Terms of Use for Moqaysa | مقايسة

These Terms of Use (“Terms”) govern your use of Moqaysa | مقايسة (“Moqaysa”, “the App”), developed and published by EMAD DEV.

By downloading, accessing, or using Moqaysa, you agree to these Terms. If you do not agree with them, do not use the App.

1. Purpose of Moqaysa

Moqaysa is a construction quantity-estimation, BOQ, project-management, reporting, procurement, cost-control, and project-control assistance application.

Depending on the version and features available to you, Moqaysa may provide tools relating to:

·         construction quantity calculations;

·         finishing-work calculations;

·         Bills of Quantities (BOQ);

·         project organization and project records;

·         material pricing;

·         procurement and purchasing;

·         contractor and payment-certificate workflows;

·         project progress and control;

·         structural quantity takeoff;

·         concrete and reinforcement workflows;

·         Bar Bending Schedules (BBS);

·         reinforcement cutting and remnant calculations;

·         site-control and reporting workflows;

·         PDF reports;

·         Excel exports;

·         backup and synchronization; and

·         other construction-management and productivity functions.

Features may change, be added, removed, limited, or reorganized as Moqaysa develops.

2. Important Calculation Notice

Moqaysa provides calculation and estimation assistance.

All quantities, formulas, material summaries, rates, costs, reinforcement outputs, schedules, optimization results, and other calculated outputs must be treated as assistance and estimates, not as automatically approved engineering or contractual results.

Actual requirements may differ because of factors including:

·         site conditions;

·         project geometry;

·         execution methods;

·         workmanship;

·         material properties and brands;

·         waste and cutting losses;

·         construction tolerances;

·         design revisions;

·         local codes and standards;

·         approved drawings;

·         contractual specifications; and

·         information entered by the user.

You are responsible for reviewing and verifying outputs before relying on them for purchasing, construction, pricing, tendering, contracting, certification, or other professional purposes.

3. No Substitute for Professional Engineering or Contract Administration

Moqaysa does not replace:

·         professional engineering judgment;

·         licensed engineering services where legally required;

·         approved structural calculations;

·         approved design drawings;

·         approved shop drawings;

·         MEP design;

·         geotechnical advice;

·         manufacturer technical data;

·         site inspection;

·         quantity-surveyor or cost-consultant review;

·         contract administration;

·         applicable building codes or regulations; or

·         project-specific contractual specifications.

Structural, reinforcement, BBS, optimization, quantity, cost, or project-control functionality in the App does not constitute approval, certification, or professional engineering advice.

Qualified professionals must review information where required by the project, contract, applicable standards, or law.

4. User Responsibility

You are responsible for:

·         entering accurate dimensions, quantities, rates, materials, assumptions, and project information;

·         selecting appropriate calculation options;

·         checking units and currencies;

·         reviewing formulas and results where professional verification is required;

·         verifying generated BOQs, reports, schedules, and exports;

·         protecting confidential project/client information you enter;

·         maintaining appropriate independent project records and backups;

·         confirming construction information against approved project documents; and

·         reviewing information before sharing it with clients, consultants, contractors, suppliers, authorities, or other parties.

You remain responsible for decisions made using information produced by the App.

5. Accounts

Certain Moqaysa functionality requires sign-in.

You are responsible for maintaining access to the Google or other supported account used to authenticate with Moqaysa and for activity performed through your authenticated account.

You must not intentionally attempt to access another user’s cloud information, bypass access controls, interfere with backend services, or misuse the App.

6. Free and Pro Functionality

Moqaysa may provide both Free and Pro functionality.

The exact features, project limits, export permissions, advertising behavior, rewarded-ad unlocks, and Pro entitlements are determined by the version of the App and the product rules presented to you.

Free functionality may include limitations that do not apply to eligible Pro users.

Certain free features may be made available after completion of a rewarded advertisement.

Feature availability may change in future versions, subject to applicable purchase rights and platform requirements.

7. Pro Features and Payments

Where available, Moqaysa offers paid functionality through Google Play Billing, including:

·         an annual auto-renewing Pro subscription; and

·         a one-time Pro Lifetime purchase.

The price and applicable currency are displayed by Google Play before purchase confirmation.

Moqaysa does not directly receive your full payment-card information.

Purchases must be successfully verified before the corresponding entitlement is activated.

Annual Subscription

The annual Pro subscription may automatically renew unless cancelled through Google Play according to Google Play’s applicable rules.

You can manage or cancel the subscription through your Google Play account.

Cancellation of renewal does not normally terminate already-paid access immediately; access generally continues until the end of the applicable paid period unless the purchase is refunded, revoked, or otherwise invalidated.

