These Terms of Use apply to Mood Tracker: Daily Moments (“Daily Moments,” “the app,” “we,” “us,” or “our”). By using the app, you agree to these terms. If you do not agree, do not use the app.

1. Purpose of the app

Daily Moments provides tools for mood check-ins, short personal notes, reviewing history, daily affirmations, optional cycle records, and personal patterns. It is intended for personal, non-commercial reflection.

The app is not a medical device or a healthcare service. It does not provide diagnosis, treatment, therapy, emergency assistance, or professional medical advice. It does not monitor your entries for risk or alert anyone on your behalf.

2. Patterns, affirmations, and cycle information

Patterns depend on the information you record and may be incomplete or unrepresentative. Associations in your records do not establish cause and effect. We do not guarantee improved mood, health outcomes, or any particular result.

Affirmations are general content, not individualized advice. Cycle phases and related information may be estimated and should not be used to confirm ovulation, plan or prevent pregnancy, or make medical decisions. Consult a qualified healthcare professional about health concerns. For an emergency, contact local emergency services.

3. Eligibility and responsible use

The app is not directed to children under 13. You must meet any additional age or parental-consent requirements that apply where you live. If you cannot legally agree to these terms on your own, a parent or guardian must agree on your behalf where permitted.

Use the app lawfully. Do not misuse it, interfere with its operation, attempt unauthorized access, or infringe others’ rights.

4. Free features and Premium

Some features are free; others require Premium. The app shows the current features, prices, billing periods, and any applicable offer terms before you purchase. Availability and prices may vary by storefront.

Monthly and yearly plans are auto-renewable subscriptions. Lifetime is a one-time, non-consumable purchase that unlocks the offered Lifetime Premium entitlement without recurring subscription charges. It does not promise that all future, separately offered products or services will be included.

5. Subscription billing and trials

Apple charges purchases to your Apple Account. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Your account may be charged for renewal within 24 hours before the end of the current period, at the renewal price disclosed by Apple.

If a free trial or introductory offer is available, its duration, eligibility, and subsequent price will be shown before confirmation. A trial may convert to a paid subscription unless canceled in time. Follow the cancellation deadline in Apple’s purchase terms; Apple advises canceling a free or discounted trial at least 24 hours before it ends. Any unused portion of a free trial may be forfeited when purchasing a subscription, where applicable under Apple’s terms.

Manage or cancel subscriptions in your Apple Account subscription settings. Cancellation generally stops the next renewal; the access end date is shown by Apple and may differ for trial cancellations. Uninstalling the app or deleting app data does not cancel billing.

6. Restore purchases, refunds, and access changes

Use Restore Purchases with the Apple Account that made the purchase to restore eligible Premium access. Restoring purchases does not restore journal data. Refund requests are handled by Apple through Report a Problem, subject to Apple’s rules and applicable consumer law.

If a subscription expires or a purchase is refunded or revoked, Premium access may end. Saved entries remain available through free features unless you delete them or they are otherwise lost. Restoring an expired subscription does not renew it.

7. Your entries and backups

You retain your rights in the content you create. The app processes it to provide recording, display, editing, pattern calculations, and optional backup features. We do not claim ownership of your journal entries.

You are responsible for what you record and for reviewing backup status. Optional iCloud backup depends on Apple services, your account, available storage, and connectivity. It is not real-time synchronization and does not merge records across devices. We cannot guarantee recovery of data without a usable local copy or backup. Review deletion and Start Fresh confirmations carefully.

8. Privacy

Our Privacy Policy explains local storage, optional iCloud backup, analytics, diagnostics, purchases, and support communications. Please read it alongside these terms.

9. Apple license and third-party services

For the iOS app, Apple’s Standard Licensed Application End User License Agreement applies to the app license unless a valid custom EULA is provided through the App Store. These terms supplement that license with app-specific service terms and do not override mandatory rights or applicable Apple terms.

Apple and other third-party services are governed by their own applicable terms. Their availability and operation are outside our sole control.

10. Intellectual property

Except for your own content and material owned by third parties, the app’s design, artwork, text, and software are protected by applicable intellectual-property laws. Your right to use them is limited to the license granted for use of the app. Do not copy or redistribute them without permission except where the law allows.

11. Availability, warranties, and liability

We aim to provide a reliable app, but it may contain errors or experience interruptions. Features may change as the app develops. We will honor applicable purchase terms, notice requirements, and consumer rights when changes affect paid access.

To the extent permitted by law, the app is provided “as is” and “as available,” without additional warranties. To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the app. Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable statutory consumer guarantees. These terms do not remove mandatory rights available to you under local law.

12. Changes and contact

We may update these terms and will revise the date above. Where required, we will provide notice of material changes or obtain consent. Updates will not remove rights that cannot lawfully be limited.
