These Terms of Service (“**Terms**”) govern access to and use of **PokeVid: AI Video Generator** (“**PokeVid**”, “we”, “us”, or “our”), including our Android application and related services (the “**Service**”). The Service is offered in connection with distribution on **Google Play** by the developer account operated from **Singapore**.
**Related documents.** Our **Privacy Policy** explains how we handle personal data. **Subscription and Purchase Terms** apply to paid subscriptions and certain Google Play purchases. Those documents are linked from the Google Play store listing and, where available, inside the app (for example under Settings or Legal). If anything in these Terms conflicts with the Subscription and Purchase Terms **solely** as to **billing, renewal, cancellation, trials, price changes for paid plans, or credits tied to subscriptions and purchases**, the Subscription and Purchase Terms control for that limited topic; for all other topics, these Terms control unless explicitly stated otherwise.
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

## 1. Eligibility
You must be at least **13** years old to use the Service, or the minimum age required in your country if that age is higher.
If you are not old enough to enter a binding contract where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

## 2. What the Service provides
PokeVid offers **AI-assisted tools** to create, edit, or enhance **videos** and related media from prompts and materials you supply. Features may include generation, editing, templates, effects, and export options. **Specific features vary by version** and may change, be limited, or discontinued.
The Service may include **advertising**, **subscription** plans, and **one-time** in-app purchases (for example consumable packs), as shown in the app and on Google Play at the time of purchase.
Outputs are **automated** and may be imperfect, incomplete, or unsuitable for your purpose. You are responsible for how you use outputs, including compliance with law and third-party rights.

## 3. No PokeVid login; Google Play and your device
PokeVid **does not provide an in-app user account or password login**. Paid plans, **credits**are recognised through **Google Play** billing and identifiers on **your device**, as implemented in each app version.
You are responsible for:
- the **Google account** used on the device for Play purchases;
- **device security** (for example screen lock and who uses your device); and
- **backups / transfer** limitations: if you change devices or Google accounts, entitlements or credit balances may not carry over except as **Google Play** and our implementation allow.
We may suspend or restrict access if we reasonably believe there is fraud, abuse, a security risk, or a breach of these Terms.

## 4. User content and licence to us
**4.1 Your content.** You retain ownership of content you upload or generate for your own use, subject to third-party rights (for example music, trademarks, or likenesses in your uploads).
**4.2 Licence you grant us.** You grant PokeVid a **limited, non-exclusive, worldwide, royalty-free** licence to host, process, transmit, display, and create derivative outputs **only** as needed to:
- operate and provide the Service you request;
- maintain security, prevent abuse, and enforce these Terms; and
- comply with applicable law.
This licence **ends** when you delete your content from systems we control and we no longer need it for the above purposes, except where retention is required by law or for dispute resolution.
**4.3 No training for unrelated models.** Unless we notify you otherwise in the product and update our **Privacy Policy**, we **do not** use your uploads or prompts to train **general-purpose** or **shared** AI models for unrelated services. Processing for **your** output during a session is not “training” in that sense.
**4.4 Your representations.** You represent that you have the rights needed for your User Content and that your use does not violate law or third-party rights.

## 5. Acceptable use
You agree **not** to use the Service to create, upload, request, or distribute material that:
- is illegal or promotes illegal activity;
- is sexually explicit involving minors, or exploits or endangers minors;
- is non-consensual intimate imagery, “deepfake” harassment, or defamation intended to harm identifiable individuals;
- infringes intellectual property or trade secrets without authorisation;
- contains malware, exploits, or instructions to unlawfully bypass security;
- interferes with or overloads the Service or other users’ access; or
- violates Google Play policies or applicable export, sanctions, or child-safety laws.
We may remove content, block prompts, suspend features, or terminate access for violations. We may cooperate with law enforcement when required.

