この利用規約（以下「本規約」といいます）は、「Prompile」（以下「本アプリ」といいます）の利用条件を定めるものです。
本アプリを利用する場合、ユーザーは本規約の内容に同意したものとみなします。
Prompileは、AIサービス等で使用するプロンプトや関連するテキスト、画像などを、ユーザー自身が保存・整理・管理するためのアプリです。
本アプリは、ユーザーが情報を整理・管理するためのツールとして提供されるものであり、本アプリ内に保存されたプロンプトその他のコンテンツについて、その内容、権利関係、正確性、合法性等を運営者が確認または保証するものではありません。
ユーザーは、自らの責任において本アプリを利用するものとします。
ユーザーは、本アプリの利用にあたり、適用される法律、規則および第三者が提供するサービスの利用規約等を遵守するものとします。
未成年者が本アプリを利用する場合は、必要に応じて保護者その他の法定代理人の同意を得たうえで利用してください。
本アプリでは、ユーザーが入力または保存したプロンプト、フォルダ情報、画像その他のデータを、ユーザーの端末内またはAppleが提供するiCloud等の仕組みを利用して保存する場合があります。
ユーザーは、自らの責任でデータを管理するものとし、必要に応じて本アプリが提供するバックアップ機能その他の方法を利用してデータの保全を行うものとします。
端末の故障、紛失、OSの不具合、iCloudその他の外部サービスの障害、本アプリの削除、データの破損その他の事情によりデータが消失または利用できなくなった場合であっても、運営者は、その復旧またはこれにより生じた損害について責任を負いません。
ユーザーは、本アプリに保存する文章、プロンプト、画像、名称その他のコンテンツについて、必要な権利または利用権限を有していることを自ら確認するものとします。
本アプリにコンテンツを保存したことによって、そのコンテンツに関する著作権その他の権利が運営者へ移転することはありません。
また、本アプリまたは運営者が、ユーザーの保存したコンテンツについて、新たな著作権、利用許諾その他の権利を付与するものでもありません。
インターネット、SNS、書籍、Webサイト、AIサービスその他の媒体で公開または共有されているプロンプト、文章、画像等には、著作権、商標権その他の第三者の権利が存在する場合があります。
ユーザーは、本アプリへの保存、複製、編集、共有、公開、商用利用その他の利用を行う前に、必要に応じて当該コンテンツの権利関係や利用条件を確認するものとします。
本アプリに保存可能であることは、そのコンテンツについて自由な利用、転載、再配布、公開または商用利用が認められていることを意味するものではありません。
ユーザーによるコンテンツの保存または利用に関連して、第三者との間で著作権その他の権利に関する紛争、請求、損害その他の問題が生じた場合、ユーザー自身の責任と費用において対応するものとし、運営者は責任を負いません。
本アプリに保存したプロンプトをChatGPTその他の生成AIサービスで使用した場合に生成される文章、画像、音声、動画、プログラムその他の成果物について、本アプリおよび運営者は、その正確性、完全性、有用性、安全性、合法性、第三者の権利を侵害していないこと等を保証しません。
生成AIサービスの利用および生成されたコンテンツの利用については、ユーザー自身の責任で、当該AIサービスの利用規約その他の条件を確認してください。
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
法令または公序良俗に違反する行為
第三者の著作権、商標権、プライバシー権その他の権利を侵害する行為
本アプリの運営または提供を妨害する行為
本アプリを不正に改変、解析、攻撃または悪用する行為
本アプリまたはその機能を利用した不正行為
その他、運営者が不適切と判断する行為
本アプリでは、広告配信その他の目的で、Google AdMob等の第三者サービスを利用する場合があります。
これらの外部サービスについては、それぞれのサービス提供者が定める利用規約、プライバシーポリシーその他の条件が適用されます。
外部サービスの提供内容、障害、仕様変更、提供終了その他の事情によってユーザーに損害が生じた場合であっても、運営者は責任を負いません。
運営者は、本アプリの品質向上、機能改善、保守、法令への対応その他の理由により、ユーザーへの事前通知なく、本アプリの内容または仕様を変更することがあります。
また、やむを得ない事情がある場合、本アプリの全部または一部の提供を一時的に中断または終了することがあります。
これらによりユーザーに損害が生じた場合であっても、運営者に故意または重大な過失がある場合を除き、運営者は責任を負いません。
運営者は、本アプリについて、正常な動作、継続的な提供、特定の目的への適合性、正確性、完全性、安全性その他一切の事項を保証するものではありません。
ユーザーが本アプリに保存したプロンプト、文章、画像その他のコンテンツの内容、出所、権利関係および利用方法については、ユーザー自身が責任を負うものとします。
個人利用、商用利用を問わず、本アプリを利用して保存、管理または利用されたコンテンツに関連して、著作権その他の第三者の権利に関する問題が発生した場合、運営者は責任を負いません。
また、本アプリの利用または利用不能、本アプリ内のデータの消失、本アプリを通じて保存したプロンプトの利用、生成AIによる生成結果その他本アプリに関連して生じた損害について、運営者に故意または重大な過失がある場合を除き、運営者は責任を負いません。
ただし、適用される法令により運営者の責任を免除または制限することが認められない場合は、この限りではありません。
本アプリそのものに関するプログラム、デザイン、ロゴ、名称その他の知的財産権は、運営者または正当な権利を有する第三者に帰属します。
本規約によって、これらの知的財産権をユーザーへ譲渡または許諾するものではありません。
運営者は、法令の変更、本アプリの機能変更その他必要と判断した場合、本規約を変更することがあります。
重要な変更を行う場合は、本アプリ内または本アプリの公式Webサイトその他適切な方法でお知らせします。
変更後の本規約は、掲載または告知された時点、または別途定めた効力発生日から適用されます。
本規約は、日本法に準拠し、日本法に従って解釈されます。
本アプリまたは本規約に関連して紛争が生じた場合は、日本の法令に従い、管轄権を有する日本の裁判所において解決するものとします。
本規約の英語版その他の翻訳版が提供される場合、それらはユーザーの便宜のための参考訳として提供されるものです。
日本語版と翻訳版との間に内容の不一致、解釈の相違または矛盾がある場合は、日本語版の内容が優先して適用されるものとします。

This English version is provided for reference and convenience only. In the event of any inconsistency, discrepancy, or difference in interpretation between the Japanese version and this English translation, the Japanese version shall prevail.
