Developer / Operator: Ilias Stentoumis (Independent Software Developer)

Please read these Terms and Conditions ("Terms", "Agreement") carefully before downloading, installing, or using the Petminder mobile application ("the App", "the Service") developed and operated by Ilias Stentoumis ("Developer", "we", "us", "our").

By creating an account, downloading, or using the App, you ("User", "you") agree to be legally bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

1. Eligibility and Capacity to Contract

By accessing or using the App, you represent and warrant that you are at least 16 years of age (or at least 15 years of age in Greece pursuant to Article 21 of Greek Law 4624/2019) and possess the legal capacity to enter into this Agreement. If you are under the age of majority in your jurisdiction, you represent that you have obtained verifiable consent from a parent or legal guardian to use the App.

2. Description of the Service

Petminder is a digital organization, calendar, and reminder utility designed to help pet owners record pet details, store pet documents, and set personal date/time notifications for pet-related tasks, including medications, vet visits, grooming, and vaccination schedules.

3. Veterinary & Medical Disclaimer (CRITICAL)

• NOT A VETERINARY OR MEDICAL SERVICE: Petminder is solely an administrative reminder tool. The App does NOT provide veterinary, medical, diagnostic, pharmacological, or healthcare advice.

• NO EMERGENCY OR LIFE-SAFETY RELIANCE: The App must never be relied upon as an infallible medical dosing device, emergency alarm, or substitute for professional veterinary care. Always follow the explicit prescriptions and instructions of your licensed veterinarian.

• LIMITATION OF LIABILITY FOR MISSED DOSES OR APPOINTMENTS: We shall not be held liable for any missed medications, overdoses, underdoses, delayed veterinary treatments, missed appointments, or any resulting injury, illness, worsening of condition, or death of any animal arising directly or indirectly from the use or technical failure of the App.

4. Notification & Alarm Limitations (Hardware and Operating System)

• Reminders and alerts in Petminder are scheduled locally on your device hardware.

• We cannot and do not guarantee that notifications will execute on time or at all. Alarm delivery may be delayed, silenced, or prevented by factors outside our software's control, including:

  • • Device battery saver modes and aggressive manufacturer background kill managers (such as Xiaomi MIUI/HyperOS, Samsung OneUI, Huawei EMUI);

  • • Android Doze Mode and Apple iOS Focus / Do Not Disturb modes;

  • • Device restarts where the device remains in a locked state prior to first unlock;

  • • User revocation of notification permissions or exact alarm permissions (SCHEDULE_EXACT_ALARM);

  • • Device mute switches, low volume, or hardware malfunctions.

• You remain solely responsible for ensuring your pet receives necessary care and medication on time.

5. User Accounts and Content

• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• User Content: You retain ownership of all pet records, notes, photos, and document files you upload to the App. You represent and warrant that you own or have the necessary rights to upload such content.

• Prohibited Conduct: You agree not to:

  • • Use the App for any unlawful, harassing, or fraudulent purpose;

  • • Reverse engineer, decompile, or disassemble any part of the App;

  • • Upload malicious code, viruses, or corrupt files to the storage infrastructure.

6. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which describes how we collect, process, and protect your personal data in compliance with the General Data Protection Regulation (GDPR). The Privacy Policy is available at Privacy Policy and is incorporated into these Terms by reference.

7. Intellectual Property

All source code, software architecture, designs, graphics, branding, trademarks, icons, and visual interfaces within the App are the exclusive intellectual property of Ilias Stentoumis. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. "As-Is" Warranty & Limitation of Liability (Statutory Rights Carve-Out)

• THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PET HEALTH COMPLICATIONS, OR EXPENSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP.

• STATUTORY CONSUMER RIGHTS CARVE-OUT (GREEK CIVIL CODE ART. 332 & DIRECTIVE 93/13/EEC): Nothing in these Terms shall limit or exclude the Developer's liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, or any mandatory statutory consumer rights under Greek Law 2251/1994 or applicable European Union consumer protection laws that cannot be contractually waived.

9. Termination & Account Deletion

• You may terminate this Agreement at any time by permanently deleting your account inside the App via Profile > Delete Account.

• Upon account deletion, all personal data, pet profiles, reminders, documents, and photos are permanently purged from our active databases and storage systems.

• We reserve the right to suspend or terminate your account without notice if you violate these Terms.

10. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. Updated versions will be published at Petminder legal with a revised "Last Updated" date. Your continued use of the App following the posting of any changes constitutes binding acceptance of the updated Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Greece and applicable European Union law, without regard to conflict of law principles. Any legal disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece.
