These Terms cover the Merkaba Pro iPhone app and the website at sites.google.com/view/merkabapro (together, "Merkaba Pro"). Merkaba Pro is made by Paul Arbs, an individual developer in Connecticut, USA ("we", "us"). By downloading or using Merkaba Pro, you agree to these Terms.
1. Apple's license agreement
The app is licensed, not sold, through Apple's App Store. Your use of the app is governed by Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), together with these Terms. If they conflict, Apple's EULA controls for the app. Apple isn't responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of the EULA and may enforce it.
2. Your license
We give you a personal, non-exclusive, non-transferable license to use Merkaba Pro on Apple devices you own or control, for your own non-commercial use, as allowed by Apple's Usage Rules.
3. Free version and Full Unlock
Merkaba Pro is free to try. An optional Full Unlock is a one-time, non-consumable in-app purchase made through Apple. There's no subscription and nothing renews. Prices are shown in the App Store. Apple processes all payments; we never see your payment details. Use Restore Purchases in Settings to restore the unlock on another device signed in with the same Apple ID.
4. Refunds
All refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can't issue refunds directly.
5. Acceptable use
Please don't copy, resell, redistribute, reverse engineer or modify the app or its audio, narration, artwork or code (except where the law allows), get around the unlock, or use Merkaba Pro in any unlawful way.
6. Intellectual property
The Merkaba Pro name, logo, app design, artwork, narration scripts, recordings and other content belong to Paul Arbs or his licensors and are protected by copyright and trademark law. Ancient symbols and traditions themselves belong to everyone; our particular expression of them is ours.
7. Wellness, not medical care
Merkaba Pro is for relaxation and general wellness only. It isn't medical or psychological advice, diagnosis or treatment. Please read our full Disclaimer (sites.google.com/view/merkabapro/disclaimer), which is part of these Terms. If you're in crisis, call or text 988 in the US or contact local emergency services.
8. No warranty
Merkaba Pro is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, and we don't promise it will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special or consequential damages, or any injury, arising from your use of Merkaba Pro. Our total liability for any claim won't exceed the amount you paid for the app or the Full Unlock. Some places don't allow these limits, so they may not fully apply to you.
10. Third-party links
Merkaba Pro may link to Instagram, Apple or other sites. Their own terms and privacy policies apply.
11. Governing law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules, except where your local consumer law gives you rights that can't be waived.
12. Changes
We may update these Terms. The current version will always be posted at sites.google.com/view/merkabapro/terms with its effective date. Continuing to use Merkaba Pro after a change means you accept it.
