Terms of Use / End User License Agreement

These Terms of Use / End User License Agreement ("Terms", "EULA") govern your use of official software and distributed builds developed or published by modcore ("modcore", "we", "us", "our").

These Terms are primarily intended for official distributed versions of modcore software, including builds distributed through official app stores, download channels, or other official distribution methods.

These Terms do not replace or override an applicable open-source license for software released under an open-source license.

They also do not generally govern Patreon posts, Patreon membership payments, or Patreon-exclusive non-software content. Those matters are governed by our Patreon & Payment Terms where applicable.

1. Acceptance

By downloading, installing, accessing, or using a Covered Distributed Version of modcore software, you agree to these Terms.

If you do not agree to these Terms, do not install or use the applicable Covered Distributed Version.

If you use the software on behalf of an organization, you confirm that you have authority to accept these Terms on that organization's behalf.

These Terms work alongside our Privacy Policy and, where applicable, our Patreon & Payment Terms and third-party licenses.

Where different terms apply to different parts of a product, the applicable license or terms for that specific part take precedence.

In particular:

• Open-source licenses govern software released under those licenses.

• This EULA governs your use of Covered Distributed Versions to the extent described here.

• Our Privacy Policy governs applicable data practices.

• Our Patreon & Payment Terms govern Patreon memberships, payments, and Patreon-related benefits.

• Third-party licenses govern third-party software and content where applicable.

2. Scope and Definitions

2.1 modcore

modcore is an independent software organization based in Germany. Many modcore projects are open source.

2.2 Tools

"Tools" means software, browser extensions, applications, utilities, and related software products developed or published by modcore.

2.3 Open-Source Software

"Open-Source Software" means source code that modcore has expressly released under an applicable open-source license.

Examples may include software published in a public modcore GitHub repository.

2.4 Covered Distributed Version

"Covered Distributed Version" means an official compiled, packaged, or otherwise distributed version of a Tool that modcore provides through an official distribution channel.

This may include:

• Official Chrome Web Store releases

• Official Edge Add-ons releases

• Official Itch.io releases

• Official downloads from modcore

• Official installers or packages

• Other versions explicitly identified by modcore as official distributed releases

A Covered Distributed Version may contain both Open-Source Software and components that are not released under an open-source license.

2.5 Proprietary Components

"Proprietary Components" means parts of a Covered Distributed Version that are owned by modcore or its licensors and are not released under an open-source license.

This may include, depending on the product:

• Proprietary code

• Compiled-only components

• Proprietary assets

• Branding

• Logos

• Artwork

• Icons

• Other protected materials

2.6 Patreon Content

"Patreon Content" means content published through modcore's Patreon, including Patreon posts, exclusive media, development material, documentation, assets, and other Patreon-exclusive material.

Patreon Content is generally governed by our Patreon & Payment Terms and any specific license that accompanies the content.

Patreon Content is not automatically governed by this EULA simply because it relates to modcore software.

3. Open-Source Software

3.1 Applicable Open-Source License

Where modcore releases software under an open-source license, your rights to that software are governed by the applicable license.

For example, where the Apache License, Version 2.0 applies, that license governs your rights to use, modify, reproduce, and distribute the applicable software.

The applicable repository or source distribution should be consulted to determine which license applies.

3.2 This EULA Does Not Restrict Open-Source Rights

Nothing in this EULA is intended to restrict rights that you receive under a valid open-source license.

If a provision of this EULA conflicts with an applicable open-source license concerning the licensed source code, the open-source license controls for that source code.

You do not lose your open-source rights because the same software is also available as an official distributed build.

3.3 Separate Components

A project may contain components under different licenses.

You are responsible for reviewing applicable license notices when modifying or redistributing software.

4. Official Distributed Versions

A Covered Distributed Version may contain components that are not included in the corresponding open-source repository or that are otherwise subject to separate restrictions.

For those Proprietary Components, you receive a limited license to use them as part of the official Covered Distributed Version.

Unless an applicable license expressly permits otherwise, you may not:

• Extract Proprietary Components for separate distribution.

• Redistribute proprietary assets independently.

• Copy proprietary branding into unrelated software.

• Sell Proprietary Components.

• Sublicense Proprietary Components.

• Claim Proprietary Components as your own.

• Remove applicable copyright or ownership notices.

This section does not restrict rights granted by an applicable open-source license.

5. Permitted Use

Subject to these Terms and applicable licenses, you may use official modcore software for:

• Personal use

• Educational use

• Development and testing

• Commercial use

• Organizational use

You must comply with applicable laws and third-party terms.

You may install an official Tool on multiple devices that you own or control, unless a particular product has separate licensing restrictions.

You are responsible for ensuring that your use of the Tool is appropriate for your environment.

6. Modified and Forked Versions

Open-source software may be modified and forked where permitted by its applicable open-source license.

If you publicly distribute a modified version, you must comply with the applicable license and must not falsely represent the modified version as an official modcore release.

You must not use modcore trademarks, logos, or branding in a way that falsely suggests endorsement, sponsorship, or official status.

Where reasonably necessary to avoid confusion, publicly distributed modified versions should clearly identify themselves as unofficial or modified versions.

