。

4. 利用者が本アプリの利用により被った損害について、当方の故意または重過失による場合を除き、当方は責任を負いません。

5. アカウント・ログイン（匿名利用と統合）

1. 本アプリは、初回は匿名（未ログイン）で利用を開始でき、後から Apple または Google によるログインを行うことができます。

2. 匿名状態で作成・保存されたデータは、ログイン後に必ずアカウントへ統合されます。

3. AppleログインとGoogleログインを切り替えた場合も、同一利用者のデータとして統合されます。

4. ログイン情報の管理、第三者による利用の防止は利用者の責任で行うものとします。

6. 文字起こし機能（音声の取り扱い・第三者サービス）

1. 本アプリは、先生のアドバイス記録等を目的として、録画映像から音声データのみを抽出し、文字起こしを行う機能を提供します。

2. 文字起こし処理には、OpenAI のサービス（API）を利用します。文字起こし実行時、抽出された音声データがサーバーを経由して送信される場合があります。

3. 音声データは、文字起こしの実行と結果返却のためにのみ取り扱い、文字起こし完了後はサーバー上から削除します。

4. AIによる文字起こしは、発話内容を正確に認識しない場合があります。文字起こし結果の正確性・完全性を当方が保証するものではありません。

5. 利用者は、文字起こし対象となる音声（第三者の声・個人情報・機密情報を含む可能性があるもの）について、必要な権利処理・同意取得等を行った上で、自己の責任で本機能を利用するものとします。

7. サブスクリプション（自動更新・解約・復元・広告）

1. 本アプリには月額のサブスクリプション（以下「本サブスク」）があります。

2. 本サブスクを購入すると、利用者が解約しない限り、各ストアのルールに従い自動的に更新されます。

3. 解約は、各ストアのサブスクリプション管理画面（Apple ID / Google Play）から行ってください。

4. 無料トライアル（6か月）を含む場合、トライアル期間終了後に課金が開始されます（トライアルの提供条件・対象等はストア表示に従います）。

5. 返金の可否・手続きは、各ストアの規定に従います。

6. 「購入を復元」機能は、ストアの仕組みに従って購入状態を復元するためのものです。

7. 有料プランでは広告が完全非表示にはならず、全画面広告は表示しませんが、バナー広告は表示されます。

8. 禁止事項

利用者は、以下の行為をしてはなりません。

1. 法令または公序良俗に反する行為

2. 第三者のプライバシー、肖像権、著作権その他の権利を侵害する行為

3. 無許諾での録音・録画、施設・主催者の規約に反する撮影・公開等

4. 本アプリまたはサーバー等に過度な負荷を与える行為、運営を妨害する行為

5. 本アプリの改変、リバースエンジニアリング、解析、脆弱性探索等

6. 不正アクセス、なりすまし、または第三者のアカウント利用

9. 規約の変更

当方は、必要に応じて本規約を変更できるものとします。重要な変更がある場合、当方は合理的な方法で利用者に周知します。変更後の規約は、本アプリまたは当方が指定する方法で表示した時点から適用されます。

10. 準拠法・管轄

本規約は日本法に準拠し、本アプリに関連して利用者と当方の間で生じた紛争については、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use (“Terms”) set forth the conditions for using the app “Ballet Day” (“the App”) provided by SparklyForce (“we,” “us,” or “our”). Users shall use the App after agreeing to these Terms.

1. Use of the App: Recording, Filming, and Privacy

Please exercise sufficient care when handling lesson audio recordings and video recordings. Users must follow the policies of the subject, facility, organizer, and other relevant parties, and must not infringe on the privacy, portrait rights, copyrights, or any other rights of third parties.

Users shall be responsible for any audio recording, video recording, or use of content performed through the App.

Recorded videos are saved within the App on the device and in the device’s Photos app or similar apps. The storage location and behavior may vary depending on the device, operating system settings, and specifications.

2. Information Collected: Anonymous Usage Data

We may collect usage information, such as songs played, date and time of use, and feature usage, in a form that does not directly identify individuals, as anonymous information, for the purpose of improving the App.

Please refer to the Privacy Policy for details regarding the scope of collection, purposes of use, provision to third parties, and other matters.

