These Terms of Service ("Terms") govern your use of OpenUp: Your Confidence App (the "App"), developed by Mahesh Rokaya ("we," "us," "our"). By downloading or using the App, you agree to these Terms.
Note on software license: These Terms cover your use of the OpenUp service. The underlying software license for the App is Apple's Standard End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
OpenUp is a confidence-building app designed to help users become more comfortable communicating and interacting with others. The App provides:
A set of confidence-building tasks for users to complete
An AI Practice feature that lets users have a conversation with an AI assistant to practice real-world communication
OpenUp does not require you to create an account or sign in. You can use the free portion of the App immediately after download.
The first five (5) tasks and Lessons are available free of charge.
All remaining tasks and the AI Practice feature require an active paid subscription.
OpenUp offers auto-renewable subscriptions, billed through your Apple App Store account:
Weekly Subscription — auto-renews every month
Yearly Subscription (3 day free trial) — auto-renews every year
Exact current pricing for each plan is displayed on the purchase screen within the App and on the App Store product page prior to purchase, and may vary by region. There is currently no free trial offered.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price unless changed and disclosed to you in advance.
You can manage or cancel your subscription anytime in your Apple ID Account Settings (Settings > [Your Name] > Subscriptions).
All purchases are billed through Apple. Refund requests are handled by Apple in accordance with Apple's own refund policies, not by us directly.
The AI Practice feature uses a third-party AI service (Google Gemini) to simulate conversation for practice purposes only.
This feature is not a substitute for professional advice. OpenUp is not a licensed therapist, counselor, or medical provider, and the AI Practice feature does not provide therapy, psychological treatment, or medical advice of any kind.
If you are experiencing a mental health crisis, please contact a licensed professional or your local emergency/crisis services.
Before your first use of AI Practice, you will be asked to consent to sending your conversation input to Google Gemini for processing. Declining this consent means the AI Practice feature will not be available to you, but you may continue using the free tasks.
OpenUp uses PostHog, a third-party analytics service, to help us understand how users interact with the App and improve its functionality, reliability, and user experience.
PostHog may process certain technical and usage information, such as information about App interactions, features used, events, and device or session-related information. We do not use PostHog to provide the AI responses in the App.
Because OpenUp does not require users to create an account, analytics information is not associated with an OpenUp account or user profile unless otherwise described in our Privacy Policy.
PostHog is a third-party service, and its processing of information may be subject to its own terms and privacy practices. For more information about what information we collect, why we collect it, how third-party services are used, and your available choices, please see our Privacy Policy.
You agree not to:
Use the App for any unlawful purpose
Attempt to reverse-engineer, decompile, or extract the App's source code, except as permitted by applicable law
Use the AI Practice feature to generate harmful, abusive, or illegal content
Interfere with or disrupt the App's servers or third-party service integrations
All content, design, branding, and functionality of the App (excluding third-party AI-generated responses) are the property of Mahesh Rokaya and are protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without prior written permission.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the App, including the AI Practice feature, will be uninterrupted, error-free, or produce any specific outcome (such as increased confidence or improved communication skills).
To the maximum extent permitted by applicable law, Mahesh Rokaya shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App, including any reliance on AI Practice conversations.
We reserve the right to suspend or discontinue the App, or any feature of it (including AI Practice), at any time. If you have an active subscription at the time of discontinuation, you may cancel it through your Apple ID Account Settings.
These Terms shall be interpreted in good faith and in accordance with generally applicable consumer protection principles. Nothing in these Terms limits any statutory rights you may have under the mandatory consumer protection laws of your country of residence.
We may revise these Terms from time to time. Updates will be posted at this URL with a revised "Last Updated" date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