6.1 Official Identity

You may not represent a modified version as:

• An official modcore release

• An official modcore build

• A release directly maintained by modcore

• Endorsed or certified by modcore

unless we have expressly authorized that representation.

6.2 Internal Modifications

These requirements do not prevent you from making private modifications for your own use that are not distributed to third parties.

7. Branding and Trademarks

modcore's name, logos, visual identity, trademarks, and other branding remain the property of their respective owners.

An open-source license covering source code does not automatically grant permission to use modcore branding.

You may retain required attribution and license notices when permitted or required by the applicable license.

You may not use modcore branding in a manner that:

• Implies official endorsement where none exists.

• Misleads users about the origin of software.

• Suggests a modified version is an official release.

• Damages or deliberately misrepresents the modcore brand.

8. Third-Party Software and Services

modcore software may interact with or depend on third-party software, APIs, platforms, or services.

Examples may include:

• GitHub

• Chrome or Chromium

• Microsoft Edge

• Browser extension APIs

• Cloud services

• Patreon

• Discord

• Other APIs or third-party infrastructure

Third-party services are controlled by their respective providers.

Their availability, security, terms, licenses, and data practices may change independently of modcore.

Where third-party software is included in or distributed with a Tool, its applicable license remains in effect.

You are responsible for complying with third-party terms that apply to your use of those services.

9. Updates and Availability

modcore may update, modify, replace, or discontinue features or entire Tools.

Updates may:

• Add features.

• Remove features.

• Change functionality.

• Introduce breaking changes.

• Fix security issues.

• Change compatibility requirements.

• Modify internal implementations.

Official browser-store releases may update automatically according to the relevant platform's update system.

You may be able to disable automatic updates through your platform or browser settings, but modcore may not provide support for outdated versions.

We do not guarantee that old versions will remain compatible with future browsers, operating systems, APIs, or third-party services.

You are responsible for maintaining appropriate backups of important data.

10. Discontinuation

We may discontinue a Tool or a particular distribution channel.

Where reasonably practical, we may provide advance notice through an official modcore communication channel.

Advance notice may not be possible where immediate action is necessary because of:

• Security vulnerabilities

• Legal requirements

• Platform restrictions

• Abuse

• Technical emergencies

• Third-party service termination

• Other circumstances outside our reasonable control

If a distribution platform removes an official Tool, we may provide an alternative distribution method where reasonably practical, but we do not guarantee that an alternative will always be available.

11. Privacy and Your Data

Our software is generally designed to perform as much processing as reasonably possible on your device.

Depending on the Tool and its configuration, certain features may communicate with external services.

Examples may include:

• Update checks

• GitHub APIs

• Optional cloud functionality

• Authentication services

• Error reporting

• Analytics

• Other network-dependent features

The exact data practices of each Tool are described in our Privacy Policy and, where applicable, the product's documentation.

You are responsible for:

• Your locally stored data.

• Your device security.

• Your account credentials.

• Maintaining backups.

• Exporting important data where appropriate.

• Reviewing permissions requested by the software.

12. Security and Responsible Research

We welcome good-faith security research intended to identify and responsibly report vulnerabilities.

Security research must not involve:

• Unauthorized access to systems you do not own or have permission to test.

• Theft or exposure of personal data.

• Denial-of-service attacks.

• Destructive activity.

• Fraud.

• Extortion.

• Deliberate disruption of modcore services.

Security researchers are encouraged to contact us before publicly disclosing a serious vulnerability where reasonable.

We may request a reasonable coordination period so that a security issue can be investigated and, where possible, fixed.

This section does not restrict lawful security research rights or rights provided by applicable law.

This section also does not grant permission to access Patreon-exclusive builds, private infrastructure, accounts, or systems that you are not otherwise authorized to access.

13. Prohibited Uses

You may not use modcore software to:

• Violate applicable law.

• Distribute malware or malicious software while falsely representing it as modcore software.

• Deliberately compromise or disrupt modcore infrastructure.

• Circumvent technical access controls for unauthorized purposes.

• Remove legally required license or copyright notices.

• Commit fraud or facilitate illegal activity.

• Impersonate modcore or its developers.

• Misrepresent unofficial modifications as official modcore releases.

Nothing in this section prohibits activities expressly permitted by an applicable open-source license.

14. Support

Support is provided on a best-effort basis.

We do not guarantee:

• A specific response time.

• That every reported issue will be fixed.

• That every requested feature will be implemented.

• Compatibility with every device or browser.

• Continued support for old versions.

• That a Tool will remain available indefinitely.

Security-related reports may receive priority where appropriate.

15. Warranty Disclaimer

To the maximum extent permitted by applicable law, software covered by this EULA is provided "as is" and "as available."

We do not guarantee that a Tool will:

• Be completely error-free.

• Remain continuously available.

• Work with every environment.

• Remain compatible with future platforms.

• Meet every particular purpose or requirement.

Nothing in this section excludes or limits warranties or statutory rights that cannot legally be excluded.

Where an applicable open-source license provides its own warranty disclaimer, that disclaimer also applies to the relevant Open-Source Software.