These Terms of Use ("Terms") set forth the conditions governing the use of Prompile (the "App").
By using the App, you are deemed to have agreed to these Terms.
Prompile is an application that allows users to save, organize, and manage prompts, text, images, and other related content for use with AI services and other purposes.
The App is provided solely as a tool for users to organize and manage information. The operator does not review or guarantee the content, ownership, rights, accuracy, legality, or other aspects of any prompts or other content saved within the App.
Users shall use the App at their own responsibility.
When using the App, users must comply with applicable laws and regulations, as well as the terms of use and other rules applicable to third-party services.
Minors should obtain the consent of a parent, guardian, or other legal representative where required.
Prompts, folder information, images, and other data entered or saved by users may be stored on the user's device or through services provided by Apple, including iCloud.
Users are responsible for managing their own data and should take appropriate measures to protect their data, including using backup features provided by the App where available.
The operator shall not be responsible for restoring data or for any loss or damage arising from data loss or unavailability caused by device failure, loss of a device, operating system issues, failures of iCloud or other third-party services, deletion of the App, data corruption, or other circumstances.
Users are responsible for confirming that they have the necessary rights or permissions to save any text, prompts, images, names, or other content in the App.
Saving content in the App does not transfer any copyright or other rights in such content to the operator.
The App and the operator do not grant users any new copyright, license, permission, or other rights with respect to content saved by users.
Prompts, text, images, and other content published or shared on the internet, social media, books, websites, AI services, or other sources may be protected by copyright, trademark rights, or other third-party rights.
Users are responsible for reviewing the applicable rights and terms of use before saving, copying, editing, sharing, publishing, commercially using, or otherwise using such content.
The fact that content can be saved in the App does not mean that the content may be freely used, reproduced, redistributed, published, or commercially exploited.
If any dispute, claim, loss, or other issue arises between a user and a third party in connection with content saved or used by the user, including any alleged infringement of copyright or other rights, the user shall handle such matter at their own responsibility and expense. The operator shall not be liable for such matters.
The operator does not guarantee the accuracy, completeness, usefulness, safety, legality, or non-infringement of any text, images, audio, video, software, or other output generated by ChatGPT or any other generative AI service using prompts saved in the App.
Users are responsible for reviewing and complying with the terms and conditions applicable to each AI service and for determining whether and how generated content may be used.
Users must not engage in any of the following conduct in connection with the App:
Conduct that violates applicable laws or public order and morals
Conduct that infringes the copyrights, trademarks, privacy rights, or other rights of third parties
Conduct that interferes with the operation or provision of the App
Unauthorized modification, analysis, attack, abuse, or misuse of the App
Fraudulent or unlawful use of the App or its functions
Any other conduct that the operator reasonably considers inappropriate
The App may use third-party services, including Google AdMob, for advertising and other purposes.
Such third-party services are governed by the respective providers' terms of use, privacy policies, and other applicable conditions.
The operator shall not be responsible for any loss or damage arising from the content, interruption, malfunction, modification, or termination of any third-party service.
The operator may modify the content, functionality, or specifications of the App without prior notice for reasons including service improvement, maintenance, legal compliance, or other operational needs.
The operator may also temporarily suspend or permanently discontinue all or part of the App where reasonably necessary.
Except in cases of intentional misconduct or gross negligence by the operator, the operator shall not be liable for any loss or damage resulting from such modification, suspension, or termination.
The operator makes no warranty regarding the proper operation, continuous availability, fitness for a particular purpose, accuracy, completeness, security, or any other aspect of the App.
Users are solely responsible for the content, source, ownership, rights, and manner of use of prompts, text, images, and other content saved in the App.
Whether for personal or commercial use, the operator shall not be responsible for any copyright infringement or other third-party rights issues arising from content saved, managed, or used through the App.
The operator shall also not be liable for any loss or damage arising from the use or inability to use the App, loss of data, use of prompts saved through the App, output generated by AI services, or any other matter related to the App, except where such liability cannot lawfully be excluded or limited, or where the damage results from intentional misconduct or gross negligence by the operator.
All intellectual property rights relating to the App itself, including its software, design, logos, names, and other materials, belong to the operator or to third parties holding valid rights.
Nothing in these Terms transfers or grants any such intellectual property rights to users.
The operator may revise these Terms when necessary due to changes in laws or regulations, changes to the App, or other reasonable circumstances.
Where material changes are made, users will be informed through the App, the official website, or another appropriate method.
The revised Terms will take effect when posted or announced, or on any separately specified effective date.
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any dispute arising out of or in connection with the App or these Terms shall be resolved before a court of competent jurisdiction in Japan in accordance with applicable Japanese law.
This English version is provided solely as a reference translation for the convenience of users.
If there is any inconsistency, discrepancy, conflict, or difference in interpretation between the Japanese version and this English version, the Japanese version shall prevail.
