Information for the Property Owners in the Sleepy Hollow Cluster Home Association
By now, you may have noticed that Frontier is installing fiber optic cable in our front yards for their new high-speed internet service. Many homeowners are understandably displeased that their front yards are being dug up and have been contacting the Association to intervene. To be honest, however, the Association cannot do anything about it.
Most properties have a utility easement (a legal right for utility companies to access and use a specific portion of your property for installation and maintenance) in the front, back, or side yards, typically near property lines or the street. You generally cannot stop the work if the digging is within a recorded utility easement. By purchasing the property, you implicitly agreed to the terms of these existing easements.
They are responsible for any repairs. While they have the right to dig, utility companies are generally liable for repairing any damage they cause to your yard, such as re-laying sod or putting down seed and soil. It is important to document your yard's condition with photos before they start work.
The digging is often minimal. For fiber optic installation, companies often use techniques like micro-trenching, which involves a very narrow, shallow trench that has a minimal impact on the yard compared to traditional digging.
Still don't believe us? Check the Title Insurance Policy/Report you received when you purchased your property. That report or schedule should list all recorded easements and other encumbrances (liens, restrictions).

Thank you to our departing Board Members - William N., for his service for the past 3 years as Trustee and President, and Stratos T., who had to resign after 2 years as Trustee. They were both critical in many important decisions made on behalf of the Association.
Please welcome our new Trustees, Jennifer G. (Castleton) and Nancy K. (Brittany). Their fresh ideas will be a welcome addition.

The Reserve Fund is fully funded through 2026. We are currently looking into getting a Reserve Study done in 2026
The Brittany Gazabo
In mid-October 2025, Lamphear's gave the Brittany gazebo area a fresh look. The overgrown bushes were removed, and two burning bushes were added along with new perennials. Mulch and decorative stone were also incorporated into the landscaping. Stop by and check it out; it should look even better in late Spring 2026. For more pictures, visit our Photos page.
The Association's newsletter, the Sleepy Hollar, is published quarterly and mailed to all Association homeowners. It is also available by clicking on the above link. The latest newsletter is available now on the Events page. The next one will be in January 2026.

Our Featured Rule of the Quarter
Rule 1/1/2013_A: January 1, 2013, Parking During Winter Months
It has come to the attention of the Board of Directors that there is a problem with on street parking during snowplow season on Keats and Castleton. Vehicles should not be parked on the street while snowplowing is in progress. Any vehicle impeding the ability of our contractors to plow will be towed at the homeowners expense. The contractors are not responsible for contacting homeowners to move their vehicles. Please be courteous and insure that your vehicle(s) are not blocking access during
plowing.

Section 4.2. Owner's Responsibilities. Except as otherwise provided in Section 4.1, all maintenance of the Residential Unit shall be the responsibility of the Owner, and each Owner shall maintain and keep in good repair such property and improvements such as decks, patios, front porches with railings, and screened‐in porches. With the exception of lawn mowing, trimming shrubs or bushes, and weed maintenance and fertilization of the grass, the Owner is responsible for all maintenance and landscape of the yard areas located on the Lot. This maintenance and landscape responsibility includes tree planting, tree trimming, and replacement of any and all shrubs, bushes, plantings, and trees located on the Lot. All replacement costs for shrubs, bushes, plantings, and trees will be at the sole expense of the Owner. The Owner is also responsible for the maintenance of landscape beds located on the Lot, including weed removal and fertilization in the landscape beds.
The Owner is also responsible for maintenance, repair, and replacement of the patio constructed immediately adjacent to the Residence on the Lot.
Any conflict between these provisions and any other provisions of the Declaration and Bylaws will be interpreted in favor of this amendment clarifying maintenance, repair and replacement responsibility for the Residential Unit's driveway, patio and yard areas on the Lot. The invalidity of any part of the above provision does not impair or affect in any manner the validity or enforceability of the remainder of the provision. Upon the recording of this amendment, only Owners of record at the time of the filing have standing to contest the validity of this amendment, whether on procedural, substantive, or any other grounds. Any challenge to the validity of this amendment must be brought in the court of common pleas within one year of the recording of this amendment.

Thursday is our scheduled lawn mowing day with Lamphear's. This can be delayed by weather conditions. If you have any concerns or comments about this service, please contact us.

Are you replacing your roof this year? Our homes should have Timberline (GAF) Natural Shadow Weathered Wood Algae Resistant Architectural Shingles. Ask your installer for this or something that is about the same color to get it quickly approved by the Board.
Replacing your siding? In our Covenants, regarding "Exterior Uniformity", it does not specifically state what colors you should use. All we ask is that you consider the existing colors used by your neighbors and consider something neutral, earthy and light so as not to stand out. Here are some siding color examples.
As with ALL improvements or modifications made to the exterior of your home, you should always notify the Board of Trustees to secure approval before proceeding with any work. Your cooperation is appreciated by the Board and your neighbors.
Association Assessments
The Association assessments is $105.00 per month. That is the equivalent of $315.00 per quarter. Assessment payments must be received by the last day of the month in which they are due. Invoices will be mailed out at the beginning of the quarter to every homeowner. We ask that you please do not send us cash.
If you are experiencing problems paying your assessment, please contact us immediately to make suitable payment arrangements. We are willing to work with you if you contact us!
The Association provides services that are paid for by the assessments, including: lawn care, snow plowing, access and maintenance of common areas, entrance/street lights, Association insurance and legal fees, treasurer & secretary salary, office supplies, reserve funding, mailing expenses, mileage, hall rental, taxes, and other miscellaneous costs.
