Terms of Use / End User License Agreement

These Terms govern your use of software, browser extensions, websites, and related services developed by modcore ("we", "us", "our").
1. Acceptance
By installing or using any modcore product (the "Tools"), you agree to these Terms. If you do not agree, do not use the Tools.
If you use the Tools on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms work alongside our Privacy Policy and Patreon Terms. If there is a conflict:

2. Definitions
modcore is an open-source project run by individuals based in Germany.
"Tools" means our software and browser extensions, including modcore Extension Manager, modcore Authenticator, and modcore Clipboard.
Open-Source Software: Code released under an approved open-source license
Distributed Version: Official builds from the Chrome Web Store, Edge Add-ons, or similar platforms
Closed-Source Components: Proprietary parts like branding, logos, and exclusive features not released under an open-source license
3. Licensing
3.1 Open Source
Unless a specific file or repository states otherwise, our original code is released under the Apache License, Version 2.0. Some components may use different open-source licenses - check the relevant repository for details.
Your rights to use, modify, and distribute open-source components are governed by the applicable license.
3.2 Closed-Source Components
Official Distributed Versions may include Closed-Source Components. These remain our property and are not covered by the Apache 2.0 license. You may not copy, modify, or redistribute them without our written permission.
4. Permitted Use
You may use the Tools for personal, educational, or commercial purposes, provided you:
Follow all applicable laws
Do not misrepresent modified versions as official modcore products
Do not damage our name, branding, or reputation
You may install and use the Tools on any number of devices for your personal or organizational use.
If you distribute a modified version to third parties, it must:
Use a clearly different name (no "modcore" or confusingly similar terms)
Display "UNOFFICIAL" or "FORK" prominently in the user interface and store listings
Link to the original modcore repository
Not use our official logos or branding without written permission
These fork requirements do not apply to internal modifications that are not made publicly available.
5. Add-ons and Third-Party Content
5.1 Official Add-ons
Extras we develop may be available through GitHub or Patreon. Add-ons distributed via Patreon are subject to our Patreon Terms.
We may change add-on availability, pricing, or access conditions at any time.
5.2 Third-Party Add-ons
We do not control, audit, or endorse third-party add-ons. Installing them is at your own risk.
6. Updates and Availability
We may update, change, or discontinue features or entire Tools. By using the Tools, you accept that updates may install automatically through your browser. You can disable automatic updates through your browser settings, but we may not support outdated versions.
If we discontinue an entire Tool, we will try to give at least 30 days' notice on our website or GitHub, unless security or legal concerns prevent this.
If a distribution platform removes the Tools, we will endeavor to provide alternative download methods through our website or GitHub, but we are not obligated to do so.
You are responsible for backing up your data. We do not guarantee backward compatibility.
7. Privacy and Your Data
The Tools are built to work primarily on your device. We do not operate our own remote servers to collect, store, or process your personal data through the Tools. Our website and support systems use third-party infrastructure as described in our Privacy Policy.
Some features require network connections (for example, checking for updates or using GitHub APIs).
You are responsible for:
Your locally stored data
Your device security
Backing up and exporting your data

8. Third-Party Services
Some features interact with services we do not control, such as GitHub, Chrome Sync, or Patreon. We are not responsible for their availability, security, or data practices.
9. Prohibited Uses
You may not:
Violate EU, German, or applicable export control laws
Remove copyright notices or license terms
Distribute malware disguised as modcore software
Disrupt our website, distribution channels, or related infrastructure
Security Research
Good-faith security research is permitted on publicly available source code and official Distributed Versions. Contact us at least 90 days before publishing critical vulnerabilities.
This exception does not extend to Patreon-exclusive builds, server infrastructure, or closed-source components outside official Distributed Versions.
10. Support
We provide support on a best-effort basis. We do not guarantee response times, bug fixes, or compatibility with future browser versions.
11. Warranty Disclaimer
To the maximum extent permitted by applicable law:
The Tools are provided "as is" and "as available." We make no warranties about fitness for a particular purpose, merchantability, error-free operation, or continuous availability.
Use the Tools at your own risk.
12. Liability
For users in Germany and the EU:
We are fully liable for intentional harm and gross negligence
For ordinary negligence, we are liable only for breach of essential contractual obligations, limited to foreseeable damages
Liability for injury to life, body, or health remains unaffected
Mandatory statutory liability remains unaffected
We are not liable for:
Data loss resulting from your failure to back up, or from events outside our control (we remain liable for data loss directly caused by our gross negligence or willful misconduct)
Extension conflicts
Browser instability
Incompatibility with future browser versions
For disputes related to Patreon support, liability is capped per our Patreon Terms.
13. Termination
We may restrict or remove access to official distribution channels if you violate these Terms, use the Tools for illegal purposes under applicable law, or if we are required to do so by law or platform policy.
Termination does not revoke rights granted under open-source licenses, but may limit access to official builds and services.
Sections 11, 12, and 16 survive termination.
14. Age Requirement
You must be at least 13 years old. If you are under 16, you must have permission from a parent or legal guardian.
Patreon support requires you to be 18 or older.
15. Governing Law and Disputes
These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For German residents, jurisdiction is determined by general German procedural law. For merchants or users who do not live in Germany, the place of jurisdiction is Germany. For non-EU consumers, the courts of Germany have jurisdiction unless mandatory local law requires otherwise.
This does not affect the rights of EU consumers to bring legal proceedings in their country of residence under applicable EU law.
Patreon disputes are subject to binding arbitration per our Patreon Terms.
16. Severability
If any part of these Terms is unenforceable, the rest remains in full effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Patreon Terms, constitute the entire agreement between you and modcore regarding the Tools.
18. Feedback and Contributions
By submitting feedback, suggestions, or code contributions to modcore, you grant us a perpetual, royalty-free, worldwide license to use, modify, and incorporate them into the Tools. You represent that your contributions do not infringe third-party rights.
19. Indemnification
You agree to indemnify and hold modcore harmless from claims arising from your violation of these Terms, your modifications to the Tools, or your distribution of third-party add-ons.
20. Changes
We may update these Terms to reflect legal, technical, or organizational changes. Continued use after changes take effect means you accept the updated Terms.