16. Liability

To the maximum extent permitted by applicable law, modcore is not liable for indirect, incidental, special, consequential, or similar losses arising from the use of a Tool.

This may include, where legally permitted:

• Loss of data.

• Loss of revenue.

• Loss of business opportunities.

• Loss caused by third-party services.

• Loss caused by browser or operating-system changes.

• Loss caused by incompatibility.

• Loss caused by unofficial modifications.

We are not responsible for data loss resulting from your failure to maintain appropriate backups or from events outside our reasonable control.

However, nothing in these Terms excludes liability for data loss or other damage caused by our own intentional misconduct or gross negligence where such liability cannot legally be excluded.

16.1 Germany and EU

For users in Germany and the EU:

• Liability for intentional misconduct remains unaffected.

• Liability for gross negligence remains unaffected where required by law.

• For ordinary negligence, liability may be limited to breaches of essential contractual obligations and foreseeable damages where legally permitted.

• Liability for injury to life, body, or health remains unaffected.

• Mandatory statutory liability remains unaffected.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Patreon payments and membership-related claims are governed separately by our Patreon & Payment Terms where applicable.

17. Termination and Restriction of Official Access

We may restrict or terminate access to official distributed versions or related services where reasonably necessary if you:

• Materially violate these Terms.

• Use the software for unlawful purposes.

• Attempt to compromise modcore infrastructure.

• Abuse official services.

• Circumvent access restrictions.

• Violate applicable platform requirements.

Where termination concerns an Open-Source Software component, termination of access to official distribution channels does not revoke rights already granted to you under its applicable open-source license.

You may continue exercising rights provided by that license.

Termination may, however, prevent you from receiving official updates, support, or access to proprietary services or components.

Sections concerning intellectual property, disclaimers, liability, disputes, and other provisions that by their nature should survive termination will remain effective.

18. Age Requirements

Unless a particular Tool or applicable law requires a different age:

• You must be at least 13 years old to use modcore software.

• If you are under 16, you should have permission from a parent or legal guardian where required by applicable law.

Some services or features may have separate age requirements.

Patreon financial support is subject to the age requirements stated in our Patreon & Payment Terms and applicable Patreon policies.

19. Feedback

You are welcome to submit feedback, suggestions, bug reports, or ideas.

Unless otherwise agreed in writing, you grant modcore a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, and incorporate submitted feedback into our software, documentation, services, or future products.

You do not transfer ownership of your independently developed intellectual property merely by submitting feedback.

You represent that you have the right to submit the material you provide and that doing so does not knowingly violate another person's rights.

For actual code contributions, the applicable repository contribution guidelines and contributor license requirements may apply separately.

20. Indemnification

To the maximum extent permitted by applicable law, you are responsible for claims, damages, and reasonable costs arising directly from:

• Your unlawful use of the Tools.

• Your material violation of these Terms.

• Your unauthorized distribution of proprietary components.

• Your intentional misuse of modcore software.

• Your distribution of third-party material without the required rights.

This section does not require you to indemnify modcore for claims caused by modcore's own unlawful conduct or liability that cannot legally be transferred to you.

21. Patreon and Membership Separation

Patreon memberships are separate from ordinary software licensing.

Purchasing or maintaining a Patreon membership does not grant ownership of modcore software or intellectual property.

Patreon memberships, payments, refunds, membership access, and Patreon-exclusive content are governed by our Patreon & Payment Terms where applicable.

Patreon-exclusive software may also have a separate software license or EULA accompanying the specific release.

Where Patreon Content is merely promotional, developmental, informational, or otherwise not software, our Patreon & Payment Terms generally govern its use rather than this EULA.

Nothing in a Patreon membership overrides an applicable open-source license.

22. Governing Law and Disputes

These Terms are governed by the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are an EU consumer, this choice of law does not remove mandatory consumer-protection rights available to you under applicable law.

For German residents, jurisdiction is determined according to applicable German procedural law.

For merchants and other users where permitted by law, German courts may have jurisdiction as provided by applicable law.

Nothing in these Terms prevents a consumer from bringing proceedings in a court that has mandatory jurisdiction under applicable consumer-protection law.

Patreon payment and membership disputes are governed separately by the dispute provisions in our Patreon & Payment Terms where applicable.

23. Changes to These Terms

We may update these Terms when reasonably necessary, including because of:

• Legal or regulatory changes.

• Technical changes.

• New software features.

• Changes to distribution platforms.

• Security requirements.

• Organizational changes.

• Clarifications or corrections.

The latest version will be published through an official modcore channel.

For material changes, we will provide reasonable notice where appropriate.

If you continue using a Covered Distributed Version after the updated Terms become effective, the updated Terms will apply to your continued use to the extent permitted by applicable law.

Nothing in this section retroactively changes rights already granted under an applicable open-source license.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will continue in effect.

25. Entire Agreement

These Terms, together with the Privacy Policy, applicable open-source licenses, applicable third-party licenses, and Patreon & Payment Terms where relevant, constitute the applicable agreements governing your relationship with modcore concerning the relevant Tool or service.

Different licenses or terms may apply to individual components.

An applicable open-source license always remains effective for the Open-Source Software it covers.
