OkPic - Ai Product Photography Terms and Conditions

Please read these Terms & Conditions ("Terms") carefully. These Terms constitute a binding legal agreement between you ("User" or "You") and ARK Development ("Company," "we," "us," or "our") governing your use of the OkPic - Ai Product Photography mobile application ("Application").

1. Acceptance of Terms and Age Restriction

1.1. Acceptance: By accessing or using the Application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Application. 1.2. Age Restriction: You represent and warrant that you are at least 18 years of age and legally capable of entering into this binding agreement. This is mandatory due to the nature of the AI service provided via the Gemini API.

2. Service and Credits

2.1. Service Description: The Application uses third-party Artificial Intelligence (AI) technology, specifically the Gemini 2.5 Flash image model, to process user-uploaded product images and generate enhanced product photography featuring a human model. 2.2. Credits: Usage of the image generation service requires pre-purchased credits. One (1) credit equals one (1) image generation attempt. 2.3. Free Trial: Each new user receives one (1) free credit for trial purposes only. 2.4. Credit Rollover: If you renew or upgrade an existing credit package before its stated expiration date, any remaining unused credits from the old package will be rolled over and added to the new package. Credits are not transferrable and have no cash value.

3. Billing and Refund Policy

3.1. Payment Gateway: All payments are processed through Razorpay or other designated payment providers. 3.2. No Refund Policy: ALL PURCHASES OF CREDITS ARE FINAL AND NON-REFUNDABLE. We do not provide refunds, monetary or otherwise, for any reason, including but not limited to: * Unused credits remaining upon package expiration (unless rolled over as per Clause 2.4). * Dissatisfaction with the generated images (quality, accuracy, or likeness). * Account suspension or termination due to violation of these Terms. 3.3. Chargebacks: You agree not to file a chargeback or payment dispute against ARK Development for credit purchases. Any attempt to dispute a valid charge will result in the immediate and permanent suspension of your account and the forfeiture of all remaining credits.

4. User Content and AI Liability (Indemnity)

4.1. User Warranty for Uploaded Content: You warrant that you are the sole legal owner of the uploaded product photos or have all necessary licenses, rights, consents, and permissions to upload them and for us to use them to generate new images. 4.2. Prohibited Content: You agree not to upload, process, or attempt to generate any content that is or contains: * Illegal, harmful, harassing, defamatory, or hateful content. * Content violating copyright, trademark, or any intellectual property rights. * Nudity, sexually explicit, or obscene material. * Violence or content promoting dangerous or illegal acts. * Images of minors or content depicting child exploitation or abuse. * Images depicting the likeness of real individuals, celebrities, or public figures without explicit commercial consent. 4.3. Right to Refuse/Delete: We reserve the right, at our sole discretion and without prior warning or refund, to immediately delete any content and terminate the account of any User who violates the Prohibited Content clause. 4.4. AI-Generated Content Disclaimer: * We use a third-party AI model (Gemini 2.5 Flash). We do not own, control, or claim copyright over the generated output. * The Generated Image is owned by the User (to the extent permitted by law and the underlying third-party AI terms). * Commercial Use: You are allowed to use the generated image for commercial purposes, but you accept sole responsibility for ensuring the generated image meets all legal standards, including rights to the human model likeness and adherence to any regulations in your industry. * NO WARRANTY: The AI output may be inaccurate, flawed, or fail to meet your expectations. We provide the service "AS IS" and offer no warranty regarding the quality, suitability, accuracy, or non-infringement of the generated images. 4.5. Indemnification: You agree to indemnify, defend, and hold harmless ARK Development from and against any and all claims, liabilities, damages, costs, and expenses (including legal fees) arising from: (a) your breach of these Terms, (b) your uploaded content, (c) your use of the generated content (including commercial use), and (d) any violation of law or third-party rights caused by you.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising under or in relation to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
