First individual mediation meeting

Before the first individual meeting (pre-mediation), clients often ask what the mediation process actually looks like. In this video, I explain its key stages and how the process is structured. I usually share it before the first meeting to help reduce uncertainty and clarify what to expect.

Emotions in mediation

Due to my experience, the mediator’s ability to help parties to work through their emotions is essential in mediation: not only in the family cases but also in the business mediation.

By identifying the parties' emotions, we help them to make the first step to understanding their real interests and needs. Moreover, it's crucial to help parties to name their emotions in words. It helps to bring back the ability to think rationally by getting out of the "fight-flight-freeze" mode (when amygdala hijack happens) and switching back to the neocortex.

From positions to interests and needs in mediation

Some mediators believe that a deep understanding of each party’s interests and needs is at the heart of mediation — I share this view.

When negotiations focus only on positions, the result is often compromise or competition. Shifting the focus to interests opens the possibility for collaboration. Going deeper, to underlying needs, creates even stronger potential for mutually beneficial outcomes. As Roger Fisher and William Ury noted, the most powerful drivers in negotiation are basic human needs.