3. Handling of Music, Videos, YouTube, and Other Content

The songs pre-registered in the App use audio sources that, to the extent confirmed by us, may be used without permission from the rights holders, such as Creative Commons or public domain materials. However, conditions may apply depending on the region of use, purpose of use, and other factors. Users are responsible for confirming whether such content may ultimately be used.

Content such as music and videos imported into the App by users must be used in accordance with the license or terms of use of the source provider, such as a competition organizer’s website. Users must obtain permission from the rights holders themselves as necessary.

Imported music is, in principle, saved within the relevant device. The behavior may vary depending on device settings, backup functions, and other factors.

Content from YouTube and similar services is intended only for streaming playback. Users must not engage in any act that violates the terms of the source provider, such as downloading content. This feature may be changed or discontinued without prior notice due to changes in the source provider’s specifications, suspension of service, or other reasons.

Users are responsible for confirming the rights, permitted use, and compliance with the terms of use for content.

4. Disclaimer

We do not guarantee that the App is suitable for any particular purpose, or that it is accurate, complete, continuous, or otherwise error-free.

We do not guarantee the accuracy of AI-generated transcription results or synchronization detection for comparison videos, nor do we guarantee whether content may be used or any rights-related matters.

All or part of the App may become unavailable due to failures or specification changes involving devices, operating systems, communication environments, or external services such as YouTube, OpenAI, app stores, or advertising delivery services.

Except in cases of willful misconduct or gross negligence by us, we shall not be liable for any damages incurred by users through the use of the App.

5. Account and Login: Anonymous Use and Integration

The App can initially be used anonymously, without logging in, and users may later log in with Apple or Google.

Data created and saved while using the App anonymously will always be integrated into the account after login.

Even if a user switches between Apple login and Google login, the data will be integrated as data belonging to the same user.

Users are responsible for managing their login information and preventing use by third parties.

6. Transcription Feature: Handling of Audio and Third-Party Services

The App provides a feature that extracts only audio data from recorded videos and performs transcription, for purposes such as recording a teacher’s advice.

OpenAI’s service, specifically its API, is used for transcription processing. When transcription is executed, the extracted audio data may be sent via a server.

Audio data is handled only for the purpose of executing transcription and returning the results, and is deleted from the server after transcription is completed.

AI-based transcription may not accurately recognize spoken content. We do not guarantee the accuracy or completeness of transcription results.

Users shall use this feature at their own responsibility after completing any necessary rights clearance, obtaining consent, and taking other required measures regarding the audio to be transcribed, which may include third-party voices, personal information, or confidential information.

7. Subscriptions: Auto-Renewal, Cancellation, Restoration, and Ads

The App offers a monthly subscription (“the Subscription”).

Once the Subscription is purchased, it will automatically renew in accordance with the rules of each app store unless canceled by the user.

Cancellation must be performed from the subscription management screen of each app store, such as Apple ID or Google Play.

If a free trial period, such as a six-month free trial, is included, billing will begin after the trial period ends. The conditions and eligibility for the trial are subject to the information displayed by the relevant app store.

Refund eligibility and procedures are subject to the rules of each app store.

The “Restore Purchases” feature is intended to restore purchase status in accordance with the app store’s system.

Paid plans do not completely hide all advertisements. Full-screen ads will not be displayed, but banner ads will still be displayed.

8. Prohibited Acts

Users must not engage in any of the following acts:

• Acts that violate laws or regulations, or public order and morals

• Acts that infringe on the privacy, portrait rights, copyrights, or any other rights of third parties

• Audio recording or video recording without permission, or filming, publication, or similar acts that violate the rules of facilities or organizers

• Acts that place an excessive load on the App, servers, or other systems, or interfere with operation

• Modification, reverse engineering, analysis, vulnerability exploration, or similar acts involving the App

• Unauthorized access, impersonation, or use of a third party’s account

9. Changes to the Terms

We may change these Terms as necessary. If there are any important changes, we will notify users by reasonable means. The revised Terms shall apply from the time they are displayed in the App or by a method designated by us.

10. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. For any disputes arising between users and us in connection with the App, the court having jurisdiction over our location shall be the exclusive court of agreed jurisdiction in the first instance.