## 6. Subscriptions, one-time purchases, and advertising
**6.1 Google Play.** Paid features are billed through **Google Play** under your agreement with **Google**. PokeVid does not directly collect your payment card number for those transactions.
**6.2 Subscriptions.** Subscriptions **renew automatically** until you cancel in your Google Play subscription settings. **Free trials** convert to paid subscriptions unless cancelled before the trial ends, as disclosed at purchase. After cancellation, access typically continues until the end of the current period.
**6.3 One-time purchases.** One-time in-app products (such as **credit packs** or permanent unlocks) are governed by the description at purchase and by Google Play policies. Restoration on a **new device** or after reinstall depends on **Google Play** and how credits are stored; we do **not** guarantee recovery if you lose access to the purchasing Google account or device.
**6.4 Refunds.** Refund requests are handled under **Google Play’s refund rules**. We do not guarantee refunds outside those rules.
**6.5 Ads.** Third-party ads may appear in the Service. Ad partners may collect data under their policies; see the **Privacy Policy** for choices such as device ad settings and regional consent tools.

## 7. Intellectual property in the Service
The Service, including software, branding, UI, and curated assets we provide (excluding your User Content and outputs you lawfully own), is owned by PokeVid or its licensors. Except for the limited right to use the Service, these Terms do not grant you ownership of our IP.
You may not reverse engineer, decompile, or attempt to extract source code except where mandatory law allows; scrape the Service in a way that harms performance; or remove legal notices.

## 8. Third-party services
The Service relies on cloud providers, AI model providers, analytics, and advertising networks. Their terms and privacy notices apply to their components. We are not responsible for third-party services we do not control.

## 9. Disclaimers
THE SERVICE IS PROVIDED **“AS IS”** AND **“AS AVAILABLE”**. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT).
We do not warrant that AI outputs will be accurate, unbiased, lawful for your use case, or free from third-party claims. **You** are responsible for reviewing outputs before publication or commercial use.

## 10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- PokeVid AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE; AND
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE **GREATER OF** (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE THROUGH GOOGLE PLAY IN THE **SIX (6) MONTHS** BEFORE THE CLAIM, OR (B) **USD $50**, EXCEPT WHERE LAW DOES NOT ALLOW SUCH A CAP.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent still permitted.

## 11. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless PokeVid and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, or your breach of these Terms, except to the extent caused by our intentional misconduct.

## 12. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, legal requirement, or discontinuation of the Service. Provisions that by nature should survive (for example Sections 4, 5, 7, 9–11, 13–15) will survive termination.
Deleting the app **does not** cancel a subscription; manage subscriptions in Google Play.

## 13. Changes to the Terms
We may modify these Terms. We will post the updated Terms with a new “Last Updated” date. If a change is material, we may provide additional notice (for example in-app or via Play). Continued use after the effective date constitutes acceptance of the updated Terms, except where applicable law requires explicit consent.

## 14. Governing law and disputes
These Terms are governed by the laws of **Singapore**, **without regard to conflict-of-law rules** that would cause another law to apply, **subject to** any **mandatory** consumer protection rules in the country where you habitually reside that cannot be contractually waived.
**Courts.** Subject to the paragraph below, you and PokeVid agree that the **courts of Singapore** have **non-exclusive** jurisdiction over disputes arising out of or relating to these Terms or the Service.
**Mandatory consumer rights.** If you are a consumer in the **EEA**, **UK**, or another jurisdiction that gives you the right to sue in your home courts or to use mandatory alternative dispute mechanisms, those rights remain available to you notwithstanding the choice above.

## 15. Miscellaneous
**15.1 Entire agreement.** These Terms, together with the Privacy Policy and Subscription and Purchase Terms, are the entire agreement between you and PokeVid regarding the Service.
**15.2 Assignment.** You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
**15.3 Severability.** If a provision is invalid, the remainder remains enforceable.
**15.4 No waiver.** Failure to enforce a provision is not a waiver.
**15.5 Language.** The English version prevails if there is a conflict with a translated copy we may provide for convenience.
