Acceptance of Terms

By downloading, installing, or using PaceBox ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and PaceBox ("we," "us," or "our") regarding your use of the App.

Description of Service

PaceBox is a running training application for iOS that provides:

- Structured training plans for various running distances (5K, 10K, half marathon, etc)

- Workout scheduling through Apple's WorkoutKit framework

- Progress tracking and completion monitoring

- Personal records management

- Achievement system with unlockable trophies

- Premium subscription features for accessing all training plans

Eligibility

You must be at least 13 years old to use PaceBox. If you are under 18, you must have your parent or legal guardian's permission to use the App. By using PaceBox, you represent and warrant that you meet these requirements.

Account and Registration

PaceBox does not require account creation or registration. The App stores all data locally on your device. You are responsible for maintaining the security of your device and any data stored on it.

Subscription Terms

Premium Subscription

PaceBox offers a premium subscription that unlocks access to all training plans. Subscription details:

Subscription Plans:

- Monthly subscription

- Yearly subscription

Payment:

- Payment is processed through Apple's App Store

- Your iTunes account will be charged upon confirmation of purchase

- All payments are handled by Apple according to their terms

Auto-Renewal:

- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

- Your account will be charged for renewal within 24 hours prior to the end of the current period

- The renewal cost will be clearly displayed before purchase

Managing Subscriptions:

- You can manage your subscription and turn off auto-renewal in your App Store Account Settings

- Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription

Cancellation:

- You may cancel your subscription at any time

- Cancellation takes effect at the end of the current billing period

- No refunds will be provided for the unused portion of any subscription period

Price Changes:

- We may change subscription prices at any time

- Price changes will not affect your current subscription period

- You will be notified of price changes before they take effect

- Continuing to use the subscription after a price change constitutes acceptance of the new price

Free Trial (if offered):

- We may offer free trial periods for new subscribers

- You must cancel before the trial period ends to avoid being charged

- Only one free trial per user

- We reserve the right to determine trial eligibility

License and Restrictions

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use PaceBox for your personal, non-commercial use.

Restrictions

You agree NOT to:

- Modify, reverse engineer, decompile, or disassemble the App

- Remove any copyright or proprietary notices from the App

- Use the App for any commercial purposes without our written permission

- Rent, lease, sell, sublicense, or transfer the App to any third party

- Use the App in any way that violates any applicable laws or regulations

- Use the App to create a competing product or service

- Attempt to gain unauthorized access to any part of the App or its systems

- Use automated systems or bots to access the App

- Interfere with or disrupt the App or servers connected to the App

- Collect or harvest any information from the App or other users

PaceBox is a fitness training tool and is NOT a substitute for professional medical advice, diagnosis, or treatment. The training plans, workouts, and recommendations provided are for general informational and educational purposes only.

Consult Your Doctor

Before beginning any training program:

- Consult with your physician or qualified healthcare provider

- This is especially important if you:

- Have any pre-existing medical conditions

- Are taking any medications

- Have a history of heart disease, high blood pressure, or other cardiovascular conditions

- Have joint, muscle, or bone problems

- Are pregnant or nursing

- Are over 40 years old and have been inactive

- Have any concerns about your ability to safely exercise

Assumption of Risk

By using PaceBox:

- You acknowledge that physical exercise involves inherent risks of injury

- You assume all risks associated with using the training plans and workouts

- You are solely responsible for your health and safety while training

- You should stop exercising immediately and seek medical attention if you experience:

- Chest pain or pressure

- Severe shortness of breath

- Dizziness or lightheadedness

- Unusual fatigue

- Rapid or irregular heartbeat

- Any pain or discomfort

Training Guidance

- Start slowly and progress gradually

- Listen to your body and adjust training as needed

- Ensure proper warm-up and cool-down

- Stay hydrated and maintain proper nutrition

- Use appropriate footwear and equipment

- Train in safe environments

- Consider working with a qualified running coach for personalized guidance

No Warranties

We make no warranties or representations about:

