Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the NoteBird AI mobile application (the "Service") operated by Toolsbird ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
## 1. Description of Service
NoteBird AI provides AI-powered productivity tools including, but not limited to:
- Voice-to-text transcription.
- Optical Character Recognition (OCR) for images and documents.
- AI-driven note refinement and summarization.
- Secure cloud synchronization via Google Drive and task management.
## 2. Accounts and Registration
When you create an account with us (via Google Sign-In or other methods), you must provide information that is accurate and complete. You are responsible for safeguarding the password/account used to access the Service and for any activities or actions under your account.
## 3. Subscription and Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)").
- **Plans**: We offer Monthly, Yearly, and Lifetime plans.
- **Billing**: Subscriptions are managed and processed through the Apple App Store or Google Play Store.
- **Trial Period**: We may offer a limited free trial of premium features (e.g., a specific number of AI scans). Once the trial ends, you must subscribe to continue using those features.
- **Ad-Supported Tier**: Non-premium users may be required to view rewarded advertisements to unlock specific features (like OCR scans).
## 4. AI and Usage Limits
- **AI Content**: The Service uses third-party AI models (e.g., Google Gemini, Groq, Cerebras). While we strive for accuracy, we do not guarantee the correctness of AI-generated transcriptions or refinements.
- **Usage Caps**: Free users are subject to daily or monthly limits on AI processing. Premium users have higher limits as defined in the app's subscription details.
## 5. Intellectual Property
The Service and its original content (excluding user-generated notes), features, and functionality are and will remain the exclusive property of Toolsbird and its licensors.
## 6. User Content
You retain all rights to the notes, audio, and images you upload or create ("User Content"). However, by using the Service, you grant us the necessary permissions to process this data solely for providing the Service to you (including reading and writing files in your private Google Drive app folder when Google Drive sync is enabled). We do not claim ownership of your notes.
## 7. Prohibited Uses
You agree not to use the Service:
- For any unlawful purpose.
- To transmit any malware or viruses.
- To attempt to gain unauthorized access to our servers or user accounts.
- To reverse engineer the application.
## 8. Limitation of Liability
In no event shall Toolsbird, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