Pro Lifetime

Pro Lifetime is a one-time purchase providing access to the applicable Core Pro functionality associated with that entitlement.

“Lifetime” refers to the lifetime of the supported Moqaysa product/service and does not mean that every future service, external paid service, or separately priced product must be included.

Future functionality with substantial recurring operating costs—such as separately offered AI services, advanced cloud processing, collaboration services, credits, or a future separately priced tier—may be offered separately and is not automatically guaranteed as part of Pro Lifetime.

8. Advertising

Eligible Free users may see advertisements.

Moqaysa may use:

·         banner advertisements; and

·         rewarded advertisements associated with particular optional free unlocks.

Availability and behavior may depend on consent requirements, region, account status, and current product rules.

Completing a rewarded advertisement provides only the specific benefit described by the App and does not create a permanent Pro entitlement unless explicitly stated.

9. Reports and Exports

Moqaysa may generate PDF reports, Excel files, BOQs, schedules, summaries, and other exports.

Generated files reflect:

·         information entered by the user;

·         selected settings;

·         available project data; and

·         the App’s calculation and reporting logic.

You must review generated documents before professional, commercial, contractual, or construction use.

The availability and format of exports may differ between Free and Pro functionality.

10. Cloud Sync and Backups

Moqaysa may provide cloud synchronization and Google Drive backup functionality.

Cloud synchronization and backup services are convenience and continuity tools and should not be treated as your only project-record storage system.

You are responsible for maintaining appropriate independent copies of important professional or contractual information.

Cloud and backup functionality may depend on:

·         internet availability;

·         third-party services;

·         account authentication;

·         Google Drive authorization;

·         service availability; and

·         compatible application versions.

We cannot guarantee uninterrupted synchronization or recovery in every circumstance.

11. User Content

You retain responsibility for information and content you enter into Moqaysa.

You must have the right to use any project, client, company, logo, pricing, contractor, supplier, or other information you enter or upload.

Do not use Moqaysa to store or distribute unlawful content or content that infringes the rights of another person.

12. Account and Data Deletion

Moqaysa provides controls for deleting local data, cloud data, and the user’s account.

Permanent account deletion may require reauthentication.

The applicable deletion function may remove:

·         Moqaysa Google Drive data;

·         applicable Firebase Firestore data;

·         the Firebase Authentication account; and

·         local application data.

13. Third-Party Services

Moqaysa relies on third-party platforms and services for certain functionality, including services provided by Google and Firebase.

Third-party functionality may be subject to separate terms, privacy policies, availability, technical limitations, or account requirements.

Moqaysa is not responsible for outages, policy changes, account restrictions, or failures controlled solely by third-party providers.

14. Availability and Changes

We aim to maintain and improve Moqaysa, but we do not guarantee that every feature will always be available, uninterrupted, or error-free.

We may:

·         fix or change features;

·         update calculations or workflows;

·         improve reports;

·         change interfaces;

·         introduce new functionality;

·         retire obsolete functionality; or

·         make changes required by technical, security, legal, or platform requirements.

Where appropriate, changes will be introduced through application updates.

15. Prohibited Use

You must not intentionally:

·         reverse engineer or interfere with protected backend services except where applicable law expressly permits;

·         bypass authentication, entitlement, advertising, or purchase-verification controls;

·         attempt unauthorized access to another user’s data;

·         misuse cloud or backend resources;

·         distribute malicious content through the App;

·         use the App for unlawful activity; or

·         intentionally disrupt the operation or security of Moqaysa.

16. Disclaimer of Warranties

To the extent permitted by applicable law, Moqaysa is provided on an “as is” and “as available” basis.

We do not guarantee that:

·         calculations will be suitable for every project;

·         outputs will satisfy every local code or contractual requirement;

·         the App will operate without interruption;

·         cloud synchronization or backups will never fail; or

·         every result will be free from errors.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, EMAD DEV is not responsible for indirect, incidental, special, consequential, or similar losses arising from reliance on App outputs, including losses associated with:

·         inaccurate user inputs;

·         unverified quantities or calculations;

·         purchasing or procurement decisions;

·         construction decisions;

·         pricing or tender decisions;

·         project delays;

·         loss of project data;

·         third-party service interruptions; or

·         use of reports without appropriate professional review.

This limitation does not apply where liability cannot lawfully be limited or excluded.

18. Changes to These Terms

We may update these Terms when Moqaysa’s functionality, commercial model, technical services, or legal requirements change.

The effective date will be updated when the Terms are revised.

Continued use of the App after updated Terms become applicable may constitute acceptance to the extent permitted by applicable law.