- The accuracy, completeness, or suitability of any training plans

- The results you may or may not achieve

- The safety or effectiveness of any workout for your specific situation

WorkoutKit Integration

PaceBox uses Apple's WorkoutKit framework to schedule workouts to your Apple Watch and Fitness app:

- You must authorize WorkoutKit access for this functionality

- Scheduled workouts will appear in your Apple Workout app

- You are responsible for manually starting and tracking your workouts

- PaceBox does not access your workout performance data or health information

- You can revoke WorkoutKit authorization at any time in your device Settings

User-Generated Content

While PaceBox does not currently support user-generated content or social features, if such features are added in the future:

- You retain ownership of any content you create

- You grant us a license to use, store, and display such content as necessary to provide the service

- You are responsible for the content you create

- We reserve the right to remove any content that violates these Terms

Intellectual Property

Our Rights

All rights, title, and interest in and to PaceBox, including:

- The App design, interface, and functionality

- Training plans and workout structures

- Text, graphics, icons, and images

- Software code and algorithms

- Trademarks and branding

are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Feedback

If you provide us with any feedback, suggestions, or ideas about PaceBox:

- You grant us an unlimited, irrevocable license to use such feedback

- We are not obligated to compensate you for any feedback

- We may use your feedback without any restrictions or obligations to you

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle information.

Key points:

- All user data is stored locally on your device

- We do not collect personal information

- We do not track your location or workout performance

- Subscription processing is handled by Apple

Third-Party Services

PaceBox integrates with Apple services:

Apple Services

- App Store (for subscriptions and payments)

- WorkoutKit (for workout scheduling)

- HealthKit/Fitness (integration only; no data access)

Your use of these services is subject to Apple's terms and policies. We are not responsible for Apple's services or any issues arising from their use.

App Updates and Changes

Updates

We may release updates to PaceBox:

- To add new features or improve existing ones

- To fix bugs or improve performance

- To maintain compatibility with iOS updates

- To comply with legal requirements

Changes to Service

We reserve the right to:

- Modify or discontinue any feature of PaceBox at any time

- Change these Terms at any time (see "Changes to Terms" section)

- Require updates to continue using the App

We will make reasonable efforts to notify you of significant changes.

Termination

By You

You may stop using PaceBox at any time by:

- Deleting the App from your device

- Canceling your subscription (if applicable)

By Us

We reserve the right to:

- Suspend or terminate your access to PaceBox at any time for any reason

- Discontinue PaceBox or any part of it

- Refuse service to anyone

Effect of Termination

Upon termination:

- Your license to use PaceBox ends immediately

- You must delete the App from your devices

- Any subscription benefits end (subject to Apple's refund policies)

- Locally stored data on your device remains until you delete it

- Provisions that should survive termination (such as disclaimers, limitations of liability, and dispute resolution) will remain in effect

Disclaimers

"AS IS" Basis

PACEBOX IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- Warranties of merchantability

- Fitness for a particular purpose

- Non-infringement

- Accuracy or reliability of information

- Uninterrupted or error-free operation

No Guarantee of Results

We do not guarantee:

- That you will achieve any specific fitness goals or results

- That the training plans will be suitable for your specific needs

- That the App will be available at all times

- That the App will be free from bugs, errors, or security vulnerabilities

Device Compatibility

We do not guarantee:

- Compatibility with all iOS devices or versions

- Compatibility with future iOS updates

- That all features will work on all devices

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

- Any indirect, incidental, special, consequential, or punitive damages

- Loss of profits, revenue, data, or use

- Personal injury or property damage

- Damages arising from your use of or inability to use PaceBox

- Damages arising from training plans or workouts

- Damages arising from third-party services (including Apple services)

- Any other damages or losses

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

MAXIMUM LIABILITY:

If we are found liable for any damages, our total liability to you shall not exceed:

- The amount you paid us in the 12 months before the event giving rise to liability

Essential Purpose

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

These limitations apply even if any remedy fails its essential purpose.

Indemnification

You agree to indemnify, defend, and hold harmless PaceBox, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

- Your use of PaceBox

- Your violation of these Terms

- Your violation of any rights of another person or entity

- Any injury or damages you suffer while using training plans or workouts

- Any content you submit or transmit through PaceBox

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Informal Resolution

Before filing any formal legal action, we encourage you to first contact us at pacebox_app@outlook.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes informally within 60 days.

Jurisdiction and Court Proceedings

Any disputes arising out of or relating to these Terms or PaceBox shall be resolved in the courts of England and Wales. You agree to submit to the personal and exclusive jurisdiction of these courts for the resolution of any disputes.

Small Claims Court: You may choose to bring claims in small claims court if they qualify under the applicable rules and value limits.

Consumer Rights: If you are a consumer based in the UK or EU, nothing in this section affects your mandatory rights under local consumer protection laws, including your right to bring proceedings in the courts of your country of residence.

Apple-Specific Terms

Because PaceBox is distributed through the Apple App Store, the following terms apply:

Apple's Role

- Apple is not a party to these Terms

- Apple has no obligation to provide any support or maintenance for PaceBox

- Apple is not responsible for addressing any claims relating to PaceBox

- Apple is not responsible for any product liability claims

- Apple is not responsible for any claims that PaceBox fails to conform to legal or regulatory requirements

Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

Legal Compliance

You represent and warrant that:

- You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country

- You are not listed on any U.S. Government list of prohibited or restricted parties

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PaceBox regarding the use of the App and supersede any prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign or transfer these Terms at any time without restriction.

Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

- Acts of God

- Natural disasters

- War or terrorism

- Labor disputes

- Internet service provider failures

- Changes to Apple's platforms or services

Survival

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to:

- Disclaimers

- Limitations of liability

- Indemnification

- Dispute resolution

- Intellectual property provisions

Notices

We may provide notices to you by:

- Displaying a notification in the App

- Sending an in-app message

- Posting on our website

Interpretation

- The section headings are for convenience only and do not affect interpretation

- "Including" means "including but not limited to"

- Singular terms include the plural and vice versa

- References to "days" mean calendar days unless otherwise specified

UK and EU Consumer Rights

If you are a consumer based in the United Kingdom or European Union, you have certain statutory rights that cannot be limited by these Terms:

UK Consumer Rights

Under the Consumer Rights Act 2015 and related legislation, you have the right to:

- Receive digital content that is of satisfactory quality, fit for purpose, and as described

- A repair or replacement if the digital content is faulty

- A price reduction or full refund in certain circumstances

- Cancel within 14 days of purchase for online/distance sales (cooling-off period)

14-Day Cancellation Period:

- You may cancel your subscription within 14 days of purchase for a full refund

- This right may be waived if you access premium content before the 14-day period ends

- To exercise this right, contact Apple Support or visit reportaproblem.apple.com

- Refunds are processed through Apple's App Store according to their policies

EU Consumer Rights

Under EU Directive 2011/83/EU and related consumer protection laws, you have similar rights including:

- Right of withdrawal within 14 days of purchase

- Right to digital content that conforms to the contract

- Right to remedies if digital content is defective

- Right to clear and transparent terms

GDPR and UK Data Protection

Under GDPR (EU) and UK GDPR, you have rights regarding your data:

- Right to access your personal data

- Right to rectification of inaccurate data

- Right to erasure ("right to be forgotten")

- Right to data portability

- Right to object to processing

Note: PaceBox stores all data locally on your device. We do not collect or process personal data. For more details, see our Privacy Policy.

Important Notes

Refund Requests: All subscription refunds must be requested through Apple, as they process all payments. We cannot process refunds directly.

Statutory Rights: Nothing in these Terms affects your statutory rights as a consumer under UK or EU law. If any part of these Terms conflicts with your mandatory consumer rights, those Terms will not apply to you, and your statutory rights will prevail.

Unfair Contract Terms: Any terms that are deemed unfair under UK Consumer Rights Act 2015 or EU consumer protection law will not be binding on consumers.

Changes to These Terms

We may update these Terms from time to time. When we make changes:

- We will update the "Last Updated" date at the top

- For material changes, we will notify you through the App or other reasonable means

- Your continued use of PaceBox after changes take effect constitutes acceptance

- If you do not agree to the new Terms, you must stop using PaceBox
